    I don’t have tons of proof other than the usual joint bank accounts and stuff and my summer flying schedule is hectic so I don’t know if I can find time to attend biometric appointment. I’m not worry tho because we are a legit couple but I just worry about my employment with Delta.

    One other thing to think about in regards this issue other than what has been said, one to three months prior to expiration of letter you should make an infopass appt at your local USCIS office and get a I551 stamp in your passport. This will give you an additional extension. You would then just update the GE as was stated before with the new extension. Every office is different as to how soon before the expiration they will do the I551 stamp as I have read in other posts. Hope this helps.

    thats wrong, he come to NYC for the first time with her  together so I don't understand why they said that he has to has a separate I751.  It it come to sending a separate application and fee , i will do it but a think that the make a mistake and you all know that they some times do.  Thanks for ur time 

    Do an infopass appointment fast if you think there is error. The thing is to do it quickly either the infopass or the two applications. Good Luck.

    Hope the best for you guys. I think it is a matter of being thorogh and give lots of info. Our interview for 751 was interesting but I felt we did well, although my husband was a bit scared. I think it was the fact that she told him we would hear within 60 days that threw him. We heard in about a week. I guess that is just the usual phrase they spout.

    In the end I think it’s luck and who is ultimately reviewing your file.  

     

    I am curious to to see whether or not they interview us this time around, his green card was approved without one.

    Thanks for the info. I will search around a bit more nad see if I can correlate other responses about the N400/I751 issue and see where the numbers go. I agree about the luck comment. That and perhaps and good congresspersons office staff who get behind you in a long delay situation. I got an answer on our K-1 petition 1 week after I contacted my congress reps office. Found out it was sitting in a pile on someone's desk. But good results since. I 751 took about 8 months total.

  5. The journey begins again. We have filed our ROC again, Jun 2,  after the error that was found last year, Jul 2017, of an incorrect expiration date on the conditional green card. We start the waiting now and hope for something good and quick. But are also ready for the slow wait. Our I-90 is still pending since Aug 2017 to correct the bad dates. But moving forward regardless. 

  6. We sent ours this past Saturday, June 2. USPS says delivered Jun 4. Now wait for the NOA. And then wait and wait. I hear that filing N-400 at the 2yr, 9mo+ date can expedite the I-751. We are planning to try that also. Saw a post in a forum that someone got an approval on I-751 in 6 months post conditional green card expiration. So this is some hope for a faster time. But likewise the many post of long wait times are out there too. Perseverence is the name of the game.

    Yes. that is correct. After the status that NVC had sent to embassy, it was 1 - 1.5 months before we received the email. Hope all goes well, smooth and fast for you guys.

    Everyone I've talked to has ultimately said that filing the i90 is the correct way to fix this as it appears that you were eventually told, but by filing the i751 based on your incorect expiration date you seem to have forced USCIS to make some note on your file, which will hopefully protect you from having your status terminated while the i90 works through review. 

    In the timeline that I see ahead for my husband, I do not believe we will get the corrected GC before our corrected expiration date will force us to refile the I-751. The corrected date is in June 2018, so we will refile in March. According to the processing time site, the I-90 is taking about 10-11 months. So we do not expect to see the corrected card until Jul or Aug 2018 which is after it will have expired. Crazy!!!!! Keep us informed as your case progresses. Hope it goes well especially as it is their error not yours.

    I know of a girl who studied for one or more years in Germany and she had to get this certificate for herself. She found out at the interview. She was put on administrative hold while she got the remaining evidence for her visa request. So wherever your fiancè has lived for more than 6 months month since he turned 16 years of age he must have these documents. Also every state of Brazil that he has ever lived in for the same period, he must have the certificate from each one. Good luck.

    I do not know specifically about means test but the intial petition I-129f does not require income proof. It only asks your empoyment history. Income iproof s required at the visa interview in your fiancèe's country where you must submit an I-134 and the supporting documents for it. Then after the marriage when your fiancèe applies for AOS you will need to file with it an I-864 and its supporting documents. These are the times where you will be giving evidence of support regarding income.

     

    As to the medical, this link may help with your answers. In Brazil there is one female doctor of the four that are authorized to do the medical exam. So if that doctor is accessible to your fiancèe than she might feel more comfortable with that doctor. When you access this link use the drop box and choose Rio de Janeiro (RDJ) for the specific Brazil information.

    Finally, you can do any kind of ceremony you like as long as it does not result in a marriage, legal or religious. A commitment ceremony could just be considered a formal way of acknowledging you intent to marry or engagement, which is part of the K-1 visa process anyway.

