My fiancee and I canceled our 129f feb 09 now refiling.We received an A # with the withdraw letter from uscis.We included it for question 11 on the 129 f asking "if ever filed for this fiancee before if so include A# and result".Does this A # apply for question 8b part a and question 9 part b as well?Also Does this A# apply for the top and bottom corners of the 325 that says file #/ A#?Thanks,hope someone can clarify.
  2. Once a K-1 (I-129F) has been filed and check cashed, is it possible to get a refund, or have that money transferred to a new CR-1 Application? Or am I SOL once it has been cashed. I thought the K-1 was the only way to get her here (filed everything before I found VJ.com). Now I think it makes more sense to get married in her home country (Portugal) and bring her in under the CR-1 Visa. Any thoughts out there?

    I was telling Jewel - thank god I didn't get an RFE for not having a letter of intent or original bioraphical data or actual passport photos! lol.

    I'm not complaining!!! I'm running and running with my NOA2 straight to NVC in hopes for a quick layover en route to Beirut!

    Marie - make sure your fiance has an original letter of intent and plenty of passport pics (just in case they are looking for additional pics to make your file complete!!)

    Cover all bases JUST IN CASE!!!!

    Here's something I wanted to run by all of you -

    Tax returns - I have them - but my concern is that last year I had a negative adjusted gross income due to a business that I report in my taxes (no longer an issue in 2009) - I'm worried about submitting those taxes bc they are negative.

    But as to current situation - i have paystubs and I'm above the poverty line ...

    Any thoughts?!?!

    YES MALARIEEEEEEEEE - this time around - I'm submitting information overload (funny thing is I keep hearing how embassys don't even look at anything ...regardless - I'm making sure I have EVERYTHING ready).

    Marie - here's a thought ..... maybe you could hold of on sending your taxes until after you have filed for 2009. I believe (but dont quote me) that only the previous years tax return is required (again please dont kill me if I have quoted that incorrectly.)

  4. That happend to my file. Basically the person who approved it did not check it properly. In my case a box was left unticked and uscis should have issued me an RFE. Unfortuneatley you wont know until you get a letter from uscis. our petition was returned on august 25 and we only got the letter on sept 10th saying that NVC sent it back for review, then it took another month before we knew about the RFE. I only just received the reapproval in November.

    I figured it was something like this. So was there was really nothing else required as an RFE, it was just a simple box left unchecked? You didn't have to send any other evidence?

    You should keep on top of this Dacko - it may be beneficial for you to contact your congressman .... unless you dont mind waiting the extra time as Kimbear has.

  6. WE GOT OUR VISA!!!!!! So Katia will be flying here Nov 29th!!! I've been up all night waiting for her call after the interview and now I'm too excited to sleep, oh work will be difficult today :(

    The interview was very long, almost 30 minutes. She said the woman asked about EVERYTHING. The woman started the questioning with a serious tone but by the end of the interview they were laughing and joking. Then the woman finally stopped and said "Congratulations, welcome to the United States" :dance:

    My mom even called me at 3am to ask if I had heard anything.. I was surprised. My whole family knows already that she got it and its 4:15am now! :D

    Wow, I better get this house cleaned! :jest:

    CONGRATULATIONS!!!!!!!!!!!!!!!!!! Your fiance will be here to enjoy Christmas with you ..... things are definately rolling for us July 2009 filers... keep posting the good news!

    I think it boosts the morale here and we can definately use that any time!!

    Ohhh I love all the good news!! It was so quiet here the other day, it seems as if it was only quiet before the storm kicked in. I am sooo happy for everyone, even though I know not everyone has their NOA2 yet, so I'm still waiting for the final news from everyone (F)

Some months ago we were all sitting here waiting for our NOA2s and it is so incredible nice to see the first visas being issued. Now I'm just waiting for the rest of us to follow!     Honestly, I can barely contain myself... I have a smile on my face I can't remove ...and I can't focus on work and I keep texting my fiance with "Are you happy?!?!" "Are you happy?!!?!?!?" hahahaha

    I hope it will be a smooth ride from this point on...only in my wildest dreams would I wish to wake up tomorrow with an approval!!!! But how amazing would that feel?!!?!? Omg I would go crazy!!!

