    I would resend the birth certificate, court ordered name change document and a copy of her current photo ID. Yes, they may have overlooked the name change proof. Include a statement explaining everything and point it all out to them as clearly as you possibly can. The court ordered name change document should list her previous name and new legal name, so they should be able to connect the dots, BUT I would still point out both names in your explanation.

    Though we received different request for the RFE on my AOS, the problem is the same. The officer may overlook the proof you presented.
    In my case, they wanted complete tax return, in which we submitted in the first go round.
    I second what KayDeeCee has said on here, and make a brief explanation on the joint sponsor and present the proof again. If this goes smoothly, usually the approval won't take long.

    Me too. My taxes were reduced more than $11,000 PLUS the first $2600 of two of our family's educational expenses were paid with tax credits. That's more than the entire family could collect in food stamps, but we make too much money to get food stamps so we get tax deductions and credits instead. So do you. When someone comes forth and says "I pay taxes and do not take any credits or deductions I am entitled to", then they will have some grounds to criticize someone else.

    He didn't ask for their opinons of people who get food stamps or analysis of his personal situation. He asked specific information and thiose that criticized him fail to answer the question.
    She can use her passport as ID to fly to Hawaii, and YES he can get food stamps. Those are the answers the rest is pompous BS. We have a system to help people that need it, if someone does not like thaqt there are avenues to pursue that do not include ridicule of people using the system we have. I will note that those "taxpayers" will gladly take any sort of tax credit or deduction they can which is also part of our system and is in no way different than any other subsidy given by the government. Gripe about someone getting $3500 in food stamps but gladly take a $5200 education credit, $1000 per child credit, chiold care credit and ad nauseum until in fact they really pay no income tax at all. 47% of Americans pay NO income tax after deductions and credits.
    People need to have a little more thought in their process.
    The other problem, and main problem here is this ridiculous Affidavot of Support which should no teven exist. Eliminate and simply make family based visa recipients ineleigible for public aid until they are citizens. Period. Job done. This process of trying to determine HOW they will get the money BACK if your spouse becomes a public charge is STUPID. Why not just NOT give the money to begin with?

    Most of what you read is wrong.
    HE does not apply for permanent residency, SHE does. SHE is not receiveing food stamps, HE is.
    US citizens are always eligible for public aid and NEVER surrender that privilege.
    HE is her sponsor, and possibly has a joint sponsor. He fills out an I-864 and must show that he earns more than 125% of the poverty level to sponsor her. He can qualify for food stamps at an income level higher than 125%.
    You misunderstand the purpose of the I-864 as most people do. The purpose is to show the government that IF your spouse becomes a public charge that you make enough money that the government could garnish your wages to get their money back. The issue of food stamps may come up at that time but is not addressed at any other point in the process
    Where does it ask about food stamps on the I-864? What you are doing is repeating what others who are offended at the idea have fabricated. "It will haunt you when you apply for AOS" BULLSH*T. After AOS there is no further question about finances EVER.
    What IS possible is that IF they have an AOS interview and IF the husband attends the interview and IF the officer doing the interview ASKS "do you receive public aid" then the husband would have to answer truthfully and the officer COULD determine that he will ask for a joint sponsor. So there it is, there is your worst case "haunting"
    As I said earlier, I do not recommend you apply for food stamps until after the AOS. I will also say that my family is the most important thing in the world to me and if I needed assistance to help them eat foodI would apply for food stamps NOW, this minute. And if someone else doesn't like it they can kiss my @ss. I would also work 100 hrs per week to avoid doing that, but if I had to I would in a heartbeat, make no mistake about it.
    You also need not make judgements about his trip to Hawaii, could be a gift, who knows, but it is none of our effin' business. If you have a problem with the food stamp system, then vote Republican.

    I hesitate to participate in this discussion, because we do receive foodstamps. I had been with my fiance in Mexico for about 8 years, and we arrived here at the heigth of the "depression" in June of 2009. There were no jobs for carpenters, or handymen. I knew that I was the only one that qualified for help, and made it clear when filling out the forms, that my wife and three children were immigrants, and did not qualify. I am now employed, and we no longer need them. I want to say that as bad as this economy has been, with people accustomed to making thousands of dollars, and are now on unemployment, is it such a surprise that there are now people on welfare, that have never received it before-hand. This is almost the same for me. I believe that the welfare department knows this, and thinks accordingly.

    Let me help you feel better. I have a good job making good money and I do not get food stamps. Relieved? Good.
    Alla qualifies for the "hope credit" $2600 in our pocket each year that other taxpayers pay for. In addition to her 50% tax free scholarship worth $8000 per semester, it covered a lot of the expense of her Masters degree from a private university. Thanks. No food stamps here!
    $1000 child tax credit for our immigrant LPR son under age 17.
    $11000 off our income from itemized deductions!
    We use the tax return to pay for our trips back and forth to Ukraine and it has been enough each year for all of us to go twice!
    No food stamps in this house!
    Just focus on food stamps, don't worry about how our country runs its revenue system.

    These are questions you should not ask and no one should. The problem comes from the fact that we have to make this affidavit of support. We should not. The immigrant should simply be ineligible and then there is no question
    Your standard for what someone should do with their money is not realistic nor is it in any way in line with reality and what is required to receive food stamps. Would you take a child tax credit? Why should the rest of us subsidize your child? Would you take the "hope credit" for education? Why should we subsidize you for that? A tax deduction for your home mortgage interest? Why am I subsidizing YOUR house???? How much further would you care to go?
    The problem is not food stamps, the problem is a revenue system that creates class envy or class warfare and exempts 47% of the population from paying any income tax at all.
    If you have issues with our revenue system (and I do) then address that and do not try to decide what is best for others to do.
    Personally I hope his fiancee gets here OK and they get married and she gets a job and they live happily ever after.

