  1. Hi!

     

    It's day  191 since my ROC priority date (12/11/2018) I called USCIS and it's still within normal processing time but I am confused about biometrics, Will I need to do Biometrics for this? I thought there was a fee for it? , also does anyone see this on their online account??? :

    What do they mean by "waived" the check was cashed as per usual, are they talking about Biometrics???

  2. Looking at the ROC thread I see many people send their I-751 (Removal of Condition Application) at the same time of their N-400 (application for naturalization).

     

    How does this work? I thought you had to be married to a US citizen for 3 years AND be a legal resident for 3 years (ROC means you've barely had a GC for two... right?), I thought both conditions had to be met in order to apply for naturalization, Is that not the case? because most of us got the GC many months after marriage so how are ppl able to file those two forms at the same time? I don't understand :huh:

     

    Can somebody please explain?

    For all of you who already did the removal of conditions, How did you know the exact date to send out your application?

    So my Green Card expires on Jan 31 2019, but I don't know how to calculate the "90 day window" is it all regular days or just business days (no holidays no weekends)??

    @msw1992 sorry I didn't get the chance to read your post before. I sincerely hope your case is all good by now :thumbs:.

     

    To answer your question, No. I never got a "reason" as to why it was lost. I dealt with USCIS only. I never called USPS because I felt like the post office would be the most frustrating dead end, since they would probably "Start an investigation" but couldn't send me a copy of what they lost let alone find what they lost <_<.

     

    Yes, I did receive a "copy of interview letter" BECAUSE I placed the e-request as soon as I realized there was a problem AND pestered the USCIS agents on the phone. Multiple calls, multiple 1st tier agents will tell you that all you should do now is wait for the copy, don't despair. Call again and try again, you WILL get a different agent.  I talked to at least two 2nd tier agents and another handful of other 1st tier agents, I did not desist until they offered a solution to the "what if it doesn't come in time?".  One of the 2nd tier agents asked me to wait until 7 days before my interview, and if I hadn't received the copy I requested (through the e-request ) by then, he offered to give me a case number where he wrote down instructions to Fax me a copy if necessary. Knowing that I had the option to request a faxed copy made it a little easier to wait and see IF the copy would come through the mail in time. and it came eight days before my interview. 

     

    FYI, 6 days after my interview I received my greencard without any problem at all. Same address :rolleyes: oh USPS  <_<

    What a different experience from the K1 Visa process. :blink:

     

    The AOS process was sloooooooooow, and with no update information at all. It was nerve wrecking!!!! I stayed in "Fingerprint fee received" limbo for the majority of the process. I am grateful that I was not required to have an interview, which would have prolonged this more, and that I didn't get a RFE. But most of all I am glad I kept myself distracted enough, not to get overwhelmed by the prolonged wait. :clock:

    My focus now is on continuing enjoying life with my wonderful husband and to be ready for the next step which is the Removal of Conditions in a year and nine months. Let the countdown begin once more!!! ;)

    It's a long process and I wish you the best of luck, just hang in there and hopefully they will get to your case soon.

    Call them and inquire about the reason of such delay.

    Did the email say the deadline until when to wait for the card? mine literally says:

  8. We sent a copy of our marriage certificate, husband's 1040 (taxes) for the past 3 years, a copy of his birth certificate and copies of both our passports. Everything else we brought it at the interview. If you already have the evidence I would say, send it, otherwise just bring it to the interview, you should be fine. Regarding the filing fees, it's best to go by the official USCIS.gov website to verify you have included what they require.

    Regardless, he has a 10 year ban. The petition will get denied and waivers will need to be filed.  A lawyer will best be needed. Will be a long and somewhat expensive process.

    @NuestraUnion There is no 10 year ban. His application won't be denied over an expired/overstayed visa. I think what you've described applies to

     

    a) people who overstayed and left the country, meaning they are outside of the US 

    or

    b) people who border crossed their way into the states. 

     

    @zuluweta is right. no ban for someone who overstayed but it's still in the US and married to US citizen.