    I even emailed my congressman with the update (I'm thinking I got the touch bc of the service request from them but who knows) I'll still take it!!!! Hopefully no RFE!!!! hahahaha :crying::crying::crying: so happy!!! happy tears!!! :dance::dance::dance:

  9. So you all have to sit through the following story ....

    So last night I went home to visit my parents ...and all night i complained (my pitty party) and said it's not fair ...and i want good news for my thanksgiving ...(which happens to be my fav holiday, bc good things have happened to me around thanksgiving, i found out i passed the bar right before thanksgiving, moved into a new house around thanksgiving, and i love to eat which hello!!! thanksgiving is all about eating and napping) ...so that was last night.

    i wake up this morning ...and i write you all a little note, i check uscis (nothing) and i get back to work ...and tell myself ..."oh it is just another day"

    then i finally give in to my fiance's stubborness (seeing how long he would wait to text me - whatever...i'm still a girl) and i miss him ...so i start texting him ..and we are having a little back and forth flirting ..and then around 1.30 (my time) i tell myself ..."oh it's about that time again...time to recheck uscis"

    and ... here is the moment of truth.

    i do what I always do ... sign in, customer, my id and my password ..and as usual my heart skips a beat as i imagine whether an update has been made ...AND WHAT DO I SEE??????? A NEW DATE OF 11/19 HOLY GUACAMOLE!!!!!!!

    I GOT A TOUCH TODAY I GOT A TOUCH TODAY I GOT A TOUCH TODAY I GOT A TOUCH TODAY

    I feel alive again. I got SOMETHING!!!!!!!!

    So i'm in my office, and I actually literally SCREAMED! my secretary came running into my office ..and it just happens to be a day when our regional manager is visiting the office and he is next door interviewing ...and i refresh uscis bc i can't believe my eyes...i start to sweat and i was literally shaking out of excitement!!!!

    yes people ... i know it is ONLY a touch ...and really doesn't mean anything ...because i have 3 options here that could result

    1. approval shortly

    2. rfe

    3. a touch and wait and wait and wait for something!!

    4. denial!?!? (i'm leaving it with 3 options)

    but IT IS SOMETHING!!!!!!

    so i ran downstairs and called my fiance ...and i had to take 15 minutes to explain to him a touch

    and he told me "go to that website and ask your friends about when they got a touch and what happened" he is referring to all of you! hahahahaah

    ok...i'm done ...really.

    thank god. seriously.

  10. OMG!! you never guessed what happened?! i sent in my rfe on november 7 in a certified return receipt mail. its been more than a week..

    i was wondering how come i didnt received the return receipt yet.. so i called USCIS and they said they haven't received anything..

    then i called my US postal office, i gave them my tracking number and they said, it hasnt been delivered until now.. they told me to call the destination post office to check it with them and they said they havent received or scanned anything.. :crying::crying:

    so im going to the post office tomorrow to talk to the manager..

    can i get a original copy of the RFE notice of action from the USCIS?

    or can i send in photocopy of the RFE notice of action and have a letter from the postal service that it was lost?

    please help! :help::help::help:

    OMG that's horrible! Have the tracking number ready when you call USCIS, because it sounds like you should let them know what is going on ASAP.

    They might be able to give you a fax number (or email address) and instructions on how to get the information to the person working your case? It probably depends on what your RFE was in regards to.

    Dont freak out ...... I would resubmit it but copy the RFE notice on whatever color paper USCIS sent to you.

    This really svcks -- Sorry for you guys.

    Very disappointing ..... well try to keep on the positive side - at least you know there is not something incorrect with what you submitted for the RFE rather than USCIS just has not received it yet.

  11. Good Morning July Filers....

    I received an email this morning from the Embassy in Algiers with packet 3 instructions. I thought we would be waiting for the packet in the mail but hey this is better!!

    I haven't seen Marie online for a while...... Marie I hope you are OK and keeping your spirits up!!!

    Let us know whats up with you. I still look probably 100 times a day to see if you (and the others still waiting) make a comment that says you received your NOA2.

  12. So how's the progress with NOA2s, medical appointments and interview? I'm waiting eagerly to hear some good news! :D

    Dave's medical is in a week and a half. P3 was signed for by London today. It took them 2 weeks for the box from NVC to be processed and the P3 letter to be sent to Dave. I know of people who sent their P3 letter back on 10/12 and they still do not have an interview date though.

