    Ummmm YES!!! I called today and they didnt have anything in the computer yet -- of course!!

  2. Did they take money from him for fed ex or did they say he can come pick up it in a few days? If he lives in Algiers, they will let him know when he can get it. If he lives out of town , they will mail it and they would have asked him for the address plus money. Based on what I know about Algiers, he sounds approved and it takes several days of administrative last minute process in Algiers ( my case was a week) and then they release the passport via mail or in person. Sounds very good. Dont worry, just sit tight . It will be ok

    Hey Kat,

    He was given a UPS slip and told he could pick it up at UPS within 8 days of giving the passport to the embassy. At the time he picks it up he has to pay UPS.

    Sound legit? I hate this limbo thing and DOS doesnt have anything yet.

    I guess we must just be patient.

  3. OMG -- Now that is a PLAN!!!

    If anyone else that has dealt with Algeria really wanted to pipe in about how the consulate rolls ..... I would greatly appreciate it!

    Also -- a little update - I received a text from my fiance saying he did receive a paper that says:

    Congratulations -- the consulate has granted you your visa into the USA!!!!

    I get that he has been approved -- I want to know if he's in AP or not???

    Yeah I should just chill -- BUT I CANT!!!!

    Well -- the interview was today. My fiance was the last one to be interviewed.

    I dont have the details about what transpired during the interview, however, the agent told him

    MABROUK!!!!

    Of course ... I need more than just a congratulations :blush: so here's the lowdown:

    The embassy kept his passport

    He wasnt given a 221g

    He was not asked to sign the DS156k ... uh ohhh????

    He was given a receipt to return and pick up the passport/visa and they told him to return in 8 days (security checks??)

    They also told him when he returned for the passport/visa he would be given an envelope that can not be open and is to be given when he enters the USA, along with the xray.

    What do you guys think ... I want to happy dance ... help me out here!!!!

  5. OK so he was the very last person interviewed for the day and he said the agent told him - CONGRATULATIONS!!!!!!

    He left his passport and was told to return in 8 days to pick it up..... security checks????

    I dont know if he was given a paper or not ... Kinda going crazy right about now!

    I wanna happy dance really I do --- really really really I do .......... but dare it too soon?

    Marina had her interview today in Frankfurt. APPROVED!!!!!!!!!!

    I will fly over in March and we will come back on the 24th.

    Congrats!!!!

  8. So i finally managed to get through to someone at USCIS and as usual that person didn't know what she was doing so luckily she transferred me to her supervisor who agreed to start a referral. She said that she contacted the California Service Center to follow up on my case and that the average time it took to reach the NVC was around 3 months. She also said that I should hear back from them within 30 days. Hopefully something might develop.

    If I were you I would still contact your congressman. The congressmans office can make an inquiry on your behalf and it is proven this does help.

    We did not meet 24 months before we sent our application and because of that the I-129F was denied; but we know each other for more than three years and the application was sent just few months out of requested time. We thought our circumstance/reason was valid and we hoped they understand. Now I can’t travel to Africa for professional reason and he could not get a visa to EU bcz currently he is not working and EU countries requested proof of income before issue a visa. My fiancé resign previous job to be able to be with me, use his savings to go back to school and be prepare for new job opportunities in USA; we thought it was the best option.

    Well, long story short we are looking for options that allow us to spend time together and reapply for a k1 visa.

    Please let us know what country do not request visa to Algerian citizen. We are open to suggestion. What do you know about Trinidad and Tobago, Mexico, cruice, etc?

    Y&L -- Just curious -- did you guys request a waiver of the meeting within the 24 months prior to filing the application and if so did you submit that waiver request with the I129f?

    I guess if you did or didnt really doesnt matter at this point and in reality the chance that the waiver would have been approved was very slim -- I dont think I myself have ever seen anyone form this forum granted a waiver of the meeting in person within the 24 months prior to filing the application.

    Very sorry for you guys ... and I have no idea about which countries Algierans can visit/live without a visa.

    There is absolutely no way you can squeeze in a visit? This would be the easiest solution!!

  10. Well .... I havent been here for a while but I have returned with good news FINALLY!!!

    The package I mailed December 16, 2009 finally arrived to my fiance January 31,2010 --- THANKS USPS!!! :blink::blink: and my fiance was able to get all the vaccinations he needed (he completed this in early January but let me tell you it was rough for him -- lack of supply and places to administer --- very frustrating!!) and

    :dance::dance: HIS INTERVIEW IS FEBRUARY 23, 2010 :dance::dance:

    Crossing fingers things go smoothly and taking any prayers anyone can spare!!!

    Maybe he will be here for my birthday in mid March (ok wishful thinking with the inevitable security checks that follow the interview :blush:)

    I hope everyone is doing well and their SO's are with them!!!!

  11. Hi All ... I hope everyone's process is going well or their mates are already here!!

    Question for anyone who wants to give their opinion.

    I mailed all of my documents for P3 to my fiance on December 16, 2009 and he has still not received them ( :blink::o ). The online tacking of the package shows it left the international dispatch in NJ on December 19, 2009 and then nothing. I have contacted the USPS and they are tracking it but they said it could take up to 60 days for a response to the inquiry (very nice huh). I did pay for the extra insurance but apparently it doesnt mean squat because it still is not there.

    Now I need to make a decision -- Gather a new set of papers and remail them or should I wait a little longer?

