Hey everyone!
Quick question, I have my N-400 interview on March 18th. My I-751 is still pending (Dec 2017 filer! with the June 12th 2018 update of “case was transferred and a new office has jurisdiction”. Do I need to let USCIS know I still have a pending I-751 or just assume my N400 interview will be a combined interview since it is still pending?
And one more question! Given that my interview is March 18th, will I be expected to bring my 2018 tax return. We have everything compiled and gave it to our accountant but he will not have filed yet by March 18. I have IRS transcripts from 2015-2017. Anyone foresee any issues with this?

Just an update.... I am a Yes for N-400 and my interview is schedule for 3/18/2019. Still no movement on my pending I-751. Last update was June 2018 (the case transfer update that nearly everyone received).

Hello,
I believe they just updated the underlying green card information. Since then I have had a few issues with using the nexus however. Going into Canada they told me it needed to be updated again, claiming that it had only been updated on the American end not the Canadian end while I was at the Fort Erie Nexus office. So I updated on my way out of Canada and had no problem going back into the US. Then the next time I went to Canada a few months later they once again said there was an error with the update and that I needed to go in again. That time I was at the Ivy Lea border crossing in the Thousand Islands where the Nexus office is not open very long hours and wasn’t able to stop in. The border agent once again let me in through the nexus line but made a fuss about the Fort Erie office not updating my card correctly. Since then I haven’t bothered trying to use it as I’m a bit sick of getting scolded at the border!!
Sorry I cant be more helpful, but from what the Nexus office workers told me you have to update it in person. And for some reason my issues only seem to be appearing when entering Canada not entering the United States.
Each time I went into the Nexus office the people were very nice, so I don’t expect them to yell at you. I think it’s more the actual crossing agents that get mad when you haven’t updated it.

Well, it appears I answered my own question. Straight from the N-400 instructions. Are you personally planning to file 3 months early? I live in Columbus and the field office here is pretty quick, someone I know filed last year and went from application to oath in about 4 months...
Early Filing. An applicant filing under the general naturalization provision (section 316(a) of the INA) may file his or her application up to 90 days before he or she would first meet the required 5-year period of continuous residence as a lawful permanent resident (LPR). An applicant filing as the spouse of a U.S. citizen under section 319(a) of the INA may file up to 90 days before meeting the required 3-year period of continuous residence as an LPR. Although an applicant may file early according to the 90-day early filing provision, the applicant is not eligible for naturalization until he or she has reached the required 3- or 5-year period of continuous residence as an LPR. Applicants filing up to 90 days before meeting the continuous residence requirement must still meet all other requirements for naturalization at the time of filing Form N-400. For example, an applicant filing under section 319(a) of the INA must meet all other requirements as the spouse of a U.S. citizen at the time of filing.

You can file up to 90 days before your three year anniversary (and having been married to the same USC spouse) and have one interview, one oath ceremony and the possibility of being done with the whole process by 2019.
But not everyone’s goal is US citizenship. I have heard that if you file within the 90 days early, the USCIS won’t touch the N-400 until after those 90 days; but I know they won’t touch my ROC either!!

I gotta say, I am looking forward to both! As a tip I would like to share, we will be submitting the Form 4506-T from the IRS to get our tax transcripts. I think submitting proof of tax transcripts is better evidence than showing the tax return because this verifies with the governmental agency of what they have on file. I think it's just a better level and I think with this level of scrutiny, it's best to strive for the best quality of evidence.
As a note, most people will be able to get tax transcripts online, but there are some cases, such as a fraud indicator (where the IRS sends you that six digit number each December to e-file your tax return) where you might not be able to get it. I say all that to say: Plan early and be ready!

Hey everyone,
Does anyone here have experience traveling with discount carriers such as WOW Airlines while on an extension letter? I have gone back and forth to Canada quite a few times on the extension letter but always by car or larger airlines such as Delta, Air Canada etc. I have heard so many horror stories about the customer service on WOW that I'm a bit concerned with using them to go to and from Europe while on an extension letter. I'm sure tons and tons of people have wonderful experiences on WOW, and I'm guessing they handle an extension letter as well as any other airline, but I thought I might as well ask if anyone else has any experience with them in this situation.

I stayed at the Marriot in the link above. Not as cheap as an air bnb would be, but I was also nervous about a last minute cancellation or something happening! It was literally a 2 minute walk to the consulate (right around the corner) and had parking available onsite for an extra fee.
There are TONS of other hotels in that area of Montreal as well, if you are feeling nervous about airbnb! And I'm sure there is a wide variety price wise.

I went through K-1 a while back, but my soon to be sister-in-law is in the process right now. She was given authorization to book her interview earlier this week, and when she logged on there was still a date or two in May as well as dates in June (I can't recall if it also showed July already since I know she picked a June date). Back when I booked mine in 2015 it showed dates up to 3 months out however that could have changed.
It is my understanding (when I did this process as well as now) that you are unable to check interview times until you receive authorization to schedule an interview (aka Packet 4 via email) from the consulate.

Hey everyone!
I am now able to answer my own question having been to Canada twice since my card expired at the end of February! The first time going into Canada the border officer just mentioned that I should not use the nexus card until I update my information as it does flag that the green card on file is expired. So I went to the nexus office at the land crossing (obviously not as easy for everyone to do unless you happen to be near one) and they easily updated my info in about 5 mins. Since then I have been through the nexus lane three additional times (by land only so far) and each time I got through with no problems. Just handed over my nexus, green card, and extension letter when pulling up to the booth!

