You might have to write them a letter explaining the late filing,I don't think you're a illegal alien yet.

so do i have to wait for their response on the 1st application or i could just mail a new one now? my drivers license expired on 2024 though.

ahhh ok, print up a new package today like Junior818 suggested and get it in the mail ASAP with the correct fee. You can write a cover note about the 1st application being sent back for wrong fee and money problems due to COVID as the reason you are late. Good Luck

    noted. thank you, sir!

how much did you send them?

$595. i thought biometrics is already included in it.

Hi @ifdv,yes they going to send it back to you because of the wrong fee...I would try to prepare another package to send off since your green card already expired

what will happen now with me then? im illegal alien? and will the uscis honor my application now that my gc is expired?

  3. Hello, everyone. I have a problem. I sent my I-751 on September 28th and was received on October 2nd. However, I sent them the wrong fee. is that going to be a automatic denial of the application?  Or will they give me a chance to send the correct fee? Because I haven't gotten any letter from USCIS yet.

One more problem was my gc already expired on 10/20/2020. I know, I sent my application late but it was due to Covid19. Money problems. I dont know what to do.

  4. Hello, we had our interview in Houston, Texas last October 25, 2018. I must say, the immigration office was packed! Its like that day was interview day for everyone in the area! We almost got late because its hard to find a place to park and there's a very long line in the check-in counter. They will write your ticket number but they don't flash it on the screen, you have to listen to the speaker for your turn but since there's a looooooot of people, its hard to hear the announcement.

So the immigration officer went to the waiting area and was yelling for my husbands name. Lol!

Anyways, the interview was fast and easy. Basically they asked my husband the yes or no questions. and me (i am the USC) they asked me my husbands kids names from his previous partner and his parents names. She just scanned our documents real quick. Didn't even look at the new affidavit of support that we submitted. She didn't even look at the photographs we printed. Good thing I only printed 60 photographs. Lol. We brought our 1 yr old son with us to the interview.

The immigration officer approved it right away before we left her office. And gave us a white paper stating that we passed. then our status changed right away on the app saying "New Card is being Produced".

Today, we received the approval letter in the mail and the status was changed to "Card Was Mailed to Me".

My husband got the 2 yr green card since we got married January 2017 and we didn't reach the 2 yr anniversary before we got interviewed. But its okay. So happy we're done with it!

Good luck to everyone still waiting!

Mother was not born in USA though. BC still needed?

but your mom is the petitioner and she's a USC right? It doesn't matter if she's not born in America. that's why you show them also the proof of her US citizenship together with the birth certificate. like American Passport or certificate of naturalization.

good day! I recently had my interview at USCIS to adjust my status, everyhing goes well untill I request if i can change my gender during the interview, I gave them a letter from my doctor stating he highly recomemded me to change my gender status from male to female. how ever i rerived a RFE letter kast Oct 1, that i need to submit a new birth certificate  from my home country where I adjust my gender status. however I havent adjust my gender status in phillippines cause we dont have law that I can adjust my gender status is any public documentation of on birt cert. now  I am stressed how to reply the RFE letter.

hi. not sure what advice to tell you but you could just call them or get and infopass appointment to explain them the situation so they will tell you what to do instead.

Thank you so much for taking time to response to my query. We are now trying to obtain an original copy of his birth certificate from the Philippines and hoping that it will arrive before the interview.

Okay, I will find someone to be a co-sponsor just to be safe then.

and it just confused me because the one line says to bring "All documentation establishing your eligibility for Lawful Permanent Resident status" and the other says "Supporting evidence of your relationship such as copies of any documentation regarding joint assets or liabilities you and your spouse may have together." I just couldnt tell the difference between the two.

Do you know if we can bring our baby to the interview? Because i am not sure if I could find someone to baby sit on that day.

    have you been interviewed?

I agree that you will need a co-sponsor.  As your husband's sponsor, the I-864 is saying that you will support him if he is unable to support himself.  If you are not working, you are unable to financially support him.  It doesn't matter if he is working and supporting you now. The government requires that someone be legally bound to support him IF he decides to stop working.  If he is laid off, injured, or something else prevents him from working, someone other than the government must guarantee to support him.

