    The "Ban" only applied to the 7 countries listed and even for GC holders of those nations they made a u-turn the day after the EO had come in effect. There is no reason to scare the OP since they don't plan to travel with a passport from one of the 7 nations (it wouldn't be a problem even with such a passport for GC holders).
     
    And what could a lawyer do? If 0.0001% of what you're saying was true (and it isn't), no lawyer could help anyways. Relax.

    OP,
    I think you are getting scammed.  I know it seems like she's the only girl in the world, and you will never find anybody else, the reality is that there are plenty of women for you. 
     
    I would consider forgetting to tell me that she was married as a deal breaker, i.e. IMMEDIATE TEMINATION. 
     
    Try testing her.  Tell her that you are looking for a new job that can transfer you to her country.  Forget moving to the US, and see what she says.  At first, she may act all cool about it, but keep it going for a while (make up interviews, etc) and I'll bet that eventually she'll show her true colors.

    Sorry to hear this, you were clearly lied to by the woman you love. Whatever story she's telling you about this will most likely not be true, but at least she came clean about being married to another guy when she realized it wasn't possible to lie anymore. She never thought you'd find out, obviously she doesn't know the K-1 process very well.
     
    I know you probably love her but she lied to you, don't be foolish enough to stay around for more lies. You're young, you will find someone much better.

    Add me to the skeptics. Not in the least because you say you're 20 years old. She had a child with a sperm donor - how old is she?
    I mean, nothing against single women having children on their own, but usually women first like to find a husband to raise a child together. Having a child with a sperm donor on your own is usually not an option people consider until they're well in their thirties..

    Suggest you take a big step back, you have plenty of time, annulment is not a quick process and as you said it costs.
     
    You may wish to consider how she forgot to mention she was married. Strikes me as the sort of thing that might be worth mentioning.

    I was wondering if world class programming contests such as Facebook Hacker Cup, Google Code Jam or TopCoder Open can qualify a contestant for an O1A or EB1 visa? and if so what percentile (first 1%? 0.1%? other?) should the contestant achieve in order to qualify?

    In itself no, as part of a portfolio of work, papers, presentations, peer reviewed studies, maybe.

    1. Spend more time together before you get married. Get to know her. This is in fact, immigration advice. You might not want to be one of those people who come back to this forum complaining that their new amazing spouse changed 180 degree after the wedding and you have no idea why. Well answer you, not enough time spend together.
    2. Yes, the father needs to agree for the child to move to the US.
    3. If you're really decided to marry her, have her leave the country and apply for the K1 or if you get married in the USA - Cr1 visa.
    4. Either way, I don't think she can stay. The child has to go back and get the father approval.

    OP, sounds like a very difficult situation and a tough decision. You could say the same to her, if she loved you she'd go with you. Historically Americans follow the work, to the gold rush in the west or steel factories in the rust belt.  
     
    People have made long distance relationships work and they can also destroy relationships. 
     
    One thing I'd do is check the job boards in Your current area. With this new experience you've had you should be able to roll that into another similar position close to home and keep growing your career. It's tough to want to be a good provider and do it with your hands tied.

    2 years later i just want to update this question for all the nay sayers. My sister in law has been here for almost 2 years now on an Au pair/nanny Visa. we couldn't be happier that she got to play such a big part in my daughters life. We were told there is no way, but that's just not true. There is a way you just got to find it.

    USCIS does not issue SSN or ITIN, that is the Social Security Administration. The information to obtain an ITIN is: https://www.irs.gov/individuals/individual-taxpayer-identification-number-itin
     
    It's a bit of process and hassle, but worth the effort. 

    As for the rejection, wait until you receive as to notice why, is the only thing I can advice.

    I don't know why you would come here, make a bunch of assumptions, and then accuse the OP of behaviour you think he showed. How dare you. 
     
    Read a little further into the thread, and you'll see that his wife did a complete 180 immediately after marriage. In this forum, we're certainly allowed to read between the lines, but when you suggest things for which there is NO EVIDENCE WHATSOEVER, you're not acting in good faith. You think his wife "doesn't feel safe with him"?! Where did you get that impression? Seriously. 
     
    You're supposed to assume, when an OP makes statements of fact, that they're actually telling the truth (if there's no solid reason to believe otherwise). Because if you don't do that, then this place would devolve into a toxic and unhelpful forum where people don't take statements at face value and thereby hurt all the OP's who are truly telling the truth.
     
    The OP in this case explained that his wife seemed to have been bluffing with her offer to move back to her home country. When he subsequently offered to pay for her ticket home, she refused. Then she moved out without a word. Those aren't the actions of someone who "just wants to go home" and "doesn't intend to cause harm". 
     
    And according to you, it's "obvious" that he "didn't even try to talk to her about what bothers her or made her change that way"? What in the world. How could you possibly know that? What if he did bring up his concerns? What if nothing is bothering her, and she simply wanted to commit fraud in order to live in the States? That's a possibility, too, you know. USCIS warns citizen spouses about it all the time. 
     
    Also, if a spouse changes that quickly upon marriage, withholds sex from their partner, suddenly doesn't want to change their name, and doesn't want to do any of the things that were previously and mutually planned out, then it's THAT person's responsibility to tell their partner what's going on in their head. Otherwise, what else are you supposed to think except that it was a bait-and-switch, given the context of the case, especially when fraud is rampant? 
     
    I can't believe you wrote those things in all seriousness. I'm actually disgusted on the OP's behalf.

    VAWA is extremely well covered on VJ, plenty of examples where you may think it would not be approved, but it does.
     
    Obviously you need to know how to play the game, and who knows if in this case she does.

    The simple act of changing the door locks by the home owner is perfectly legal. What will vary by state is whether she has a right to re-enter the house and resume living there.