    I don't recall the OP asking you to buy his fiance's food at any point of his post. I give the kid credit because at least he seems to have a plan for his future and he was receptitve to getting a second job for additional income unlike some of the people who stay on the public rolls for years and who know how to work the system.
    With all the wasted tax payer money spent on things that aren't important I have no qualms with him getting a few bucks each month in food stamps. At least the OP is a USC getting the benefit, not someone in a completely different country.

    They will. And they should. Why would a citizen be required to surrender their rights and privileges to get married?
    The problem here is not that the OP gets benefits or not, the problem is that the federal government will GIVE benefits to family based immigrants and THEN ask for the sponsor to pay the money back. Hence the "need" for the I-864, the I-134 and a whole lot of BS we really don't need
    Simply make family based immigrants ineligible for means tested benefits until they are citizens and be done with it.

    He has a job. The economy sucks, people are losing their jobs and getting hours cut all over the place. He needs a little help and he's allowed to get said help. He is a tax payer, and paid into the system. The OP has even said he's looking for another job. Ease up a little. Some need to remember the saying "Walk a mile in my shoes"
    People seem to be confusing temporary benefits as welfare. Welfare is a totally different ball game all together.

    Nonwe of this is correct. Please refrain from giving incorrect naswers based on what one would wish for. It takles a lot of posts to correct this mess.
    The US citizen is NEVER, EVER restricted from the benefts of being a US citizen for any reason.
    A US citizen can easily qualify to sponsor an immigrant under one definiton of poverty (125%) AND qualify for food stamps under another definition of poverty (300%)
    A US citizen can qualify to sponsor an immigrant with ZERO income, ZERO assets, while collecting EVERY FORM of welfare there is ...IF he has a co-sponsor.
    I do not have to like it and you do not have to like it, but them's the facts! I always presume the OP wants the facts, not opinions of the facts.

    I have seen this before, asking can I get food stamps, welfare, WIC, etc. What you can NOT get is long tern care like SSI/SSA. But these rules change regularly apparently. I used to work welfare/DPSS and if LPR came in I checked their green card info and if there was a sponsor they got the bill for whatever food stamps we issued. But we still issued.
    As for the USC being eligible, well guess what. When it was just me I had oodles of spending money. Now in the last 3 months I have acquired a wife, 2 kids, and 2 dogs. Talk about intense! But I have much less spending money than I used to. DUH! Yes they can get Medicare/Medi-cal and other benefits but I did the math before they got here. I can afford insurance, food, and so on. As a family there is no need to seek out benefits. That's how I roll.
    The 125% poverty numbers are kind of a joke, there is no way to support a family of four on $28k a year. If the government thinks I can do it, I want to see their numbers.

    I also understand that there is and has been a problem with some immigrants taking advantage of government benefits, but in this particular question/situation, it is simply a question - not a plan to mooch off the government. I also wanted to know the answer so that when my immigrant husband arrived, if for some tragic reason I lost my job or we ran into a difficult time financially that was not prepared for, would be at least be able to eat or would we also have to worry about where to get our meals from. Not for nothing but, the economy isn't pretty right now and any of our lives could change tomorrow - what we had, where we worked, what we were accustomed to....gone. There is nothing wrong with knowing or planning in advance. But to make a statement like "san diego" made....if you read it again...it actually made no sense at all in conjunction with this post. The OP wanted to know if the LPR would be able to be included on the application - not apply for food stamps. This is when "san diego" went postal and started with the "immigrants sucking up government benefits" speech. It really served no purpose. And most importantly....the answer is NO. The LPR wouldn't even be able to be added to the application - so it really effects no one, or taxpayers, or the government.
    What blows my mind even more is.....everyone on here has an immigrant partner....so to speak about immigrants as though they are second class as in "san diego's" statement.....is disgusting to me.

    I made a mistake on the I-129f. Wasn't as significant: I put the wrong DOB for my then-fiancee. Anyway, I called up USCIS, told them I made an error, and they said to send in a letter to the lockbox stating the correction, along with a copy of the NOA1. The petition was corrected by USCIS at some point.
    I would recommend writing a short letter explaining the mistake and sending in the corrected page too, like Catherine did.
    I think you should be fine.
    What's the point in saying all this? The dude already is beating himself up for his mistake. He's fully aware of what he should have done. It is what it is at this point.

    Wow... You'd think the hospital staff would know about it, but I guess they don't have much to do with citizenship... Once you get the birth certificate, you're all good to go.
    Despite all it's controversy, birthright citizenship is one thing I love about America. Its a country of immigrants and birthright citizenship gives a clear, simple rule. My home country abandoned it decades back, and it's created a huge mess for young people trying to do something as simple as a passport application.

    It's amazing how little the general public knows about birthright citizenship and the 14th amendment. I was at the hospital for preterm labor and the medical assistant who was doing my registration asked if the baby would be an American citizen. She also proceeded to say that they often see tourist births in their hospital so it's not uncommon. When I explained to her that the baby had a right to citizenship even had my SO not been a USC she was utterly shocked. Just an interesting observation.

    get Marriage certificate
    Get state ID(optional)
    Apply for Adjustment of Status and ead and AP together
    After case number is received do a walk in biometrics once biometrics date is received or wait until date.
    Change Ssn name after ead is received.
    Removal of Conditions (90 days before Gc expires)
    made a few changes.
