    Another fellow from June filers got his NOA2!!!

    Sorry, it's a March filer... but anyway! yay!

    They approved a June 24th!! :thumbs:

    I just looked at Igor's list and a VSC couple who's NOA1 dated in AUGUST 2009 was approved ...... huh??????

    Trying to keep positive but it kinda seems like us CSC'ers are getting the shaft because VSC was behind and CSC is helping them out...... JMHO (of course)

    I am however, VERY happy for the approved couples!!!! Keep those files moving!!

  2. When you say "a couple years", exactly how long ago? If you've had a K1 visa petition approved in the last two years then you'll need to request a waiver for the IMBRA filing limitations at the time you submit your I-129F petition. The request must be a signed and dated letter, and you need to include evidence to support your request, basically explaining why you're submitting another K1 petition so soon after having a previous petition approved. The fact that you're petitioning for the same beneficiary should be adequate for getting the waiver.

    This is covered in detail in the I-129F form instructions.

    I do not remember the exact date but most probably it is more than two years old. We have mails from USCIS that we can refer to and make sure. Thank you Jim, i did not know anything about this IMBRA thing

    Ok. The important dates are the date your previous petition was approved (the NOA2 date), and the date you submit your second petition (the NOA1 date). If less than two years between these two dates, you need to apply for the waiver. If it's close, just wait until it's been more than two years. :thumbs:

    Note that if you don't need the waiver, then this will be your last "freebie" without having to apply for a waiver. The second filing limitation under IMBRA is if you've filed two or more petitions at anytime in the past, regardless of whether the petitions were approved or the visas granted.

  3. :crying: Its been 3 months today that I sent off my k1 petitions. I got my first NOA in the mail with a receipt number given on it. For 3 months I have been trying to log onto uscis.gov and enter my receipt number and each time I get a message stating "ERRORRRRRRRR" you are trying to enter a number that does not exist..." etc etc etc, blah blah blah... At what point with this number that they gave me work? Will it be when I am approved in "hopefully" 3 months or less? I have called them 3 times on this, and each time they say they will forward to the appropriate person and handle it and each time it still does not work when I try back in 24-48 hours. I wont be happy until I exist in theyre system. But anyhooo.... anyone know??? What is the average time to be able to look up information on uscis???? :wacko:

    HI - I mailed our K1 on July 28, 2009, I got our case number from the cashed check (viewable online) and input it into the USCIS system on July 30th and I was able to see our case without problems.

    Obviously there is something not right with the number you are using or maybe USCIS has miskeyed something in their system.

    I'm sure you have checked 100000 times, but are you sure you have the correct number from the check?

  4. I have been sooooo sick on my stomach since Monday, I got back on Sat. I was never sick while I was there. I guess it is possible to have a delayed reaction to some food or something?

    Hi - I just returned from a vacation to Egypt and yes I also got sick after I returned home (the next day), however, I was also ill during the first part of my vacation so I'm not sure if it is just a continuation of the first illness or a 2nd.

    I believe there is a lot of illness going around Egypt so maybe you picked up a bug on the way out??

  5. So when he told me he will take my marriage certificate that says we have shared assets which is part of the tunisian marriage contract to a lawyer to see what his rights are ( to my stuff) I just blew a gasket.

    Kat - I know from experience that the foreign "Marriage Contracts" do not really hold up here in our courts. I was married to a foreigner and we did have a marriage contract. When I showed my lawyer he told me this and then it was confirmed when I was standing in front of the judge at the time of my divorce ...... and I quote the judge ..... "these things dont mean squat here on US soil!"

    Just a little FYI ......

  6. The FBI will not take any action on this. I have several good friends that are FBI agents and through personal immigration knowledge, can confidently assure you that this is out of their jurisdiction.