     

    My student visa was close to expiring before we knew for sure when we could file for AOS and I had read up on this. As long you can prove you've entered the country legally (be it student visa, tourist visa, H-1B visa) you're okay as long as you don't leave the country since you entered legally. The difference is you can't or shouldn't apply for advanced parole because your re-entry would not be guaranteed.

     

    In other words, if you've overstayed your visa, until you have your green card in hand, don't even consider traveling outside the U.S.

     

    Regarding Drump, or as I call him, Lying Cheato... No one knows. True Americans feel uncertain and it sucks but I choose to believe this country is greater than a single person and his groupies. It'll pass and we'll heal. As of right now, Cheato's policy don't directly affect your friend's process but that's not set in stone. 

     

    Lawyer? that's up to and how informed you are about the process. I didn't feel like we needed a lawyer but that's a decision on a case by case, person to person scenario.

  10. I wanted to make an update for those still preparing for the interview. I did post my full detailed account in this post

     

    But here are the straight questions they asked: 

     

    • Have you traveled outside the US since your arrival?  for me
    • Have you applied for US residency before? for me
    • where do you work? what do you do?  for my husband
    • Have you sponsored anyone else before? for my husband
    • How and when did you two meet? for both
    • When did you start dating? for both
    • She asked to see the original certified copy of  my husband's birth certificate and then asked if I had photocopy, I did have one so she took it.
    • She asked where was I born  for me
    • The first name of both my parents for me
    • She asked if I was working.  for me
    • She asked for my social security number  for me
    • Then she asked if we brought any pictures for both
    • Last, thing she asked was we had any other Proof that we were living together as a married couple  both

    We had the interview yesterday, and it went apparently well because after we finished in less than an hour I received an email saying both the i-130 and the i-485 applications had been approved so I guess it's all Good!!! Thank you so much everybody ^_^ and best of luck to each and everyone of you!!

     

    If you're curious about what the interview was like, I've posted a painfully detailed topic of how it went. I warn you it's long so yeah :D

    yes you are correct, this is interview for green card but I'm adjusting from a student visa :D didn't do the k1 process but thanks!!!

  13. Hi guys! so I finally have my AOS interview on the 31st of January (in Kendall office, Miami FL)  and we are in the process of getting stuff together for the interview.

    I would really appreciate if you can take a look at my checklist and let me know if I'm missing anything? well, Thanks in advance and wish us luck...  :) ...  

     

    Also, any tips and advice is welcome!!! 

     

    SUPPORTING EVIDENCE TO PRINT:

     

    • BANK STATEMENTS OF JOINT ACCOUNT

    • PHONE RECORDS (I plan to highlight calls between us)

    • INSTANT MESSAGES PRINTOUTS (VIBER - this is a ton!!! )

    • EMAILS between me and his family, mostly wedding planning stuff and birthday congratulations etc.

    • LOOSE PHOTOS of us and our family

    • photo album

    • WEDDING PHOTO ALBUM

    • Wedding Invitations and Save the Dates

    • Wedding congratulatory cards from family and friends

    • WEDDING VIDEO (okay, I know this one is pretty much useless because they won't watch it but I rather bring it and say, "this is our wedding video" it can't really hurt right?)

    • Itineraries of all trips we've been to as a couple

    • Lease agreement with both names on it

    • PHONE BILL SHOWING BOTH OUR NUMBERS in same account

    • copies of ALL FORMS AND DOCUMENTS SENT IN INITIAL PACKAGE, maybe not necesarry but I won't be taking any chances.


     

    BRING ORIGINALS AND COPIES OF:

    • Birth Certificates for both us

    • Passports for both us

    • SSN CARDS for both us

    • My I-94

    • My VACCINATION RECORD

    • Certified copy of our marriage certificate

    • MY Medical Examination sealed package -the've requested an RFE for this one and I am required to bring it

    • DMV issued Driver License for both us

    • My EAD/AP combo card

    • Joint Credit cards(3)

    • CAR INSURANCE CARD with both our names on it

    • Health INSURANCE POLICY with both our names on it

    • JOINT TAX RETURN 2016 (1040EZ) with both our names on it
