  1. Well, they are there to do their job, not to have a nice little friendly conversation. Lets just put it that way LOL

    The 2 times I was in the embassy for paperwork, they treated me real nice, but that one time when Mohand went to get a form notarized to be used in USA, they gave him so much ####### and etc, and would not notarize a legal document for the USA, I called State Dept, raised holy hell of how rude and the un-called for remarks the clerk said to him. I got a call from a supervisor there, a Consular Officer who regrated the situation, and the clerk was written up, but he never forgot it. The same day State Dept called, and said embassy will notarize the paper, and assured me that situation will never happen again.

    The next day the C.O. called me , said Mo just left, paper was notarized, and commented how calm and polite he was threw all the hell the previous day.

    I wont let them treat him like #######, that is the main reason Im going.

    Are you talking about the consulate in Algiers or France? I have heard the consulate in Algiers is nice....

    I will be looking forward to your experience as we are working our way through the process!!

  4. OK Folks - I promised an update. Recall I sent an e-mail to the DHS person a friend of mine sort of knows. Below is the edited text of the e-mail I sent.

    My name is William Rogers and I am an employee of U.S. Civil Service. I was wondering if you could answer a few questions for me regarding my 129F

    Petition submittal. My understanding is that the USCIS reviews and addresses these types of petitions on a case by case basis and in the order they are received.

    BACKGROUND:

    1. I submitted a completed 129F petition w/check on 18 July 2009 to the California Service Center.

    2. My NOA1 date is July 22, 2009 and review time is still within the 5 month goal.

    3. My Receipt Number is XXXXXXXXXXXXXX

    4. I prepared my submission in accordance with the preference outlined in the Instructions for 129F Petition for Fiancée printed by your organization.

    5. To date I have NOT received a request for Further Evidence (RFE).

    6. To date I have not noticed that my 129F has been touched by your agency other than acknowledging receipt and cashing check. I gather this from the USCIS website "Case Status" Section.

    CONCERN:

    1. I track peoples K-1 visa process on various websites. I have since confirmed that the CSC has APPROVED petitions (non-expedited requested and

    non-military) that have NOA1 dates beyond mine. Clearly this is not the order in which they are received.

    Can you explain this to me? I am concerned mine is lost!

    2. If during this process we are still in the background check stage (and if I understand correctly this is a background check for me at this time) for national security - this should be easy... I work for the Department of Defense and do not present a national security threat. Same for my fiancée

    - She worked on a U.S. Army post in Korea and she too had to get checked out.

    I understand that DHS Immigration and DoD are separate agencies but I think we are "checked out (for lack of better terminology)"

    Perhaps by the time you receive this I will have my NOA2 - but if not is there anything I can do to speed this up? Can you tell me why others with

    later NOA1 dates have been processed?

    I would also like to have the name and contact information of a U.S. Government Employee, not a contractor, that can assist me in my query.

    I respect the Mission and Core values of the USCIS. I too have to operate under similar principals with a strong emphasis on customer service as I

    serve the members of the armed forces.

    Please respond concisely to my questions - look into this as I am concerned my 129F is missing or please tell me if I can clarify any concern.

    SO I responded back letting him know I spent some time writing that e-mail and that he didnt ackowledge any question and that he only acknowledged what I stated about the 5 month processing time. I told him I will take the customer service aspect up with the name of the person my friend gave me.

    I will note that in the morning I checked my case status at the USCIS website and nothing - the date of my NOA1. I decided to check before i left work tonite at 6:00 PM HST and I had my first touch. Coincidence - maybe, i'm not sure BUT I am a bit more happier today than yesterday. Good luck to my friends here!     i feel you.. i'm also losing patience.. :angry: i sent my petition 1 week ahead of yours and until now my petition hasnt been touched! i have the same concern that it is lost or what.. Based on timeline data, my I129f may be adjudicated between October 9, 2009 and October 21, 2009..