    The proper reporting avenue would be the USCIS. If appropriate, you should forward all available evidence to USCIS on this case and withdraw any petitions/documents outstanding.

    this is an ICE issue, I did not file a report. It is a deal ender to the marriage if I make a report...instant deportation I suspect. She wouldnt even fight it I am sure and just leave on her own.

    but my main question

    HOW DO I PROTECT MYSELF FINANCIALLY if I remain married and this bombshell is dropped on me?

    From personal experience .... If you have not yet gone for your AOS interview - DO NOT GO!! Write a letter of withdrawl for the Affidavit of support and any/every other petition you filed -- you want to be sure that you cover all bases.

    You will be OK if you have not yet attended the AOS interview - this is key.

    I wish you good luck and yes this makes me sick to my stomach.

    He is an angel and a gift from God. Obviously he is a fighter because he has been through so much in his young life!! He will be OK and glasses these days are so much better looking (almost considered cool) these days. I also believe hearing aids are so small now that it will not be very noticeable.

    Always remember that God does not give someone more than they can handle. You guys will be just fine!!

    You are a great mom so dont ever forget that -- he's strong because of you!!

  8. Uh...I think you're confusing this with the certificate that says she is single and not married - all Moroccans getting a K-1 have to get this paper.

    Sorry I can not contain my giggles :rofl::lol::rofl::lol::rofl::lol:

    Of course it is necessary to confirm that a person is not married!!

    Can you imagine if it were used to prove virginity??? That would definately be an interesting examination :blink::blink::blink:

    I am posting only what I have experienced myself with my son. As a newborn my son had the same type of actions as you wrote about above and long story short what my son was having were seizures. I can only explain the seizure as that he was all of a sudden in complete shock/fear - arms out (as you said above) it was like he was reaching for help and always ending in a terrible crying fit. He was diagnosed with epilespy and is medicated for it. I would have never thought that what he had was a seizure as it is not "typical" of what a seizure looks like (to me at least).

    I am not a doctor so I cant say this is your sons case as well, and I pray to God it is not, but I wanted to let you know my experience.

    You may want to consider taking him to a neurologist because if what he is having are seizures and he is having them regularly it is not a good thing. Every seizure that occurs damages the brain.

    I do have her cell phone number as she was sweet enough to give it to me so when I was in Algeria I would have and American contact. I do not really know her though.

    I do not feel comfortable contacting her.......

    Does anyone know her better than I do that would be willing to contact her?

  14. Hi Everyone,

    I am looking for a little direction. I have read this forum and I see many topics that say multiple filings of K1 visas, however I do not see a topic that exactly pertains to my situation. I previously filed a petition for a spousal visa (which was approved) and my now ex spouse came over on the K3 visa. Long story short (without all the gooey details) the relationship failed - it was a nightmare. We filed the AOS papers, however, we NEVER attended the AOS Interview. I subsequently officially withdrew my affidavit of support.

    Fast forward ... I am happy to say that I have met someone (from a different country as I am the USC) and we have begun to get serious about things and of course the first thing in my mind is - would this even be a possibility? So I would like to know if any one has personal experience or knows of any other situation such as this (filing for the K1 after the K3) and if the case was successfully approved.

    That being said - if you were or are in this situation and you have any advice it would be greatly appreciated.

    The thought of going through all of this again is terrifying and to add the past filing issue.

    Will a waiver be necessary?

    Will the past filing add excrutiating wait times to the process?

    Is it worth getting a lawyer up front or give this a try without one?

    I believe it is actually multiple filings of I-129F petitions because a USC does not apply for a visa. Many have multiple petition filings, some withing the two year time limitation period and some outside of it. Most if not all seem to have had the petitions approved. If you are inside the two year period just attach a supplemental sheet requesting a waiver of the limitation.

    Right but whether a waiver letter is needed will depend on the timing of the previous I-129F approval. When was that?

    The previous 129f was approved 4/07 -- We have only just begun to talk about things and if we move in this direction a petition will not even be considered until subsequent face to face visits have been and more time time has past -- probably sometime in 2009.
