I hate to be an ### for saying this, but coming here and telling us your husband is illegal and you are attempting to get him a K-3 is sort of a slap in the face to everyone here having to go through the process and doing things the legal way. You husband has violated the laws of this country and IMO should be in jail instead of applying for a visa.

    I could understand this if the OP and her hubby where trying to still do things the wrong way. However that is not the case. The correct/legal process has been undertaken in order for him to gain legal status. Those that are in the US illegally and do try to correct the situation in the right way are punished by way of a ban and having to be denied the visa and then file a waiver. There are many reasons why people find themselves filing waivers for overstays/illegal status, many on this board included, those open about it and those that are not. They deserve the same respect as anyone else for doing things the RIGHT way.

    Lorelle, I'm confused now. Why are some people advised that they can just adjust status since they're here... even if they are illegal.. "Elsie is confused" was advised to pursue the AOS. What am I missing??

    I don't understand that either. I have no problem with this situation if a person has to at least leave the country during the application process, but how in the name of all that is lawful, can a person stay here without leaving if they have entered the country illegally?

    I'm sorry you feel that way be you are entitled to your opnion. I never in my life expected to fall in love with someone here illegal., but sometimes things happen that you never expect. So at least we are trying to fix the problem now instead of just ignoring it and acting like nothing is wrong. And also from other post I have read on this site I am not the first person married to someone here illegal.

    I realize you are in a difficult position, but one of the reasons this process takes so long is because we have to deal with situation just like this.

    I am sympathetic. Anyone who has been to poorer countries knows that the opportunties in America far outweigh those of our 2nd and 3rd world neighbors to the south. That being said it still does not make what has been done here right and creates a severe problem with the application of law in an equal manner.

  5. I received the following email about 6 days after my husband sent the RFE response:

    On August 2, 2006, we received your response to our request for evidence or information. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates.

    Can someone tell me what does this mean? How long do you guys think it will take until I get the approval?

    It will take less than the maximum stated in the message. :)

    Honestly it is hard to say..Best bet is to look at others timelines that have similar circumstances to yours..

    Can I ask what the RFE was for?

  6. Ok for all thoes who had to send the 129 f to the chicago lock box and got a receipt number that begins with MSC....... how long did it take for it to actually work only online? I have had mine for about 10 days or so and every time I try to look it up on USCIS I keep getting this

    Validation Error(s)

    You must correct the following error(s) before proceeding:

    Status for this Receipt Number cannot be found at this time in this automated system.

    I know others have had this issue....I just want to see if any ones number is working yet and how long did it take from the time you recived the receipt NOA1 to the time that the number started working.

    Our receipt date for I-129F is 19 JULY,same thing ---can not check online.

    I just checked mine for the first time today and it works... NOA 1 date of July 20th

  7. Should say going to live with my WIFE .Hi everyone...I have decided to go live with my wife in October while we wait for her Visa. Not really anything of substance to this thread, but at least we will be reunited in a much quicker time and now I really don't care how long the visa takes :P

    Will this effect anything on the visa standpoint? I figured it would be good evidence at the very least if we show we are living together.

  8. Pinch me, I'm in shock. The I-129f made it to the finish line before the I-130. Petition approved yesterday (notice by email), so it took 4 months, even with IMBRA.

    We were married in New Jersey on my husband's birthday in March. His present was to be sent packing on a plane back to Toronto, to become celibate for his first year as a newlywed while waiting for his visa. Since then, he has been sweating his balls off at WalMart, unloading trucks in the heat with no AC. Lucky him, because he HAS a job. I've been searching, unsuccessfully, since April, and getting anxious. No, getting psychotic. So if you want to know the root cause of my comedy, it's good old fashioned fear.

    Life has a way of giving you good things just when you think can't take any more bad. I thank God for hearing me, and will continue to pound on the gates of heaven, including all of you in my prayers, you who are still waiting and wondering.

    Meanwhile, here's some more good news. Now that I don't have to knock myself out (as if I were a rogue elephant), there'll be lots more Chilean red wine for the rest of you.

    Congratulations, I am happy for you, we also married on my husband’s birthday in March the 11. We had our I-130 approved however I think I am going to give up on the I-129F, it is taking for ever. Well hope that you soon have your husband with you.

    Why give up on the K-3? Do you really have anything to lose by waiting? There have been many people who have given up on K-3 and I am totally puzzled as to why you wouldn't be willing to wait it out. The worst thing that can happen is that is doesn't get approved before the I-130 and you are in the same position you are in now. At best it can come through faster and you can be reunited. Please explain to me the logic in cancelling the K-3...

  9. My parents are acting as my co-sponsor for my spouse. Seeing as they are doing so, does it even matter how much money I make? The reason I ask is because I am considering going to live with my wife in South Africa for a few months after my lease is up here. Obviously I won't have a job at that point, and don't plan on getting one in South Africa considering the rate of high unemployment and the limited amount of time I will be there. Will this even matter since I have a co-sponsor who makes well over the required amount?