  5. there is a multiple filing waiver required for a K-1 petition but not one for a spousal visa

    moving to IMBRA forum

    where do i get the waiver ?? we arent married yet

    you don't "get" one... you write a statement about the background regarding your situation and end it with "I hereby request a waiver from the multiple filing limitation......." or something like that

    It looks like you have recovered from your recent situation from a month or so back and are back in the saddle.....

    The IMBRA Filing limitations most definately apply to all K visa's. Do your research if you are thinking about doing this!!

    I posted this in the IMBRA section last night but did not receive any solid information so I thought I would try to post this here.

    Hi All,

    *** I am looking for help not snide comments so if you can not help me please do not respond -- I dont want to sound like a jerk but honestly I can not take any BS tonight! ***

    Here are the facts:

    1. Married to a man in the USA on TPS (temporary protective status). Filed for his residency when 245i opened in 2001. We filed an I130. Relationship ended in divorce.

    2. Married a man in his country and we filed the I130 and I129f - the I29F was approved April 17, 2007. The man split when he arrived - we never adjusted status. I submitted a withdrawl on my affidavit of support.

    3. Filed for a K1 on July 28, 2009 and received a NOID stating that I am not eligible to file for another K1 visa. I have researched IMBRA and it clearly states that you are allowed to petition for 2 K visas in a lifetime without a waiver request, however, the requests must be more than 2 years between the approval date of the first K visa.

    I researched this and thought I did everything correct and now the NOID.... I'm freaking out.... Lawyer or not? Should I try to write a waiver request myself stating the facts ... does anyone have experience in this and if so HELPPPPPP please with the wording.

    I dont want to mess this up!!

    I reviewed the instructions with the I129F form (the most current edition - the EXP date is 1/2010). I am copying in below #2 from the I129F instructions that accompany this form:

    If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver.

    2. Filing Limitations on K Nonimmigrant Petitioners.

    If you have committed a violent offense against a person or persons, USCIS may not grant such a waiver unless you can demonstrate that extraordinary circumstances exist. For details regarding those circumstances, see Item 7.B. of these instructions.

    As stated above I have only filed 1 K3 in the past (I have read other places that for IMBRA they consider the K3 as the K1 -- I get that).

    What I dont get is why I received the NOID. Has anyone ever experienced it and how did you handle it?

    USCIS is requesting a waiver request - I get that too and I have no problem writing that. I have a problem with how to word it as I feel they have made an error in their decision of the NOID.

    I researched this before sending in the petition. Am I totally misinterpreting this?

    Constructional replies only please. The situation (as eveyone else's going through the immigration process) is stressful.

    BECAUSE THE NOID STATES IT WAS ISSUED BASED UPON IMBRA filing limitations.

    If this message is in the wrong area than I apologize.

  8. I have no personal experience with what you are describing, but If you have the appropriate waiver forms, I would suggest submitting them yourself first. The worst they could say is 'no', then a lawyer may be appropriate. (I guess I just have a personal bias against using legal services if it can be helped.)

    You may be able to just reiterate what you stated about IMBRA having a 2 year requirement. Someone there may just not be checking dates very carefully.

    There are no "forms" a letter needs to be drafted and the truth is I dont know what to say or how to word it ... not my forte'!

  10. I am sending my K1 packet today after going to Kinko's to have 2 copies made. I had my brother in law proof read it for typo's, and completeness and my sister also. They are both lawyers, and my sister works for the Veterans Administration so she made some helpful suggestions like make sure photo's are taped to 8.5x11" paper and use a clip to hold the whole package together. She said govt office folks don't like small things spilling out on their desk. So its all clipped and pictures attached to pages etc. Should be good.

    Your photos should be in a clear plastic baggie with your name on yours and your fiances name on hers and then stapled to a plain white piece of paper with the words "Photo of .........." written on it.

    I thought I read that here somewhere in VJ.

    I didnt think they wanted them taped down because they may have to remove them and if they are taped the pics could get ripped.

