    Don't  know if I'll get my passport as fast as you and the rest who did routine service but I think I would have been pissed paying for expedited service. You and a lot of others who did routine service got passports in less than two weeks. Meanwhile, expedited service promises two to three weeks processing time.

     

    Got an email alert today on passport status btw.

    When I spoke with a Tier 2 officer to get my interview date he advised that I would need to have a copy faxed to me if I still haven't received? Anyone had to do this and did it work out?

     

    Can understand why the simple process of sending a letter takes so long its been weeks.

     

    Anyone experienced this?

     

     

    It's too late to tell you schedule an InfoPass or reach out to your congress person. I would try calling again and keep calling until you get some results. If that doesn't work I would go to the field office without an appointment to see what if anything can be done.  At last resort I would show up for the interview without letter to see where it goes.

    That's pretty fast. Expedited application? I did regular. Would like to have it quicker just because but could not justify spending the additional $60. Was also gonna do the card but just upgrade my driver's license to the enhanced version only available to US Citizens.

    Nothing else is needed...extra space to accommodate your fan base maybe?:D

I went back my home country right after my program was over and got a student visa and came back to the States within a month. If it says "two years rule does not apply" on your J1 visa, you can come back at any time. Even though if it says "two years rule apply" you can apply to remove it. I wish the issue was that but unfortunately her situation is more complicated than that. But, i do appreciate for your respond.

    I read this but for some reason still thought it was tied to the J1.

    Here's my problem. I read a post a few months ago that involved a J1 visitor not being able to adjust because of the restriction. I formed an opinion about this situation before taking the time to really understand what's going on.

  9. I tried reading and understanding all previous posts before weighing in so please forgive me if I missed or misunderstood something. I believe the issue here is that your friend came here on a J1 visa. You cannot adjust from that status unless you have an approved waiver. There's a 2 year waiting period. Your friend needed to go back to home country for 2 years before applying for Green Card.

    Waiver of the Exchange Visitor Two-Year Home-Country Physical Presence Requirement

    Overview
    Certain exchange visitors (J-1) are subject to a two-year home-country physical presence requirement which requires you to return to your home country for at least two years at the end of your exchange visitor program. This is also known as the foreign residence requirement under U.S. law, Immigration and Nationality Act, Section 212(e). If you are unable to return to your home country to fulfill the two-year requirement, you must obtain a waiver approved by the Department of Homeland Security prior to changing status in the United States or being issued a visa in certain categories for travel to the United States.

    I did mine on the spot. Took about 2 mins. It really doesn't matter if you do it at home or on the spot as long as there are no changes since you had the interview and the date entered is same as the oath date.

    My wife had her interview exactly a week after the two of you.

    She was approved and are waiting on the oath letter.

    She should hear something pretty soon if she's not doing a name change. NYC is moving a lot faster than I thought it would...not for all but a lot of folks got through pretty quick.

    Purplish blue button down but solid color. It was hard to see my family from where I was seated. Looked back couple times but gave up. I'm sure we cross paths but that guy wasn't me.

    Haha! One of them was mine (in the back, not the one all the way upfront). Family had to be there for this. There was a tossup on whether or not we should take the train...we choose to drive because of the baby. Almost regretted driving. The drive down to Federal Plaza on a day with normal congestion around the time we left 8:45AM is about 1hr. It took us more than 2hrs. Traffic was a nightmare. I check the estimated trip time on Google before leaving and it said 1hr 8mins but that went up to 1hr 46mins when we got to the highway. To make matters worse, the parking lot we scoped out the day before was already at capacity so we had to find another. Still made it to room 310 before 11AM but after sitting with the wife and kids for about 5 mins I found out that I was supposed to be in another room for prepping. 

     

    As you know, ceremony started significantly later than 11 so I probably would have made it even if I was a little late. I looked out for anyone standing when Taiwan was called but the room was too crowded. If you were that person looking at me like you knew me right when I was taking my pic after the ceremony, you can say "we met". 

     

    Congratulations to you and best wishes with the new level of freedom.

    My story is one of those with a lot of twists and turns, ups and downs etc. VJ has really helped me a lot.  I hope to stick around for as long as I can so I can pay it forward. Besides, it can be fun here sometimes. I like reading those stories involving long journeys with great outcomes.

    That's right. Doesn't matter who is responsible for the oversight. You could have been as honest and forthcoming as possible and it would not have made a difference. 

     

    @Koki Ali: A lot of what's being said here isn't what you want to hear but it's the truth. You're pretty much out of options. Your best hope right now is another oversight. A situation where they do not take steps to revoke your Green Card and keep issuing renewals unaware of your ineligibility because somebody screwed up the paperwork again. Your other option would be what I mentioned before. A 601 waiver based on the grounds that your deportation will create severe economic hardship for a US citizen (wife and kid). Using the forth recognized level as a qualifier for those grounds is weak but hey...a slim chance is better than nothing.

     

    Be on the lookout for notices and hope that you do not get the dreaded Notice to Appear. If you do, don't ignore it...doing nothing makes deportation easier. It will speed up a process that could take years.

    Here's a shocker - I got through the entire process (including AOS) without submitting tax document. My wife and I always file taxes separately  because it gets her lower student loan monthly payments. However, I walked with 3 years of transcripts for the both of us because I was certain they would ask...my interviewing IO didn't. As a matter of fact she only took updated bank statements spanning from the time conditions on my GC was lifted up to the interview. She said my "file was thick enough". Other people have reported similar stories about additional documents as well. I see you did not mention bank statements...I would advise that you walk with at least one year's worth. You should also walk with originals of the copies you submitted (eg. marriage certificate). I did that but like I said, she was only interested in updated bank statements. 

     

    I did not walk with the 2 photos and she asked if had any.

    Thanks! Still trying to decide on what to wear. I love jeans. I wore jeans to my interview. I looked very presentable of course. I was thinking of doing a shirt, tie and blazer with jeans and dress shoes but the wife says no jeans so slacks it is (or is it?). I've heard of people being sent home for wearing jeans but the act of wearing jeans to the oath may not have been the only reason. Some said they wore it with t-shirt and sneakers.

     

    BTW: There's no outright ban on jeans like some suggests. They just ask that you "dress in proper attire..."

  19. @Koki Ali: Your only hope of staying in the US and not living in the shadows lies with immigration court. You may have a slim chance at a successful 601 waiver application but you will have to be placed in deportation proceedings first. 

     

    Read: Extreme Hardship and the 601 Waiver: Can I Avoid Deportation? I really need to stress that your chances here are very slim at best. Some people purposely get themselves in immigration court to take a shot at this but I would advise that you wait to see what if anything will be done about your situation and use that defense. 

     

    You mentioned your debt. That's a level 4 qualifier for a 601 waiver.
