PriyaB so sorry that you are still waiting but do not lose hope. I have been in your shoes. The upside is that with YOUR Category of visa once you get ISSUED YOU do not have many other steps whereas with K1 there are other steps that they will go through. Trusting that you will get ISSUED before the holidays.

CandAm got a reaction from LoveWarrior in K1 denied under section 221g
Inconsistencies in your relationship could mean for example you state you have been involved with this person for X # of years yet you cannot answer simple questions about them etc. Here are some of the reasons I found from others on VJ in your situation that were denied. Maybe you can review with your fiance to see if any of these happened in the interview.
K1 Visas
-1 applications are subject to the same review standards as immigrant visa applications. The main reasons for visa refusal are: lacking documentation; need to review or verify evidence; lack of a petitionable relationship; misrepresentation of the facts;. A common basis for refusal is a prior marriage for the beneficiary or the petitioner that has not been legally terminated.
Lack of proof of bonafide relationship, not free to marry, already married ( in their eyes ) not enough money for affidavit , fiancé doesn't know details of work or family
didn't meet within 2 years, did not adhere to the cultural norms (such as didn't have an engagement ceremony when this is customary for the local culture, or one fiancé is much older than the other when this is unusual for the local culture). A very large age difference between the couple can cause concern. However, there is no specific age limitation.
Relationship a scam for immigration purposes only.
No common language/They are paying attention to Skype logs, wanting to make sure you can communicate together.
Fiancee commits a misrepresentation during the interview (or so it seems to the interviewing officer)
Fiancee interviews poorly and the consul doubts that there is a bona fide relationship with the U.S. citizen
Inability to establish concrete evidence to demonstrate to the CO that relationship is genuine.
Usually when K-1's are sent back to USCIS the petition will expire before it is re-adjudicated. You will most likely have to file again or get married and file an I-130. Before re-filing you must find out the specific reasons for denial, and address those reasons, or filing a new petition will most likely be denied as well.

CandAm got a reaction from duvalin in Waiting for our passports from Montreal
"Duvalin"congratulations on a successful POE... even with the added missteps of MTL. There is a link to pay that $165. I haven't done it yet for my hubby because I read on other posts that the site was'nt functioning at 100% since the technical problems.Once I realized he could pay it after I stopped stressing. I am not sure if they send an invoice. My hubby did POE @ Pearson International Airport yesterday (8/7) and was given a form with the site information etc. We'll do that on Monday or sometime next week.I will post any info I find. Wishing you much happiness and success in the USA. If all your names are in the correct order don't stress but if I find any information that may help you I will post it.Decompress and enjoy your post MTL life

Andy & Vanda (and really everyone else caught in the MTL waiting game..) I feel so bad for you guys. I have shed enough tears over this situation to last a lifetime but my heart breaks for you guys having to think of postponing your wedding. The only thing I can say is that try to stay positive. As a caterer I can tell you that I have seen weddings cancelled and postponed for different reasons but sooner or later the wedding takes place and somehow the joy and happiness is probably more so because of the journey. I am hoping your job is still available for you. I have been waiting for over 16 months to see my hubby and have my family together again so I know the torture of waiting .. I am not sure anymore what is worst being on AP indefinitely or being stuck on READY since 6/2.. I also reached out to my Congressman and other than the names and visa category my letter was the same as yours and I also had received the same rude response to my inquiry from MTL.. Hang in there. NLR's date calculations are correct so you are getting close. I do think that although it doesn't move them along any faster knowing that there are other eyes on your case will cause them to hold to the 8 weeks. I will always be grateful for VJ and the people that have connected with me because if it wasn't for my Faith and and the VJ community I think I would have lost my mind.

No updates and I am coming to realize that for the most part the dates can usually be traced back to dates when you inquired.

Send the email. I have had quick responses from that route. Quite honestly though you are probably looking a long wait because of the "Worldwide Technical difficulties". Yesterday someone who interviewed at MTL and who was approved on the spot was told that the VISA wouldn't be ready for at least three (3) weeks. My hubby's status has been on READY since 6/2 and has been update 63,6/4,6/8 and 6/16.. Trust me I know it's frustrating but try to hang in there.

CandAm got a reaction from Darnell in Eligibility document?
This is the answer I had gotten on VJ when I had the same question.......
"This is a requirement that is particular to Canadians. It means whatever document gives you the right to be interviewed in Canada - in other words - what document will prove that you are a bona fide Canadian resident?
For Canadian nationals, it's your passport or your birth certificate. For non-Canadians, it would be the residency visa that allows you to stay in Canada.
You've sent a copy of the document that makes you eligible to interview in Canada! So they want to see the real thing at the interview.''
Also check Montreal's consulate website to see if they require anything that NVC has not asked you for. Bring it with you.Better to be over prepared. That was our situation... Good luck with your interview.

CandAm reacted to Sarahc886 in Difficult situation
Hi, i dont want to tell all my story because its simply too long.
I just have a simple question. Is it always better to wait till removing conditions or divorce and fight for stay in us?
We are a marriage that is real. He was coming to my country before I got here, we love each other, and the marriage is true. We already have some.proofs to show the marriage is Bonanfide. We now buying a house on both our names. Soon we will move in probabky. My gc expires in one year.
However.. Because of many factors and living with his parents too long our love got much weaker, I don't even know if this is the way husband should be like, but anyways.
Making long story short. We will get house in one week and now I stay in friends house for a week. I could not live with him because of parents (I know I'm not bad, it's smth about them) so I'm like this now. We are married. The marriage is hard and it's hard to say if we can get along like marriage anymore but.. We agreed to try living together. Making some rules so we can live comfortably. And here is my question. Is it better to divorce now and show immigration all the situation or try living together and see what happens even if the marriage could not be real marriage anymore. I don't say I would do it for gc it was never my intention, I married him for love. But it is true I want to stay here because here is my life now.
My instinct tells me to try. I would like to see other people opinion, pepole who don't know me.

CandAm reacted to djicet in Traveling to US after interview without using K1 (split thread)
Hello, I'm from Montreal and I am currently in the process of scheduling my K1 interview online, having received the packet 4 instructions letter by email today. I have many choices, the earliest being July 28, and then there are spots almost everyday in August. I planned to be in the US for my engagement party the weekend of Aug 8, so my question is as follows:
1. If I choose the July 28 interview date, and get approved, there's only about 1 week before I want to travel, so maybe that's not enough time to receive the passport with visa package? (they will send it to Loomis courrier in Lachine, and I pick it up from there). If I go this route, would they take my Canadian passport away and mail it back with the visa or will they issue a new US passport with the visa in it? (All the photos I give them are US passport standards, so I was wondering about that).
2. If I choose an interview date some time in August, after the engagement party of Aug 8, I will still be able to travel using my Canadian passport and come back before the interview date? (Most answers found in the forums suggest yes)
Obviously option 1 is preferable, then I won't have to buy a return flight ticket to come back, but timing is just too tight. I will check the online visa scheduling system several times a day to hopefully find a sooner date, in case someone cancels an appointment or something..
Thank you!
