Just thought to share my story. I have filed for ROC waiver .

Filed in May 2016 ROC waiver from Vermont but moved to Texas after two months.
Received RFE from Vermont in April 2017, responded.
Called USCIS after no response regarding RFE for over a month, was told that i am in line to be interviewed and file on way to my local office and that i have to wait for the interview letter.
The interview letter never came but i got the biometrics letter to take finger prints again. Did biometrics on Aug 10th and waited for the interview letter but no letter and then on Oct 11 i got email from USCIS that on Oct 10, 2017 we mailed your new card. Finally received the card today , process took 1 year 5 months.  Glad this is over. Next is citizenship but i have time for that. Goodluck to everyone going through the process.

My case i didnt have much evidence. In response to RFE i sent one page letter explaining my story frm the time i got married to till now . Then i enclosed one notarized affidavit from a close relative who knew us both as couple. And 2015 joint tax transcript. And some letters that i had received while living together with him at his address. Thats all i sent and i prayed.

    Congratulations! That's great news!

    Good afternoon everybody.

Have anyone experienced changing mailing address from one to another? We are planning on moving to a different state and a bit worried. Does this going to delay the process? Because I've been told that in this case they will need to transfer my files from one local office to another. Thank you for your replies

    Hi,

I don't think so, I mean based on my experience, the processing time is still the same. During my AOS process, we moved from AZ to MA, and the AZ USCIS office sent my GC to my MA address. You just have to let them know your recent address as well as your US sponsor.  Some people don't get an interview, and some do like us, so we also waited for my interview first before moving, but it is a case-to-case basis. An added factor too is the processing period per office. Hope this somehow helps you. Regards.

Hi,so u meant spouse visa's holders need to wait total 6 years before applying citizenship,i think its not the case ,the req for this catagory is 3 years of being permanant resident in US.

Agree with you. I know it is just 3 years as permanent resident under the K1 route then you can apply for citizenship. Correct me if I'm wrong, but so far, that's what I know as well.

Yes you have to send two forms one for the beneficiary(Immigrant Spouse) form AR-11 which is also available online and Form I-865 send by the U.S citizen spouse. You have to mail the I-865 within 30 days of change of address. If you were unable to send these two forms on time it won't hurt anything unless few years late, just send them as soon as you could, good luck. Regards

    Agree with you

    All,

I have filed my I751 case in 2017.

Now i am relocating to another state, will there be any issue if i will change my address while I-751 Pending.

(I have a plan to submit online AR-11 form and also by calling uscis to change my address for my pending I-751 application),

Do my spouse also need to submit I-864 form (Change of address) as well. (Because she is also relocating with me and she was the one who sponsored me for I-130, but now she is not working).

Your comments will be really appreciated.

Yes, you have to submit this like what Name O Boy mentioned on his comment. I did this after we moved to avoid any delays or confusion with my address. I submitted it online while My USC husband also submitted a form and they mailed back my husband telling that they received it as well. Regards.

    Hello, everyone!

My green card expires on December 21, 2017. From my understanding, my husband and I would have to file Removal of Condition on or after September 21. However, I haven't received a reminder notice to apply for ROC. Is that normal? Do I have to have the reminder notice before I send my application or I can file without receiving it?

    Thank you!

I haven't received any reminder either but I filed for my ROC. You have to do it too on or before Sept 21.

The OP's issue with a K-1 is he needs to meet her in person at least once first. So he wants her to visit since he won't fly.

Getting a tourist visa to Canada would be just about as hard as the US, IMHO. I don't know Mexico's processes, but that may be the route to go.

Thanks for the info. Yes, probably going to Mexico will be a better option then. I thought of the K1 visa since I think if the OP's GF can fly to Mexico and meet him there first, then they can go the K1 process route here in the US afterwards since it is much easier to get instead of visitor's visa, fewer denials..just my personal opinion. Regards.

    I can't fly. It's that simple

    Hi,

I saw some posts giving you suggestions on driving to either Canada or Mexico. I think it is the best alternative option for you to meet in person with your GF if you are afraid to fly. You can drive to Canada from here in Boston. From here to Mexico, you can also drive for 3-4 days road trip.

Regarding Visitor's visa from PI vs. K1 visa, I believe K1 visa is much easier to get compared to Visitor's visa that's why others are suggesting it also to you. My husband and I thought about me having a visitor's visa at first, but after several types of research, the faster route is K1 visa and has fewer denials. But then again, if your GF can prove stronger ties to PI then go for it.

