    Hello Friends,

My wife I-485 status based on K1 visa was changed from ready for interview (as of May, 08 2017) to can't provide information and you have to call.

Her application is with Dallas service center, and just (waiting for interview status) it's going to be 12 months in few days. Is that normal? Does anybody completed a year waiting for the interview?

Thanks a lot for your response,

Did she get her EAD before the waiting for interview status? Coz i didnt get my EAD until now, its almost 6 months and im scared i have to wait for a year more before the interview without a job still.

    Thanks

Hey guys, Got my AOS interview on the 3rd of may, really excited BUT got a problem.

I am a K1 visa holder who married their fiance in 90 days and submitted i485 shortly after. I didn't submit my vaccine record WITH my I485 package but I submitted it WITH my K1 Visa when I entered the USA.

    My history is this:
    - Medical exam overseas in Australia ( I have my completed Ds-3025, everything's good all positive and correctly filled out and signed) Feb 09 2017
    - i485 started June 12 2017 (didn't send DS-3025 with I485)
    - i485 received June 27/2017
    - I485 interview may 03 2018.

So I submitted my medical with my K1 visa but NOT with my i485. It says that my DS 3025 is valid for one year after submitting my I485 (Completed and waiver signed that I had no problems, all my immunizations and was good health).
So would that mean since I submitted my I485 IN the same year as my medical that was in my K1 Visa (5 months apart) it would still be valid for my exam on the 3rd of may 2018 even though my DS-3025 says it expires on the 09/30/2017?

    1) You are not required to have another medical examination as long as you file your Form I-485 within one year of an overseas medical examination.
Filed i485 in the same year as the overseas medical exam that was sent with my K1, didn't know if that means filed I-485 with MEDICAL or not?

What has lead me to this confliction is does the 1 year trial start FROM WHEN THEY RECIEVE MY I485 AOS PACKAGE and if so is my DS-3025 still valid if the form itself says it expires on the 09/30/2017 or does that get ignored for the 1 year valid point thus being it would officially expire on june 12 2018?

At this rate I feel like I should be safe to attend my interview with my DS-3025 which they should have for my K1 Visa just wondering if I should be comfortable about it or not. Or if I actually need a 693 form filled properly. Thank you so much in advance

    Hi,

How was your interview? Did they ask you to do medical again. I' m waiting for my interview schedule now. And my concern is my medical also if i needed to do it again. I did mine May 2017 and applied for my AOS after we got married on November. If i based on my medical exam date, it will expire this month already. So if they schedule me next month, its expired already. So how did it go to you?

    Thank you

Hey, sorry I am posting this most likely not in the correct place but I couldn't find the subforums for this, this site confuses me often.

I am on my 178th day waiting for my EAD and I received expedite instructions almost 2 weeks ago and faxed in my documents the day after. Does anyone know when I can expect a response from them with their decision? Does it takes weeks and weeks?

And according to my online account they have mailed me two letters with response to 2/4 service requests I've made, the first one was mailed April 10th and the other April 19th, I still haven't received anything in the mail.. Strange since my expedite instructions were mailed April 11th and got here April 16th. My address is up to date and a USCIS agent on the phone told me it takes the postal service up to 30 days to deliver letters... lolwhut?

Hi, i didn't reciv my EAD until now too. I filed Nov. last year. I did a service request twice after 90 days and they responded after almost a month i think. Then after a week, they sent me an RFE for my hubby's recent income tax return. So i sent them a copy and they received it on Apr. 24. I checked my status after a week and it was changed to 'Case is ready to be scheduled for interview'. I was expecting for them to approve my EAD but now im scheduled for interview already. I mean, still waiting for the mail of the interview appointment.

    Hey,

Since June 29th 2017 on the https://my.uscis.gov/ website I see "We are scheduling your interview".

My field office is San Francisco and I adjusted from K-1.

About 4 months ago I received a response via email from USCIS regarding an online inquiry I sent about my case, where they said "we are scheduling your interview and if you do not hear from us within 3 months from this notice please call".

I called, and they still gave me the same meaningless answer...

Is there any point in calling USCIS to receive case updates now or should I simply wait longer? When should I get concerned?

    Thanks!

    Hi,

My status was changed 2 days ago and it says 'Case is ready to be scheduled for an interview'. I filed my AOS from k1 last Nov. 2017. I didn't receive my EAD until now. I did service request for my EAD after 90 days and they responded and sent me an RFE for my hubby's recent income tax return. So i sent them a copy and they received it last Apr. 24. After a week they changed my status to that. Now i'm apprehensive after reading your post that its almost 1 year now and still they haven't schedule you yet.

But did you get your EAD? Coz i didnt get mine until now.