    I will try to tell you what I can remember from my fiancè's process. We had our interview in July 2015. So after you receive your NOA2, your fileis transferred to the US Dept of State's National Visa Center where it is verified and then transferred to the proper consolate, Rio de Janeiro in your and our cases, for determination of visa issuance. Once Rio receives your file they will email you with instructions as to the next steps. I know that others in the past have received letters with this information but this is no longer the case now. These instrudtions include  how to setup your interview appointment, what documents to bring for the interview and links to fee scedules if  not the fee required. In our case, my fiance had to sign on the CASV site to register, fill out a DS 160, choose a date for the interview, and pay the fees. The appointment for the doctor is setup once you have this email because you need proof that you will be having an interview. There were only three approved doctors for the medical when we did our interview, one in Leblon, one in Belo Horizonte, and I think one in São Paulo but the last  I am not sure. But the email should have links for these locations as they may be different. You need to have certain immunizations done prior to the medical and these can be done for free at your local Posto de Saude. You can find the list of current required immunizations on the USCIS website. The medical doctor will tell you the other things you will need for the exam and where to go for them as these results are needed by the day of your medical appointment. For my fiancè it was an Xray and some bloodwork. We saw the doctor in Leblon. He sent us to specific places for these near to his office. Someone above in this thread says there is now urine required which they say takes five days to get the results. We made our medical on week prior to the interview to allow for enough time to haave the results and the doctor's report available at our visa interview. Other documents you need will be birth certificate, and police certificates, both state, any you have resided in within the past 5 years, and federal. You can start to get these now. The federal one is available online. Some states are online but some you must get in person. Read earlier post in this thread as someone got something online form the state but it was not form the correct state department. As regards to timing, It took about one month or maybe one month and a half to receive the email from the consulate. As to the schedule for the interview that is based on what is available once you sign on to the CASV website and register. Uou can do it as early or late as your life permits. Now regards the visa process after approval. We chose to receive the visa at the CASV in Rio de Janeiro as we were going to fly directly from there to the US but you can choose to have it mailed to your home. It took about 10 days for it to be ready for pickup at the CASV. I went to the interview with my fiancè. I actually met him in his hometown where we finished his immunizations then we traveled to Rio de Janeiro one week prior to the interview to do the medical. The medical was done the day we arrived in Rio that very afternoon which we had already previous made the appointment through the doctor's office. We got the X-ray first then came to the doctor's office to get the papers for the laboratory to do the bloodwork. The next day I think or two days later we came to see the doctor at his office for the exam but that may chage now due to the urine test someone says is now required. You will have to get this information when you call the doctor to make the appointment. I hope this helps you but continue to do your research online at USCIS and here so that you will be ready for everything that you will need. Boa sorte!!!!!

    Don't email or send a letter. Go straight to their local office and make contact directly. That's what I did with my K-1 petition when it had been more than 6 months waiting. Within a week of my representative making an inquiry as to our case, the petition was approved.

     

    As to your GC expiration date error, a similar thing happened to us. We were approved for the AOS in June 2016 but they issued the card based on POE date of Jul 2015. We noticed the date but did not realize the error. We asked others here about not having a 2 year period on the card and they thought that it would be OK. We did not ask USCIS. The difference in our case ns yours is that we did file the I-751 based on the incorrect date. Our file was returned with an explanation letter. It told us that our GC dates were in errror due to the USCIS and that they had corrected the status error and our expiration date would be in JUne 2018. they also informed us that we should file an I-90, replcement of GC, form which we have done but noticing the processing time on the website for this form it is taking almost 11 months to complete. Our problem was needing to travel outside the US. We found out that you could make an Infopass appt and request an ADIT also known as an I-551 stamp or passport stamp. This remedy worked for us as we just returned from Canada this past Friday without incidence. In our case, we fortunately still have the ability to file our I-751 at the appropriate corrected date prior to June 2018. It has been a bit frustrating but not so stressful as your case seems to be.

     

    I hope that you will be able to resolve this issue. It was the VSC that noticed the error for us. But as ours was noticed in regards to an I-751 submission, it just required us to wait a little longer to reapply for ROC. Good luck. Keep us informed.

    As above says, not approved, but yes, accepted. You have now started the process of ROC. Congrats!

    I think as you can see from Dawning's post above that it can take about a month to get the NOA1 letter but that they date it back to the date of receipt. She also says that she has heard that a denial does not put into jeapordy the 751 filing as they take into account the original filing with the fee waiver that has been denied. The only problem I can see is if there would be something wrong with the 751 petition and it was rejected because that would cause you to resubmit with a new receipt date which would be the NOA1 date. Hope that allays your worries. Good luck!

    Yes. The date they used was they day we entered on the K-1 visa which is a quasi immigrant visa but not. It requires an AOS so the date that should have been used was the AOS approval date. So a difference of July 2015 versus June 2016 which caused the required ROC to be 2017 rather than the proper 2018. Fortunately not a big deal as we do not have to pay the fee to get a corrected Conditional Green Card as it was an administrative error on the part of USCIS. We are applying for that now and the fee is $540. Thankfully we do not have to pay it. That would have made it unfair but in the overall situation we will be fine.