From what I remember, yes, but I'm hoping someone with an actual tax background chimes in here haha. And since I had an accountant do mine I really can't remember exactly but I do recall the letter being important. My husband is actually a dual citizen of the US and Canada, so I did fill in his SIN number. However he is not a resident of Canada and made no income in Canada so I feel like I left the other parts blank.
One other thing to mention - and I failed to do this originally so it was a pain to deal with after.... I was supposed to call CRA as well when I moved and tell them that I no longer lived in Canada (not sure if you already did this). Basically I was still getting those GST/HST credits as well as Ontario Trillium benefits direct deposited into my Canadian bank account. I ended up paying them all back to the receiver general, and had to write them several letters before they finally stopped depositing them. CRA said it can be avoided if you call to tell them you are a non resident when you moved. So if you didn't do that, and you've been getting any sort of government benefits, you'll have to pay them back... they should stop coming after you file exit taxes though! I learned this the hard way haha.

From what I remember (I could be wrong - and unfortunately can't find this in my dropbox folder of tax doc's) it is the normal T1, however you just have to fill in the part about ceasing to become a Canadian resident (still a citizen but Canada taxes based on residency not citizenship). Filling in this part is what makes it considered "exit taxes", as well as attaching the letter I mentioned above (which my accountant requested I provide - not sure if it was truly necessary or not).

Yes! I recall my accountant asking me to write a letter that had my name, SIN, date of birth, date I became a non resident, new mailing address & physical address, dollar amt received from foreign sources in that tax year and dollar amt received from Canadian sources after the date I became a non resident (i.e. final paycheck from employer). I had to include this letter with the exit taxes.
One thing to keep in mind - and maybe @NikLR knows the answer, is that you will possibly need to file a Marital Status Change form, given that you were married in 2017.

It's been a little while since I did this, but I believe there is a little box you can check that says something about becoming a non resident and making this tax filing your "exit taxes". I can look in my tax records and see if I can find more info..
I also moved in November (2015) and had worked in Canada that year so similar situation.

I can't say with certainty this is the best way to do things - but it is how I did it, and I had no problems what so ever!
I filed AOS with my NEW married last name. I also went to the Social Security office with the marriage certificate and changed the name on my SSN card (keep in mind the new card of course still had the not valid for work without DHS authorization stamp on it). When I got the EAD/AP combo card with my NEW married name, I then went to get a drivers license (Ohio), in my new married name and also went back to the social security office to get a card without the "not valid for work" statement. Then finally after all that I decided to change my passport so that everything matched up! But I have seen many many people not change their passport right away and just carry around a certified copy of the marriage certificate or abstract when they travel since the green card will have married name but the passport will have maiden name.

All you need is the certified copy of the marriage certificate, which you will have to submit anyway with AOS
This is enough for them to produce the green card and EAD/AP combo in your married name.

@Roy&Chanel no updates really, still have not received a biometrics apt letter.
However, I did notice something odd today. I realized there is another website to check for case status: https://myaccount.uscis.dhs.gov/ which I had never gone to before. On it I found this bit saying that they received my case back in December (which is when I mailed it) but then another update saying they received my case in February 2018.
Meanwhile, the other website (uscis.gov case tracker) which I had been checking continues to say the bit about my case being received at my local office on March 5, 2018.
Not sure what is going on here but thought some people may find it interesting!

Not only that it hasn’t even been a year I was told that it could take at least that. Anyway, any help would be appreciated thank you!!
Same thing happened to me! Congratulations! I received my green card in the mail about a week after my EAD/AP NOA2, also without an interview. I was shocked as well, but it definitely does happen occasionally.

Yes, I have been thinking ahead to the I-864! I am more than willing to sponsor them for that (we are a close knit family and my husband and brother in law are in business together). However, my father in law (also soon to be her father in law) sponsored me back in 2015 since my husband also didn't have a strong history of tax returns at that time due to being a recent graduate, and he will do the same for her during her AOS. I would like to do I-134 for them just to make it easier, as my father in law is out of town on business quite frequently and I don't want to burden him right now with gathering the documents she will need for the interview.
That brings up another question - On his I-864 for my brother in laws finance, will my father in law need to list me as a dependant given that he filled out an I-864 for me back in 2015 (even though I am in no way actually dependant on him I'm guessing I still count as a legal dependant)? I guess I don't know when that rolls off, after citizenship maybe?

Had my combined I-751 / N-400 interview yesterday at the Columbus Ohio field office. I had a ton of documents with me and was not asked for anything other than they wanted to look at my green card. While my husband was in the waiting room I quickly did the reading/writing/Civics test then they asked me some questions regarding our life together (I.e. what kind of car do you drive? What color is it? What car does your husband drive? What color is it? Do you have any tattoos? Does he have any tattoos? Where do you work and what are your hours? Where does your husband work and what are his hours? How many bedrooms/bathrooms/TVs in your home? What is your address?). After I gave my answers they brought him in to have him answer the same questions. They did not ask to see any of the relationship evidence I had brought with me or any originals for items I sent copies of with either application. Went quickly and the interviewer was very nice! I was approved on the spot and my online portal updated today with “we have scheduled you for an oath ceremony”, the actual document hasn’t been uploaded yet so I’m not sure when it will be.