I entered the country on K1 visa in April 2017, and I filed one unsuccessful AOS in June. I am now scheduled for a green card interview for the application I filed January 4th. I got my medical done beginning of February 2017. My green card interview is scheduled in May. I called USCIS to inquire if I will have to do another medical and they informed me that it’s at discretion of the officer. I already received my EAD without any RFE. I am just worried if they are likely to ask for another medical since my interview is way past one year from the date when I got my medical done, but my AOS application was not.

My medical exam overseas will expire this month also and my case status says case is ready and to be scheduled for interview. So it might be anytime next month. I'm also thinking of doing the medical all over again but i might just waste my money. Unless indicated in your interview letter notice that you have to do medical again, then do it. If not, just wait during the interview if the officer will ask. Ive read few threads that they got an RFE during an interview for the medical only. Some dont even if its more than a year already. So it really depends on the officer.

    Good luck to us. 😊

    Hello,

My wife and I are about to file for the Adjustment of Status, and I know that I have to provide tax information. I am behind in my taxes and am sending those in to get filed, however, I am just wondering if I can go ahead and file for the AOS using my current W2's as my proof of income? Or do I actually have to wait for the IRS to send back any information? Any assistance and advice would be greatly appreciated, I thank you all.

I sent my AOS last nov 2017 with w2's only from 2014-2016. I received an RFE 1st week of Apr and they asked for the recent federal income tax return. So since the filing was just over apr 17, i cant provide a transcript yet. So crossing fingers, i just sent a copy of 2017 W2 and the copy of 1040EZ as a proof that he filed the recent year. If i were you, just wait til you gather all the requirements before sending the AOS application. Coz if you get an RFE, it will be the same. You will wait more.

    Hello.

I need someone's advise who experienced same situation as me.

I applied for I-765 (Employment Authorization) last September with I-485 and I-131. I received an letter saying they received my paper work on October 2nd, 2017.

Now, it has been almost Five months! I am really worry whether my paper got lost or had any issues like missing information or something. But I haven't received any e-mail or letter from them.

I checked other people's status and many people who submit their paper after November, 2017 got approval already...

I called USCIS today and the lady I spoke to said she is going to send 'service request '. Whats worse is my husband has government health insurance and I was able to join his health insurance from this January but  I was told that they are going to remove me next week unless I show them 'proof of legal status' . I showed them a letter I received but they said they need EAD

Please share your story if you went through similar situation as me. Or how long it took you to get EAD:cry:

    Thank you!

    Hello,

I sent my AOS app along with my EAD+SSN & AP last November 6. I received the NOA 1 and did my biometrics on Dec. 6. After that, I didn't hear any update anymore. I just waited for the 90 days and made a service request online twice around 1st week of Feb and 3rd week of Feb. I received a mail on Mar. 23 that they got my service request and working on it already. April 4, i received an RFE for aff. of support for the recent federal income tax return. My hubby just filed his 2017 return and IRS won't give any transcript yet this fast since they just finished the filing yesterday. So crossing my fingers, i just sent them a copy of his W2 and 1040EZ as proof that he filed his tax the recent year.

If i didn't send a service request, i don't think they will even notice my case. This is crazy coz i cant do anything until now. I don't have SSN too since i applied it with my EAD.

    Good luck to us.

It was just the form. We got help from Block Advisors and he gave us the signed copy of 1040 Individual Income Tax Return Form for 2017.

We sent one copy to IRS one copy to USCIS at the same time.

Thank you. I might do the same now. I'm sure USCIS knows already that we can't have the transcript right away after filing. At least, we gave them a proof that our sponsors filed the recent tax year though.

    Crossing fingers now.

    Thanks

I am not more knowledgeable but I am  a September filer and  we received an RFE for the most recent tax year around the same time with you.

We send copy of 2017 W2 and 1040 to USCIS 10 days ago and they said they received it there was no problem with it.

But of course I am still not quite sure what to do when it comes to USCIS :)

I only got a copy of the 1040EZ form after he filed at turbo tax last week. Its not a return tax transcript yet from IRS. Is the 1040 you sent was the tax return transcript from IRS already or just the form and proof that you filed already.

    Thanks

  10. Hello Guys!

I'm a November filer. Just wondering if any of you received an RFE for the most recent tax year?

I got and RFE last Apr. 4  asking for it. My concern is, the filing will be over until tomorrow. My husband filed his income tax return already. But I can't request for 1040 yet since IRS can't provide it right away after filing this year. They gave me 87 days to comply my RFE. I can request for 1040 by the end of May only and it will take up to 75 days. I only have until July 1.

Is a copy of 2017 W2 and 1040EZ  (summary of the return) form will be enough to send this time as a proof that he really filed? or should I wait for the complete 1040?

Anybody who has the same predicament as me? Need advice.

    Thanks

Our EAD/AP was just approved a few weeks ago, and we also waited 131 days (receipt date: Sept 12).

