Did he actually have a criminal record? I don't know how things work when ppl are out of status in that country but if he was arrested and charged with a crime. That should have been indicated on the K1 application. Did he submit his background check from that country? If he did then he just needs to show the same forms at each stage.
If he didn't then he needs to consult with a lawyer.
Wht do you mean by criminal record? The only thing that he has it that he worked more than he was supposed to be on student visa, this resulted him 5 years ban to Norway due to voilation of student visa.
They didnt arrest him or convicted him when he was in Norway. As I said in my earlier post, he left Norway voluntarily and infact he even informed Immigration authorties that he is leaving Norway and move to US. In response, they said, if he leave he wont be able to enter into Norway coz his current visa at that time was expired and his visa renewal application was in process. They told him either you have to wait for the visa to enter or leave so he decided to leave. At that time, he had no charges.
When he had a k1 visa, this issue didnt happen coz he had no criminal record at that time, Offcourse he took Police Report from Norway and submitted to Stockholm Embassy during interview. so there was no criminal record for him when he was there in Norway. This ban occured when he was already in US and submitted AOS.

Actually I've been through this and I had to submit everything at every stage. All the way to citizenship. They don't care if you sent in originals the first time at the K1 interview they want certified at every step.
so based on your experience what do you advise him? do you think it would jeopardize his GC process all the way to Citizenship?

He was granted the K1 visa, so any Norwegian police record is no longer an issue. It's not part of the AOS process.
Yeah, I told him as well but still he was panicing and asked me to seek advice from VJ.

That depends if he was truthful when he submitted his forms for the K1. If he lied on the forms then yes he has an issue. Every step of the process asks about criminal records he needs to submit everything again and again.
No when he had a k1 visa interview, this issue didnt happen, it only happend when he was already in US and submiited AOS. By the time, he left norway, he had no criminal charges, no arrest, infact He did inform Norwegian authorities that he is leaving Norway.
His visa revoked just because his current visa was expired and he was waiting for extension, but they didnt grant him coz he worked more than he was supposed to in accordance with Norwegian law. This decision was made when he was in US already.
He also didnt mention that when he was filling for AOS because he wasnt aware of that issue, he got information from norwegian authrorities after 2 months of submitting AOS. do you still think he has a problem?
He has no other charges.

Hello VJ members,
I have a question regarding criminal record.
My friend has a AOS interview in a few days. He has some problem with his background check. He was on a student visa in Norway and worked more than 20 hours in a week due to which his visa revoked and banned for 5 years to enter into schengen states.
He came to US on K1 visa from Norway and by the time he applied for k1 visa, his police record was fine and left norway voluntarily. so my question would that be problem for my friend to get a GC? He made an appeal in Norway against that decision and his appeal is in process in Norway. Would his action in norway impact GC process in US?
He has no other criminal record so what do you suggest? -

Hello Guys,
I am just wondering to ask if we have to take police report for AOS interview? I already submitted Police report when I had a K1 interview back in August, 2016 so wanted to know if I have to get a new PR or they would be okay with old one?

I am sorry to hear that and I understand how it feels. It depends upon the case and where you resides? Our AOS was also submitted to NBC office in December, 2016 and we just got a interview letter last week . I would go for service request or possibly made a info pass in local USICS office to know abt the status of your case. Possible ask your congressman to intervene that might help in expedition.
Good luck!

Draft wills, medical & statutory powers of attorney, and similar documents. These make great evidence for GC interviews, and they're even more valuable to have in "life."
I dont get that what do you mean by that?

Still no response:(

Hello VJ Members,
Hope you guys are doing well. Finally, we got a letter notifying us to have a GC interview on 10th of April, 2017. I have a few questions to ask and to know if I have enough evidence to prove our legitimate relationship.
1. We both are on the same house lease contract.
2. My wife put me on her health insurance provider.
3. We both have the same joint bank account.
4. Tons of pictures with family and friends.
Would that be enough? Or should we have more? Also, I have my own mobile plan but my wife has mobile plan with her own family, would that be okay?
One more thing , I need to ask if its necessary to have original Birth Certificate. I have given my original BC when I had a K1 interview and my wife lost her original BC but we both have photocopy of that?
Any advice or help would be grateful.