    Regards.

A lot depends upon the state in which you live.  Best way to try is to be ready to explain that your green card is expired, but the I-797 extends the date on your green card for one year.  Your state may only give you a driver's license up until the extension date - and then you'll have to come back once you get your 10-year card.

If the clerk you are dealing with pushes back, ask for a supervisor.  Just explain things clearly, and with confidence if the clerk starts to hassle you.  Best of luck.  Hopefully, if Massachusetts is your state, you won't have any issues.

Thank you so much Sukie! Yes, I live here in MA. Hopefully I'll be able to do so. I will let you know my experience. Kind Regards. :)

  10. Hi everyone,

I just want to ask if did anyone of you tried to get their driver's license for the first time using their I-797 extension letter? Unfortunately, I wasn't able to get a DL during my 2-year stay here in the US since I did became busy at work and got pregnant. I'm wondering if I can still get a permit and DL using the extension letter. I've been reading some reviews and said that DMV officers are giving others a hard time even for just renewing their licenses. Any advice and sharing your experience would be really helpful. Thanks!

There have been quite a few posts recently regarding traveling on an expired GC with the one year extension letter.

Page 38 of this document provides some reassurance:

    https://www.cbp.gov/sites/default/files/documents/Carrier Information Guide- English.pdf

It also makes clear that the 12 month extension is from the card expiry date, not the receipt date of the I-797.

Thanks Derwood this is super helpful!

Hi, just a question for ROC requirement..

My husband and I have a Joint credit card, do i have to make copies of the front and back of the credit card?? If so, do i need to blur or cover our account numbers?? do i also need to copies of statements??

-- I just photocopied the front of both our credit cards and decided to cover the account numbers but leave the last 4 digits. You may or may not cover it. Yes, you need copies of bank statements. You can do quarterly or monthly statements. I did quarterly statements and it's fine.

We also have a joint checking account that was opened since we got married.. I already have a statement from the bank showing when our joint acct was opened and balance and that it's still active.. is that enough?? Or do i also need to submit copies of all our joint bank account statements (2014-2017)???

    - You can submit the statement from the bank showing when it was opened and it's still active and yes. it's better to submit copies of joint bank statements. You can do every quarterly statements or monthly statements. I did quarterly and it's fine.

    Thanks in advance

    Hi,

Please see my answers above (red font). Hope this helps.  Also, joint tax transcripts are better for ROC. Good luck! Regards.

I and my wife got married in July 2015. I got my 2 years conditional card in December 2015. Am supposed to remove my conditions by September 2017 but right now our marriage is falling apart. My wife can't have kids due to past tubal ligation. We tried to reverse the surgery but  the doctor said the chances of her having kids are very low and there is a tendency of ectopic pregnancy. Moreover, the surgery was very expensive and we don't want to go on with it with the very low chance of success. Since then our marriage has not been the same. She has a child from a past relationship while I have no kids. We are separating because of this issues and a divorce is on the way.Am so confused. Do I need to file for the ROC with a divorce waiver ASAP or wait till we file for divorce first, get the final decree and then file the ROC? Can I still file jointly with her in September 2017 while we are seperated. I need your advices pls.

Your story makes me really sad but if there's a way that you both can save your marriage, that would be great. A marriage counselling might be helpful or maybe a vacation for just the two of you to sort things out will also be a good idea. RE: Divorce, I believe USCIS will typically grant removal of conditions with appropriate evidence of divorce, i.e. a divorce decree or waiver. Hello all,

I was just wondering how anyone on here has dealt with a lost green card when sending in I-751 form and supporting documents.

I have a stamp on my passport which shows that I can work in the U.S./travel abroad until July, and I'm going to send in the I-751 package by the end of the week as my 90-day window closes on June 4th.

I was wondering if anyone on here has an idea of how to approach the lost green card situation with them, either by writing a separate explanation letter or maybe by just writing a little note in the cover letter?

P.S.: I am aware that I'll have to provide supporting documentation, such as a copy of the I-551 stamp, the biometrics appointment letter, etc.

Any help would be greatly appreciated

    Thank you

    Hi,

I saw this thread here and maybe this could give you some insights on what the person did when he lost his green card - http://www.visajourney.com/forums/topic/244875-filing-i-751-soon-but-lost-green-card/. Hope this helps. Regards.