We made several service requests online that went unanswered. Finally we made another one over the phone and that one was marked 'complete' about 10 days later. The EAD/AP was then approved the following week.

Lots of people have had various service requests go unanswered though. I'm not even sure if our service request was related to our eventual approval.

EAD/AP processing times are taking a bit longer now, I'd say the average wait time is now anywhere from 75-160 days. There are still a handful of August filers waiting along with September filers.

    Hi. Good day!

Im trying to contact the USCIS with the costumer service number provided and i chose the one for checking the application status and theyre asking for the receipt. So i just typed my receipt number since i cant type the MSC letters, but theyr saying its incomplete. I want to check my EAD status coz its more than the processing time already. How can i talk to any of their representative since i cant find any option in the number they gave.

    Thanks

I got my SSN the first week I arrived, it had conditions on it saying I cannot work which means I have to go back into the office once my EAD arrives to get those conditions removed.

You don't have to do it that way but I just wanted to get it so I could open a bank account.

I applied mine along with the EAD already but I thought it will arrive sooner than the EAD.

    Thanks you.

You apply to the Social Security Administration for a SSN. This will not be given until you can show proof lawful presence and are legally permitted to work; essentially you need to have your EAD Card in hand when you visit your local SSA office. You will also need to take your birth certificate, unexpired passport and proof of a physical mailing address. Check the SSA website for details.

BTW do not make the mistake I did and go visit SSA the day after your EAD arrives. You need to leave it at least 10 days as it takes time for the computer system to update with your approval details - otherwise the SSA make a written enquiry and that can take weeks (11 so far in my case!) to come through.

Thanks for your help. :) hopefully, i'll get get mine soon. Can't wait to work anymore. Boredom strikes already.

  17. Hello VJ's,

    Happy New Year to all..

I just forwarded my AOS along with EAD+SSN (new updated form) and AP last November. I did my biometrics first week of December already.

I'm just wondering about my SSN. Coz if I get it myself, it would be faster right? but since I included it with my EAD, I still don't have one for 2 months now.

Does anybody applied the same as me?

Are they gonna send it together with EAD?

    Thanks

    You think so?

But does that mean it's going to take even longer for the AOS process? Or no?

I just thought the purpose of biometrics is for them doing background checks in order to proceed with the AOS application (or EAD/AP but appearantly not :D)

I got my biometrics appointment on Dec. 6. I filed Nov. 6. In the notice is says its for the AOS and EAD. AP doesnt need biometrics anymore. Youre lucky you got approved in EAD without biometrics. 😍 Congrats. 😊

No, just the W2 is not sufficient.  Does your American husband not know what a tax return is?  Or what the IRS is?  Google is your friend here.

W2s or 1099s + the complete tax return    OR  tax transcripts.  It is that simple.

That's what his employer gave him every year, his w2 form since theyr the one dectucting it from his salary automatically.

I actually checked in google IRS vs W2 and it says "When a person is paid on the form W-2, the employer automatically withholds and pays all of the necessary employee income taxes as required by the IRS."

So a complete w2 of a whole year round is not a complete tax return yet? Or he needs to request a tax transcript from IRS still.

    Enlighten me please. Thanks

  20. 22 hours ago, kleenex said:

@Smooch-Esther you don’t have to worry about this year. :) they care about the most recent one (2016) and they want complete tax return information. So just make sure you have everything tax related from the last year.

They RFE me complete tax return, but we did not really understand that they want complete documentation so we ended up mailing them only W2 which wasn’t sufficient and hence they denied my aplication.

I did not get anything since those two applications require the same documentation. I did not get my work permit nor a green card.

i basically have to do it all over again and pay all the fees.

i am trying to figure out if by scheduling infopass I can convince them to reopen the case and take the additional evidence into consideration. I doubt they will since it was our mistake, but at least I’ll try.

But all i sent them was a photocopy of my hubby's W2 forms only from 2014-2016. That's all. Would that be enough? Coz you said W2 wasn't sufficient in your application also. Coz i dont know if IRS and W2 is the same thing really. But since my husband said all he got was w2, then i just sent a copy of it. That's the same copy we gave on his K1 petition for me too.

Im scared i will be denied too becoz of that now..huhu

  21. Hi.. i just sent my AOS packet last nov. 3 and they sent me msg already that they received it last Nov. 13. I only included my husbands w2 forms from 2014-2016 since we cant have the 2017 copy yet til this year ends.

Now im apprehensive that i might experience the same as you. Is the IRS and w2 form the same? Coz my hubby said he only got that w2.

Were you still able to recieve your EAD and AP despite of the denial?

    Thanks

It's very common. The official notice says to wait for the letters in the mail before you check your status online, but mine took almost 3 weeks to even show up. But don't worry about it. As long as you have your NOA1's, you're all set.

Thanks. Makes me feel better now. 😊
