  2. It sounds like none of that was planned out properly. If your fiance wants to live in the US, you need to petition her for the correct visa. She was denied entry because she did not have the correct visa. Moving to the US is not simply presenting yourself at the border. Immigration is a long and expensive process. I suggest you both do lots of research and reading so that you avoid more pitfalls.
  3. Online "relationship evidence" is weak. Do not include it. The best evidence is time spent in person.
  4. We did not submit much for AOS. By the time our interview was scheduled though, we had AMPLE evidence of marital life, financial commingling, etc. Send what you have now, and then set about to get both names on household bills, leases/titles if applicable, joint insurance, name spouse as retirement account beneficiary, etc and then of course file your taxes as MFJ. USCIS realizes the evidence for K-1 AOS will be scant, so they expect you to bring it to the interview, plus submit subsequent evidence with your ROC when time for that. Btw, we did not send any photos whatsoever. We eloped and just had selfies for our wedding, but the immigration officer asked to see them at the interview.
  5. You will need to go through the local courts where you will be living for that type of name change. Since you two are creating a new name, this will be the process for you both. In terms of it being recognized in your own country, that is probably beyond the scope of VisaJourney, but I'm sure you can utilize the Google and find out. The courts will provide documentation of the legal name change.

  9. OP, you are not permitted to work remotely while visiting. It appears you have been using the B visa to try and live in the US. Don't do that, it isn't allowed. Your parents need to petition you for an immigrant visa if you want to be able to work and live in the US.

As you can see, the VJ member who did not disclose his criminal history had to take a much longer and more expensive route to get his partner here. Your issue isn’t necessarily the crime itself, it’s the failure to disclose it as required on a legal form, the I-129F.

  18. An attorney cannot do anything here. Numerically limited visa numbers are what they are. Consider yourselves lucky that it was reinstated at all- not everyone gets to have that.
  19. YMMV, but we only sent quarterly ones from the beginning of marriage. Other items sent: evidence of jointly purchased /owned vehicles, joint insurance policies, beneficiary info for retirement accounts, joint tax transcripts.
  20. You won’t be getting a visa to attend an in-person meeting. Misrep is serious in the world of US visas. Waivers are adjudicated based on proven extreme hardship to US citizens/permanent residents, so very unlikely in the context of a tourist visa.

  22. Deceiving CBP about your intentions (adjusting on B2) can get him a misrep bar. Do you really want to take that chance? The queue is what it is. Just petition properly and wait your turn.