  15. Hi guys,

A quick update. I just finished going to USCIS today for my biometrics. It just took me around 10-15 minutes. They just asked for my biometrics letter and green card then I just filled out a form asking for basic info such as name, previous name before marriage, phone #, ht, wt, nationality, citizenship, A#, application nos, color of eyes and hair and after filling up the form, they gave me a number then called me after and that's it. I also went there an hour before my appointment schedule and since they were not toxic that time, they let me in.

Now, the waiiiitiiiing game begins.... Good luck to all of us!

  16.

We sent our I-751 in on 4/18/2017 and as of today, 5/23/2017, we still have not received the NOA1. I know this doesn't sound right. I see most have received theirs within a few days of filing. I checked the tracking and it was received 4 days from mailing it to the California office. Should I call or just wait? Thanks

    Hi,

I think you are not alone. We have a thread for I-751 April 2017 filers here at VJ and you can share your experience there. We have a spreadsheet for both California Service Center filers and Vermont Service Center filers so that we can track the filing period. Feel free to join us as you are an April filer too. Filed 4/13 at CSC (previously entered into spreadsheet). Cashed check today. NOA1 should come any day now.

Note: To those who post regularly to this thread, you might consider putting the spreadsheet link into your signature so others coming into this thread for the first time can easily locate the tracking sheet. To edit your signature, click on your username in the upper right hand corner and then select "Account Settings" from the menu.

Sounds a good idea! I added it to my signature now. Thanks!

    Hi marianav,

Welcome to April filers. That's alright , that happens to me too during my K1 processing and my lawyer actually placed an incorrect amount on the check so my paperwork got rejected that time. (never hired a lawyer again on my AOS and ROC) I think it all works for all service centers if they received an incorrect amount of check. So what I did was  I just waited for my paperwork and they returned it to me and then that's the time I sent another one again. So you don't have to worry as it also happens to anyone like me for instance. My advice is just wait for the letter and paperwork. :) Hope this helps. Regards.

I think it's approximately between 2-3 weeks that I received the letter and paperworks that time.

Hey all April filers! I am supposed to be an April filer too... until I realized today that I only included a check for $595 and none for the biometric fee. So frustrating to realize that because I worked so hard on front loading and organizing the whole paperwork! Does anybody know how long before they usually return the paperwork for rejection? I'm from NJ and filed in VSC and paperwork was sent last Saturday. Sigh! My card expires on June 9. :(

Hello everyone... Just a quick question: I notice that a lot of people sent one check covering the I-751 fees and the biometrics fees. I filed sending two separate checks. I did not include my A# number on the checks as I did not see that requirement anywhere in the USCIS instructions. Some mention that they included their A# number on their check. Is it possible to get rejected for these reasons? Again, I send my package on 4/8 to VSC and no news since then. I am worried because my card expires on 5/7 and I thought that I would have received a respond by now.

    Hi G&V K,

I haven't placed my A# number on my check too but I received the NOA1. I think it's not required to place the A# on the check don't worry. Regards.

    Hi everyone!

So my husband and I are married for only less than a month in Japan. We only had to pass papers in the city hall to get married. No ceremonies and all that. I have dual citizenship, Japanese and Filipino, and my husband is American.

We're planning to have our church wedding in the Philippines since we both have families there. We just want to celebrate with them. I think this will only be a renewal of vows since we're already married.

Do you know the requirements for this? And if we're going to have a garden wedding instead, who can do the ceremony for us? Pastor? Priest? Mayor?

I hope you get what I mean :) Thank you so much in advance!

    Hi,

We are planning to renew our marriage too in the Philippines so we already reserved a church for the specific date that we want. Here are the requirements for the catholic church wedding. Please see below. Also, if you already report your marriage in the Philippines then you need that too. I know the requirements also depends on the church but to give you a heads up, I give you this list. With a garden wedding, I think a pastor or mayor is what I heard a lot of people get since for priest, the requirements are different. Hope this helps.

    Hi,

Yes I did. Though it seems silly to put N/A to all of those you are referring too, I still put NA on it and uscis accepted it. I think whether you put NA or not it's okay. Regards.

I submitted just one check $680 but specify it on the check below ( I-751Application and Biometric Service Fee )  like the instruction here - https://www.uscis.gov/forms/paying-immigration-fees . Hope this helps!