Hello VJ Members,
My AOS Visa interview is scheduled to be on 10th of April, 2017 and USCIS asked me to bring birth certificate. Are they asking for Original one or photocopy? They already have mine original one when I submitted k1 package at POE back in October, 2016.Fortunately.I do have photocopy of my Birth Certificate so my question is that Would that be acceptable to them or do I have to order new birth certificate from my home country?
Those who were in similar experience please share that with me.
Thank you again

Hi
I got my SSN not long after I applied back in November (by going back into the SSA office and requesting it), however have never received my card - I remember reading somewhere that this could be due to the AOS/EAD process, does anyone have experience with this or is it more likely lost in the post?
Came in on K-1 visa, currently waiting on AOS/EAD/AP filed in December
Thanks
Ben
SSN has nothing to do with AOS. You should have receive it within 2 weeks of applying. I also got it within 2 weeks. If you didnt receive , I would recommend you to go to office and ask for SSN card.

I wish I could give you 2 reputations for this...ppl get upset when you complain about the system, but then they will complain about someone complaining about it? Seems quite ironic to me. I am trying to add my minor to my lease with is EAD which is all that is required and my manager asks me why does he have an EAD and he doesnt work. SMH. Yes it is an issue of knowledge in most cases.
Thats the whole issue. We are here to help each other not to criticized someone and when we start arguing with somone then they get upset. I feel sorry for them. It help alot when somone listen to you and try to understand you

Sometimes we have to be accountable for the visa choices we make and accept the consequences
of our choices without complaining.
Your choice of a K1 versus a CR1 sucked, not the immigration process of a short 3 months wait for the EAD.
Please don't project blame on the process for your own choices.
Yeah I am accountable for that choice and i am dealing with it so I dont need your suggestion and advice on that.
For your kind information I wasnt blaming , I was just expressing my concern. Anyway thank you

Probably was a service request as an infopass appt is for in person. That is just the standard response as when I did it they got back to me in about 1 week.
Oh sorry for considering service request as an infopass appt. Had no idea about that. Thank you for rectificaton

Really wish EAD/AP application were like a credit card application, which is automatic and takes 1 minute (Credit card assessment is no simple thing!).
Anyway, just heard on the forum that EAD could be discriminated by potential employers due to their lack of EAD knowledge. Not having an EAD would be even worse, wouldn't it?
Charming12, you mentioned you have got multiple job offers; any tips and tricks for describing one's immigration status when filling out online job applications when one only has an expired K-1 visa and no EAD would be really great!
Wish you good luck with getting your EAD soon!!!
I wish too and in Europe once you are resident, you are automatically granted work permit but here everything sucks when it comes to immigration process.
I just applied to several jobs and since I have a experience and double master degree in engineering field, I got a interview and then job offer but when they realized that my green card is in process, they chose not to hire me.They didnt want to wait for me.

Many choose to immigrate to the USA via the K1 because it is faster than other methods such as a spousal visa(CR-1/IR-1). Before starting an immigration process, you need to do your own "due diligence" as to the pros and cons the visa method chosen.
Yeah I wish If I could turn the clock back and came here on CR1 visa but its too late

Some posters have had some success getting a driver's license with an NOA 1. As long as they are able to verify your status VIA SAVE it is the only requirement. Give me a sec and I will try to post the link.
I tried it multiple times and went to local DMV office but they are not willing to help me. I guess it has got to do with State policy so thats the reason I couldnt get NY DL

I'm also feeling helpless, frustrated and bored. I left a bachelor's degree and a career in my country to come here. Then they don't let me get a DL, work, can't do anything by myself. I feel embarrassed every time I have to ask someone for something.
It just makes me want to address the nation and say "see these politicians inciting hate against immigrants? Well they came up with a system that charges thousands of dollars to register our permanent residency when we do it by the book, and in the meantime we cannot work or, guess what, get documents, do you folks think this is functional"...
Yeah, its very frustrated process and one cant do anything here if you dont have a proper paperwork.
Why cant this law maker make it easier for new immigrate to work and live here. Sometimes, I regret to come here but I love my wife and left my country for her. This whole process sucks! Atleast they shud allow us to get a DL but unfortunately its not the case