    We dont want to schedule the interview until he has the papers in his hand to avoid problems if the mail gets screwed up again.

    To mail or not to mail?

  12. A little update from me ...

    He's here ...but we have been having adjustment issues ...and great shock for him. He has been here for a week....and he had never been to the states before ...so I think he is going through all the emotions right now...stress, withdrawal, worried etc.

    I'm hoping that the america i fell in love with will hit him hard soon....

    How is everyone else doing???

    Do you all remember when we had all just sent in the 129f app and we were waiting and waiting for our damn NOA2....and Jewel (Julie) would do her mathematical calculations and keep track of everyone's progress? We have come far haven't we.

    Marie - how exciting that he is here!!! It will get better. He is going to have a major cultural shock -- that is just a given. Try to be patient with him and if possible keep him busy!!

    For us ... we are still waiting on the package of documents that I mailed on DECEMBER 16,2009 to get to him. I'm very worried it has been lost -- frightened actually -- all of my personal information is in there!!! I mailed it via the USPS and I did pay for the extra insurance so do you think it could have gotten stuck in customs for this long???

    Once he receives the package things are ready to go ... this waiting is torturous.

    I'm so ready for all of this to be done. My family has been through so much the last couple months. We need him here.

  13. Entering the lottery is not the same as applying for a visa so it does not need to be disclosed. The lottery is only an opportunity if you win to then apply for a visa.

    Ok thank you for your replies .... So it is safe to say because the beneficiary was NOT selected for the DV Lottery it does not need to be put anywhere on any forms ? (I129F and the DS156, DS156k or DS157 --- not too sure if all of these even ask about prior visa applications but I want to cover all bases here).

  14. Good Morning VJ'ers,

    I am trying to help a friend with her and her fiance's K1 visa papers and a question has come up that I dont know how to answer. The beneficiary previously tried for the DV Lottery. He was not selected, however, did submit the application online (in 2007 or 2008).

    Does this need to be noted on any of the K1 visa forms and if so where?

    She has looked over the forms and myself as well and I dont see a place for it. I thought I remembered reading something that it needs to be disclosed on the forms or there could be issues. :wacko:

    Any information would be much appreciated!

  15. Your interview is MONDAY!!!! Wow that was quick ... the last time we pm'd you had just send out your package to him. How very very exciting!

    My fiance is having a little difficulty finding the vaccines he needs. He is down to the last one and is going next Monday to the capital to get it.

    I am hoping the package I sent him last week is received in the mean time and if so he will call the consulate to schedule the interview.......

    It seems like its taking forever to get the things together for packet 3 .... anyone else feel this way???

    I don't have one either before,during the interview the CO won't mind if she has an engagement ring or not. I just brought with me every single evidence that we have bonafide relationships.

    You need to include a fiance letter of intent to marry. There are examples of this letter in the "Example Forms" section of this website. It is a good idea to send an updated letter of intent so she can bring it to her interview.

  17. It could never hurt to request a waiver -- if you dont need it then whatever but if you indeed do then they will have it and be able to process your petition.

    There are waiver wording examples in the IMBRA forum (I believe!)

    I petitioned for my Filipina wife and her two minor kids in 2006 and was granted a CR1 and 2xCR2s

    They joined me in the states.

    Things didn't work out, we are now divorced, and they returned to the Philippines before the 2 year renewal was filed.

    The conditional visas have expired.

    Looking at the instructions for the K1 (I-129F), I note that a waiver is required if 2 or more K1 petitions have ever been filed. The spirit and intent of that would appear to apply to my situation, even though the strict wording does not apply.

    Anyone out there been there and done that?

    Should I enclose a provisional waiver request with the I-129F, and hope that the reviewing officer understands what the heck I am talking about? Or does that risk opening a can of worms?

Very happy to report that after multiple calls to USCIS, the American Consulate in Barranquilla and the American Embassy in Bogota I was able to confirm that IMBRA does NOT apply to K3 and CR1 multiple filings, rather only K1. On several occasions by different people I was told "You are not filing K1, don't worry about IMBRA".

    I was told that if I am going DCF on a CR1 for my wife who has a dual-citizenship 6yo daughter with me then all I have to do is explain upon filing direct (the previous K1 and K3) and they should have no problem with the approval. The visa should be issued in a matter of weeks when they call her back for the interview.

    Issue/Concern closed. A family very happy.

    IMBRA does apply to K3 (all I-129F peitions) filings at the petition level with USCIS but that's irrelevant to DCF. IMBRA does not apply when only the I-130 petition is used, DCF or not.

    Thank you push.... I tried to read through a large portion of it but got bored very quickly! haha That seemed to be what the Embassy told me, although in less affirmative wording.

    I would consult an immigration attorney -- just to be safe.......... I had to request an IMBRA waiver with only 1 previous K filing and yes that previous K filing was over 2 years ago ..... just cover your hiney and put in a phone call/email to an attorney

  19. There is no common-law visa for US immigration. You must be married to file for the CR1 through DCF.

    So the DCF is for a CR1 or is it a DCF for K3?

    Also back to the OP...which was a concern about this being a third filing, although seemingly a different one each time! Any ideas or quotes from the IMBRA that would result in our restriction or need for waiver?

    You need to request an IMBRA waiver .... your case is complicated it may be worth consulting an immigration attorney.
