    I would be anxious, too. Clearly the intention was never “two weeks.” I’m always curious about how someone who truly intends to be gone for two weeks can leave things at home (pets? Job? Housing? Other responsibilities?)., and then spontaneously decide they can stay for up to a year without returning. Anyway, good luck. I’m out, too.

    Your question #2 makes it pretty obvious that you’d have no intention of returning home on the F1, which is a requirement for getting that visa. You need to wait for the proper nonimmigrant visa like everyone else.

    The date discrepancy should get some scrutiny. How can it possibly be legal to gain an immigrant benefit (unconditional GC) solely based on a date, when the applicant was not eligible for the same benefit (visa requiring both parties to be unmarried at the time it is issued) ? If this is in fact going to be legal going forward, then it will be a huge loophole that K1s could exploit to save significant time and money.

    Regardless of the context, by law the burden is still on the applicant for a US nonimmigrant visa to show ties to home. Her chosen lifestyle at the moment may complicate that.

    You asked for feedback, and you got some. I offered some points you may want to consider before USCIS does. There is no magic template or secret for writing a successful expedite request, because as you’ve pointed out- everyone’s situation is unique. You just have to be truthful. Yes, others on VJ have been successful in getting AP expedited, but I have not personally seen one where the reason was so that someone adjusting on a B visa can go back to work in their country or wrap up non-emergent details. good luck though.

    No, and in general you cannot interview abroad for a tourist visa without having legal residence in that country.

    You can try for an expedite by explaining the situation honestly. Unfortunately, bypassing the visa queue by adjusting status does come with the downfalls of not being able to work or travel. I'm curious as to what he will do for income when he returns though, since that is your reason for requesting an AP expedite.....not sure how well that rationale works with the 8 month wait for an EAD. If he intends to remain out of the country for the duration of the EAD processing so that he can work back home, I'd say that is a very bad idea.

    USCIS simply approves petitions. They are approving that the beneficiary is eligible for the visa which they have been petitioned for. Department of State issues visas. That is a completely different process. Having an approved petition is no guarantee of a visa.

    Scammers often try to get money from USCs, in addition to GCs (green cards). Not at all suggesting she is doing this, but here at VJ we have seen people who have gotten scrutiny during the immigration process when the couple is not yet married and the USC is supporting the beneficiary.

    When you get to the AOS and ROC stages, you’ll wish some of those new hires were charged with adjudicating other types of petitions.
