ANF2014 reacted to Amhara in I-751 December 2017 Filers [merged threads]
For more context, the article that sounds scary is: https://www.cbsnews.com/amp/news/changes-to-federal-policies-pave-way-for-sudden-visa-denials-deportation/

    And the actual policy is:

I noticed the article didn’t mention that this policy is related to NTA’s.  If anyone gets an NTA, it’s already bad news, now, you can just get deported faster if the petitioner has committed crimes or are suspected of fraud.  The article seems poorly written to me because so many facts about the policy (which should be the topic) are missing.  Why should we have to read the actual policy if there has been an article published on it to completely understand it?  Anyways...

They can travel as green card holders, yes.  Just be aware that even as green card holders, they are not guaranteed entry back into the States after travel abroad.  If a POE officer determines they are spending too much time outside of the US, travelling too frequently outside of the US, or presumes they are actually residing elsewhere (ie. Jamaica) and using their green cards as more of a tourist visa rather than retaining permanent US residency  they can be denied entry and can further result in loss of status as residents.

Edited to add:  If "she's not looking to live here", as you say, then petitioning her for a GC is a lot of time/effort/money wasted, and you may want to continue to pursue strengthening her chances to be approved for a tourist visa instead.  Has her personal circumstances (employment, etc.) changed at all since her denial?

Don’t waste your time replying to the trolls. It’s tough wanting them to visit knowing they can’t. Do everything within the realms of the law. Some people read these posts with intention of providing useful information and others like to judge and add irrelevant comments. Chew up the meat and spit out the bone. Meaning, take what’s useful and keep it moving.

Job, business, property, school... Stuff that shows that she has to come back to her country.

To be a little less doom-and-gloom than the other two:

    1. What evidence did she initially provide? If none, there is hope!
    2. Supporting evidence is pay stubs, employment letter, documentation of assets such as property, savings, etc. Basically anything indicating her ties to her country.

Now if she did provide all that documentation the first time, and nothing has changed (such as a higher salary, substantially higher savings, etc), then it probably isn't worth trying again right now.

I didn't see a thread for December 2017 I-751 Removal of Conditions Filers... so starting one now... if there is another one already started please let me know. Otherwise feel free to post your journey here.

My DH and I filed our paperwork this morning, and sent out via Priority Mail to the California Processing Center. I looked up processing time today and was shocked to see that they are just now processing August 2016 filers, over a year behind! That's crazy, so here we go another long drawn out process, but  what can you do other than patiently wait... I can't wait for this part of our journey to be over, so that we can apply for his citizenship right after the 3 year anniversary date.

ANF2014 got a reaction from nnguyen36 in upgrade from F2A to IR1 after I-130 approved
    Hi nnguyen36!
So happy you were able to get through to a supervisor! I believe I got an email either a day or 2 after the update was made. I also called NVC the next business day and spoke to a regular rep and they confirmed update as well. I believe it takes 24 hours for the system to reflect the change... Glad to help, and I wish you all the best

Yes, when I finally spoke to supervisor (Sylvia) it truly felt like a gift from God. I pray you'll get through to a supervisor soon. Wishing you and your loved one all the best on your journey!

Dani&Juli_VE, I'm sorry that youre in this situation, I completely understand how devastating it feels when they throw thsee timeframes out like we haven't already waited long enough. The whole process is unfair, flawed, and inefficient. We pay the price for NVC's mistakes. With that said, I truly hope that you'll have your cc soon. Keep us posted.

I had a great experience with Sylvia, she updated our case from F2A to CR1 after to waiting for almost 3 months. I was able to get through to her when I called in and requested a supervisor and she took care of it on the spot. Hopefully she'll be able to assist you as well!