USCIS may have the original birth certificate if you sent it with your AOS.  If the officer has it when you attend the interview, you should not need to submit another.  However, if they do not have it because it was "misplaced," they can require another.  As previously suggested, bring a copy and understand that you may have to wait for approval if another original/notarized certificate is requested.  Plan to order additional notarized copies of your birth certificate anyway.  USCIS will probably not return your original documents and you will need a notarized birth certificate for other things in the future.

As @K1visaHopeful said, bring anything you have to support that you have a bona fide marriage.  Along with what has been suggested, we are also bring beneficiary papers, photos, and "letters of support" from family members.  Anything we can find that shows that assets are co-mingled, property is shared, and family is aware of and support our relationship.

oh okay, thank you! we are already trying to get a copy of his birth certificate but we're not sure if it will make it here before the interview.

  9. Hi! We have an interview coming up and the appointment letter listed all the requirements they wanted us to bring to our appointment. i have a lot of questions in mind that I need ya'll opinions with.

The requirements says to bring a birth certificate of my husband (beneficiary). However, we don't have one on hand. we sent them the original copy before. Can someone from our home country fax or email to us then print it?

Affidavit of support and employment letter..Eversince I gave birth to our son, I stopped working till now. But my husband (beneficiary) started working this year. can we show his employment letter instead?

I am a US citizen. The only proof I have is my United States passport. But its expired. I haven't renewed it. Can I still show it to them?

And.. it also says, "All documentation establishing your eligibility for Lawful Permanent Resident status" --- LiKE WHAT?

    Thank you!

Hi everyone! and to my fellow Dallas filers in this thread.  We got approved on the spot today. God is great!  Do not be afraid if your marriage is really true they will see it right away. I have bunch of additional evidence but the officer said he doesn't need to look at them.  We just answered the yes or no on the i-485 and was asked about each other's birthday.  The officer said we are approved and should just wait for the mail in the next 14 days. Just an advice though. dress in business suit,  we got complimented by doing so. Wishing everyone a successful journey!

    AOS - Marriage based

    PD  02/07/2017

    Interview date 06/21/2018

    Approved on the spot

    Congratulations!!!! Happy for you!

Just showing the NOA (of the EAD renewal) alone wont be accepted by DPS?

they will. but they will still give you a case number, written on a paper. then you need to wait 3-5 days for the case number to be ready. there's a number on the paper that you can call and ask if the case number is ready for USCIS to verify. Once its ready, you need to take it to the USCIS office and have them verify it. After they verify it, you need to go back to DPS then they will renew your drivers license. they will give you another 1 year.

i am not sure though if you can just call USCIS to verify it. You can try calling them first before going to USCIS office.

  12. Anyways, if your drivers license is expired and your EAD renewal is still in process..You can go to DPS and tell them about the SAVE PROGRAM. They will give you a case number that you will need to bring to USCIS office so they could Verify it and then go back to DPS/DMV and they will renew your drivers license.

we got an emergency appointment: by bringing a letter from employer that i will lose my job if my drivers license and ead expires.

  13. Hello everyone! for everyone that are still waiting like me..

Bad news: According to the new processing times, they are 1-2 yrs behind for the pending I-485. We've been to the USCIS office twice last month for emergency reasons. It is impossible to get an infopass appointment. They always say to check appointments on their website between 12am to 5am..I did that but still there's nothing so I went there and told them its emergency.

Anyways, what sucks is that we have been back and forth the USCIS and the DPS/DMV because of the drivers license. EAD is already expired on 05/07, we filed renewal back in February but they said THEY ARE ALSO BEHiND for the renewals of EAD. the renewal will only give us another 180 days. They should extend the EAD expiration dates since they are 1-2 yrs behind our I-485 right? but no they aren't! and i am not sure if its still free to renew EAD for the second time. and everytime the EAD expires we have to pay DPS/DMV to renew drivers license which is frustrating!

Hi, the Tier 2 person I spoke to basically said because of all the delays that they had right now it was better for me to get it in as soon as possible.  Especially since I can't afford to lose my job if something happens.

I look at it this way, I have nothing to lose by submitting the renewal except the $20 on new pictures and $10 in postage.  I have a lot to lose, my job and income, if something happens and they don't process my renewal on time or the first one gets lost etc.  For me I'm not prepared to take the risk and wait.  With that said, mine expires end of April so much sooner than yours.  Basically the choice is up to you and how much risk you are willing to take.  At this point even just getting the approval or card is taking a long time for some people and that's if you get an interview scheduled.

    Hi! did you send it on this address;
