I don't know what it means and it might be nothing at all, but today I checked my online status and noticed that yesterday my I-485 was TOUCHED!! Other than Rebecca, has anyone else been 'touched' while their case is pending for the FBI name check???

My interview was on 05/11/06 and I am also pending for the FBI name check. I contacted my Senator at the end of June, the First Lady yesterday and am planning to contact the Ombudsman as soon as the processing date is 30 days over my receipt date...which should be soon. In my opinion if you ask for help sooner rather than later, you might avoid being stuck in the 'black hole' for ridiculous periods of time. It will at least keep your case familiar to everyone important.

To answer your question, our interviewing officer seemed to indicate that the FBI name check for me was initiated on 04/04/06, which was 1 day before my Biometrics appt., but don't know if that is standard procedure for everyone?!

Also, from my understanding, the writ of mandamus can be filed against USCIS, etc, once it's been 120 days or more from the interview date, a name check is still pending and there has been no decision made on the case....even for greencard applicants. The reason is that I guess there is legislation that states that an interview is not even supposed to be performed until ALL security/background checks have been performed. I also read somewhere that a writ of mandamus can be filed pro se, which means that you can file it on your own without the help of a lawyer and there are websites that detail this process step by step.

Lal Brandow, I feel the exact same way as you do. I have also been doing alot of reading and research and am getting more and more mad. It is so frustrating that we do everything right, yet have no control over what happens next and must just simply wait. It is even more frustrating to see all kinds of people getting approved without interviews, altough I am happy for them. Oh well, I guess we can only wait some more.

I called the USCIS mis-information line yesterday and was first told by a not very helpful officer, whom I don't think took the time to actually listen to my question, that it had not be more than 30 days since my processing time (as they are processing dates with a receipt of 04/05 and mine was received on 03/17), so there was nothing they could do. I then called back, on the insistance of my husband, and was this time told by another officer (who was a tad more helpful) that they are 'scripted' to tell people that there is nothing they can do unless it's been 6 months from your filing date or 4 months from your interview date. None of which of course is the case with me yet. She did say that my case has gone extremely fast so far and I would just have to be patient. And I know that is true, and that my case has gone so quickly, but it's still so frustrating to be so close, yet so far away.

Rebeccajo, how funny that you should refer to us as being in the "black-hole", because I just talked to my attorney today about this pending FBI name check and she also said that Immigration attorneys refer to people in our situation as being "black-holed". I had never heard the term in reference to this before now. She also confirmed that FBI name checks usually take a few months, but of course there are cases that take longer, such as someone having a common name, previous arrest, etc, or who knows what else.

Going back to a question asked on this thread about when the name check is actually initiated by USCIS. My biometrics were completed on 04/05/06 and I now remember our interviewing officer saying that it usually takes 2-3 months for the name check results to come back (at least in Buffalo). And then said something about it having been since 04/04/06 for mine, so maybe they'd be back in, but they were not. It would help a little I guess if we knew exactly when the name check is initiated. Also, I sent an email to Laura Bush on 06/08/06, but still have not heard anything yet, so hopefully we will soon.

Griffon76, I am Canadian and came over the exact same way. I came over simply for a 2 week vacation and a few months later, we decided to get married in Las Vegas. I applied for adjustment of status from here, we had my interview and everything went fine. As long as there was no intent to get married when the Canadian crossed over, than everything is fine. As well, I have not left the U.S. since I originally came here and will not leave until I receive my greencard. All the best of luck and I will be happy to answer any questions that you might have!