    Hurry up and wait wait.

    Boy the embassy can be jerks!

    They told Tamara that she gets her Visa but they need one more little form

    That shows why she went from her maiden name to her married name

    Can you believe it?

    Like the birthcertificate and married certificate and devorce decree doesn't show this??

    SO this poor lady now has to travel back to Odessa by train go to her city hall get this little form then travel back to Kiev on Sunday and give this form to this Embassy and then they will release her Visa! (L)

    CONGRATULATIONS!!!!! The good news is that she gets the visa and the extra little step well basically yes it stinks but it's life right?

    Soon this whole visa process nightmare will be out of your mind!!!!!

  14. Thanks all for the quick replies.

    All my documents are certified true copies from the Ministry of Foreign Affairs Thailand.

    There was no check list only what is supplied in the screen shot (minus my case number). Page 1 was just the blue I-797E form.

    After my hyperventilating eased up a bit, i think i agree with Mina's Wife. I submitted passport photos but i guess they didn't see them or like them.

    So, I should just submit new photos and the accompanied I-797E form? Or do i need to submit a copy of my original I-128F submission as well?

    what does page 1 say?

    No, the blue sheet says "Return this notice on TOP of the requested information listed on the attached sheet". My screen shot.

    I thought the 'list' was on page 1 ? Does page 1 ask for anything?

    Did you put your photo in a plastic baggy and staple it on a plain white piece of paper? If not, the photos probably got detached from the case and lost.

    At least what they are asking for is easy enough!!

  15. I have a question for people who have received their NOA2 .... How long from the time you received the email/text until you received the actual paper NOA2 in the mail?

    It's been 5 days and nothing yet.

    I stopped caring about WHEN the paper NOA2 arrived. When it did I quickly filed it away for the AOS process.

    The part that I started obsessing over was the NVC portion. :D I called every day to see if it was there and if it had been sent to embassy yet. Do you think we have our own brand of crazy?

    Well this is what I am preluding to. I contacted NVC today and was told they do not have the case yet and usually by the time the petitioner receives the hardcopy of the NOA2 its a good rule of thumb that NVC has also received the case. Of course that is not always how it goes.

    I'm the type of person who likes to have some type of guideline/timeline to follow -- it keeps me going!!

    To be honest I am a little freaked about AP at NVC :blink::blink::blink:

    Things are moving much faster than I thought they would. NOA1 on September 29 and NOA2 on November 5. What do I do now? That is the question. I have read the guides, but just want to check some things out. I already sent a copy of the I-129F Package to my fiancee. It says that I should also send her my I-134 plus proof of our ongoing relationship. Do I send this just to her, or to the USCIS office in Vermont, as well?

    send everything to her. You are finished with the VSC, they never need to see you again until you apply for lifting conditions in about 2-1/2 years

    Ok - 1 year of tax transcripts or 3 (for the I134)?

    1. Employment letter for I134:

    Aquire letter head paper from work and just type it up and print it out yourself, have boss sign it. Here is how I worded mine:

    To whom it may concern:

    (your name here) has been employed full time with the (business name here) since ( date of hire here) as a (position title here), and is an employee in good standing with an annual salary of $XXXXX.

    Signed,

    (boss signs here)

    type bosses name here and his title

    then i put the name and adress of business here

    he had no trouble signing off on it, after making a joking comment on the good standing comment in letter lol.

    2.Copies or originals of paycheck stubs

    3. Letter from bank from each account, with account numbers and balances to match. I didnt include the deposits from the last year as I am including most recent bank statements for my checking and savings account.

    4. Call the IRS and get the tax transcripts from the last 3 years, 2008, 2007 and 2006 they are free and they will mail them to you. Phone number for this is 1-800-829-1040. If you have these then you do not need your original tax return nor will you need the w2s.

    5. If USC was previously married need a certified copy of divorce decree from the courts, easy to get. only cost me 15.00 to get mine from the clerks office here.

    6. I retyped a new letter of intent to marry, with a most recent date. Just so they know I still want to do this hehe.

    Thats the hard stuff, and its not so hard. All the rest of the stuff you should have already, ie. birth certificates passports proof etc.
