Hello,
My mother has become a US citizen, while my brother was a juvenile, so she was going to get him a passport, using her Certificate of Naturalization to show citizenship. They request his birth certificate with father's name, but the father was not in the picture at the time of the birth, so he's not on birth certificate. Currently, the father's family doesn't know what happened to him to get any type of statement paper. My brother has turned 18 since my mother's citizenship, if that matters. He has a Baptismal with the father's name. Also, he has an expired Philippine passport with visa stamp, and his green card. What can he do for evidence without his father's name on birth certificate since the father is no where to be found?

I added a household member, but I got the surname and given name mixed-up. I don't see an edit or delete option. How can I fix this, or can I do it by adding another household member with correct name, then not submitting the wrong one?
Thank you!

Thank you, Richard! You just made my day!
My HR manager is going to give me a letter when it gets closer to the time, but it seems like it's almost a guess what the interviewers will ask for... or maybe I'm just nervous! haha
Thanks!

If we already have our visa and will be flying back to the US Wednesday...does this affect us? Do I need proof? I am planning on adding him to my work medical insurance...
If you've got the visa, you should be good to go. Maybe keep your insurance card handy - just in case.

Goodness, the HR doesn't even know? This shouldn't be your responsibility... Here's a little publication overview from the DoL https://www.dol.gov/sites/dolgov/files/EBSA/about-ebsa/our-activities/resource-center/publications/life-changes-require-health-choices.pdf
And the exhcange itself: https://www.healthcare.gov/glossary/special-enrollment-period/ SLEQ's for the exchange are 60 days, but job based plans must be 30 days. Generally every single insurer will have language to this effect, surely your HR should know how their own plans work?

Yeah. I was surprised when she asked me to bring her a copy. Thank you for your help!

You should be able to add your spouse, as this is a "life change" event.
I am currently on my mothers healthcare plan. We both work at the same place. I talked to our HR manager about how I go about adding my husband and 2 sons. She told me not to worry because, it's a "life change" event, and I could start my own plan and add them when they arrive.
My HR manager wants me to get a copy of the rule that states they need to be insured within 30 days. Does anyone happen to know where I can find that? Thank you.

Early filing is 3/5 years minus 90 days. You might NOT come up with the same earliest date of filing if you do it your way, especially if you're trying to apply on the first eligible day. Use the USCIS Early Filing Calculator.
Thank you!

That's how we read it, too. Thought we'd check - just in case we missed something.
Thanks, guys!

I came as part of my mother's IR-1 visa when I was 20 - she is now a citizen. I'm 22, and will be in the US for 3 years in February. My stepfather thought I could file at 2 years and 9 months, but he just read that it might be 4 years and 9 months. Is that true?
Thank you for your help!

First run through this from the IRS: https://www.irs.gov/help/ita/what-is-my-filing-status
MFJ would only be available if you had an ITIN or SSN for your spouse. You can still obtain an ITIN....it's a hassle to do so, but others have done so from the Philippines. Hopefully they will chime in.
MFS is the simplest option. You can write in "NRA" for your spouse's SSN/ITIN.
HOH does not seem to apply here as the children were not in the same residence as you.

That's a great link from the IRS!
After I posted I went back to researching and found that I can't claim HOH because I can't be married, but I see the other reasons, now. Thank you!
My eyes are just getting a little tired while I'm trying to figure it out. haha
Thank you!

Hello,
I am a LPR trying to figure this out, and I'm getting a little confused. I am in US for two years, but my husband and 2 children are in the Philippines. They have never been to the US and are all citizens of the Philippines. Children are under 18. My husband and I were married this last year - 2018, so I need to file as married. He does not really work, mostly takes care of our two young boys.
Do I need to get ITIN's for them?
I see the options for filing "Married - filing jointly w/1 income," "Married filing separately," or "Head of household." I think it's head of household. Is that correct?
I know I can't get the Earned income tax credit for the kids or anything like that. I'm just trying to do this correctly.
Thank you for your help!
Thank you!

Hi,
Don't worry about the age gap - happens all the time.
You have enough other evidence, you don't need 36 pages of Snapchat. Just give them a sampling that is representative of your length of time together.
You won't need the AOS, yet, because it will take around 2 years for the I-130 to get approved.
We filed ours in July 2018, so this is just information I have gathered along the way. Hope it's correct.

This is great. I was just getting ready to ask about this. My husband and 2 sons, 3 and 5, will be coming to join me. I will be sponsor, my mother - now a citizen, will be a joint sponsor, and my stepfather will be household member of joint sponsor. Perfect, this is great. Thank you!
-
They need to be within 30 days for the visa, so I imagine it would be the same for AOS. So, if you already used them for the visa, they would probably recognize that they're old and issue an RFE. Get some new ones to avoid any problems.

Mod Hat off
No fee for your son, just add his name. If he is under 18 by the time you take your oath then he gets citizenship through you. He will not get a certificate but you can apply for his own I think it's something like 1200 now for that or you can do like many of us did and use your certificate to apply for his US passport.
Great! Thank you for the info!

I am asking this for my mother:
Sorry, I can't quite get an understanding of what I do to make my son a citizen. I am a LPR who is filing for naturalization. I understand I include his name on my application, but is there a fee, for him, to be included or will that come at a later time? Also, I see the times for the process are getting longer, so there is a chance he may hit 18 before the process is complete. Thank you!

Hi. It has to be a PSA authenticated or aunthorized which was formerly NSO. Please check upper left corner of the document and check whether it says PSA or NSO. If it’s NSO, you’ll have to get a copy that says PSA. Good luck!
Great info. Thank you!
And it does say PSA! Looks like it's going to be a good day!

I've finally got my documents ready to send, except I'm not sure which copy to send. I have a certified copy from the day I was married. It's from City Hall. I also have a copy from NSO. Which should I send? Or should I send both?
Thank you!

For additional proof of relationship, include certified copies of your children’s birth certificates.
I'll do that. Thank you for the tip!

Signed. I am sooo close to submitting all to the NVC. All I need is an NBI clearance, but they're closed until next month!