  11. USCIS -

    I was so excited on Saturday because I got my letter from the NVC telling me that they received an approved I-129F and were forwarding it to the Embassy in Helsinki. I posted something about this the other day and was questioning whether or not it was normal to not get the NOA2 first. Well, Gary and Alla (THANK YOU) told me about calling and talking to an immigration officer... so I did that and the officer said:

    "Wow - you are the 2nd person in a row that has called me about this today . I am sorry, but there is nothing I can do for you for 38 days, you don't show approved in our system so you have to wait until the normal processing time is expired".

    I was really nervous so I called the National Visa Center and inquired if maybe I got a hoax letter or if something was wrong. They told me:

    "We did get your complete packet and it was shipped to Helsinki on the 13th of this month".

    Basically the embassy in Helsinki does not take long to set up interviews and we already have most of the packet 3 done so we are totally dependent on the NOA2 for this interview. I ended up calling my Senator (Really nice people in his office) and asked if they could help me by inquiring as to what the heck is going on. They were totally helpful and have started the process to see why this is happening. I am sure it is just a problem in their computer system or something, but I guess I am a little upset about the USCIS's total unwillingness to even investigate this, or their bureaucratic hold-ups that are preventing them from checking on why there is a problem.

    I just wonder how many people are being effected by this problem right now.

    Oh geez .... This is a totally disturbing thought. The approvals from CSC have been sparse lately. In the July 2009 CSC thread someone noted that quite possibly cases were approved but CSC was having computer issues -- apparently so!

    I hope everything works out quickly for you and there are not many in the same boat!!

I think I would have gone nuts by now if it was me :unsure: It seems as if the approval rate at CSC is stuck at snail pace and it's been a while since someone told us about their NOA2! I feel like a broken record when I'm telling you to hang in there, but I'm sure it WILL be your turn soon!

    Ok so what's going on today .... nothing but the sound of crickets at both service centers. It sure seems like every monday there are very few approvals for K1/K3/CR1 visas. Has anyone else noticed this too (who am I kidding? Of course others have noticed this too!!)

    Waiting impatiently for the mailman in hopes that the NOA2 will just appear without the system updating.

    Poor guy has no clue that I will be ambushing him ... :o:o:o:o:rofl:

I'm relying on the fact that they are having system/internet update issues at CSC because maybe their IT dept is working on VSC system and that's why there's gets updated so quick and fast.

    I am having a very down morning too today. Don't feel like working ...don't feel like doing anything. Today is officially 90 days for me and I was really hoping that by today I would have had something (Yes wishful thinking on my part) ...

    Anyway, I really hope you get news soon Malarie ....Hopefully in the next day or 2 :)

    How amazing would that be. Sleep well ... You know the drill .. A brand new week is just around the corner (ugh - i know that's not comforting - but that's all i got) :(

  16. No touch, no nothing. So I have a friend at DHS and he got me the immigration chief of some section in Washington. I e-mail him from my Government e-mail address and recite thier mission statement as well as the piece in the charter that talks about in order and case by case. I ask him why then are 129F petitions that are non expedited and non military getting to the NOA2 before petitions that have earlier NOA1 dates. These approved 129F's are clearly not first in line! I told him i was concerned that mine was lost. I'm curious if I get a response and if i do what sort of response. OR maybe they'll call CSC and say ####### is going on! Anyway still withing the 5 months but still - the way they are processing goes against what they state...

    Have a great weekend..I'm off to the beach for the entire weekend to forget this stuff!

    We have applied for a K1 visa a couple years ago. everything went fine and we got approved and the paperwork was at the embassy state. We decided not to pursue the matter and gave up the idea. Alien fiance did not send the documents to the embassy and later the US citizen wrote to the USCIS to close the file.

    Now we want to start over and again apply for a K1 visa. None of us has married before, and nothing has changed since the time we first applied.

    I wonder if there is anything we should be aware of, or if we should somehow indicate that we have already applied or not.

    yes you do indicate you have applied before... it is a question on the form

    thank you, we have not filled the forms yet. I am worried if the fact that we have applied before causes any delays or other problems for us this time

    You should be OK as long as you disclose the information and be honest about it.
