  1. Hi Everyone,

     

    This situation is a bit confusing so I'll do my best to explain: I am a conditional permanent resident since 02/2016 (my removal of conditions application is currently pending at CSC). My husbands brother (US citizen) is engaged to a Canadian whom he met while attending University in Canada. Their I-129F application is currently pending and they are expecting their NOA2 any day now. Having gone through the K1 process myself, I have been helping them out along the way. Obviously my brother in law will be his fiancé's primary sponsor for the I-134 paperwork, however due to a number of reasons (job switch to commission based real estate/recent graduate) they think having a co-sponsor as a backup couldn't hurt. My husband also had a recent switch to a commission based job so his financials would look similar to his brothers. I, on the other hand, have had a regular W2 sufficient income for the 2 years since I received residency.

     

    Now for the question, am I allowed to be their co-sponsor given that I am a CONDITIONAL permanent resident? Right on the I-134 paperwork there is a section about sponsor's citizenship/residency status, in which one option is "I am a lawful permanent resident of the United States and my A number is _______". However, I'm wondering if being a conditional permanent resident would disallow me from being their co-sponsor? Worst case my brother in law could ask his parents, but I thought since I am familiar with what is needed for an I-134 I might be the easiest option.

     

    Any advice/personal experience stories will be much appreciated!

    Hey guys, I am back from my vacation, it was great! Updating the list right now, if anyone of you is not on the list and is a December filer, please do provide us these information: Filing Date that you mailed your package, NOA date on letter, NOA received by mail on hand, Biometrics Appointment Date. We are doing this so we can keep track with each other in case someone does not receive his documents and is on the same date as others.

     

    Here's what happen when I travel on an expired GC and extension letter. I took Qatar Airways via Doha. I have an almost less than 6 months expiring passport.

    Atlanta Airport Departure: No issues with checking in and departure

    Doha Departure: No issues

    Singapore Arrival: No issues

    Singapore Departure: During checking in, the employee of QA asked for my GC and tried to scan it into the system, I provided the extension letter too and she was unaware what that is, she had to ask her manager for assistance. It took about 15 minutes to settle the issue.

    Qatar Doha Transit: During my transiting, at boarding checkpoint, the staff asked for my GC and extension letter, she was unsure if it should be calculated from the card or from the letter, had to ask her manager. She marked on my boarding pass, and I been checked with my hand carry and luggage 3 times during the Boarding Checking in area. 

    Atlanta Airport Arrival: I went to the scan, it didn't work for me, so I headed to the booth, the CBP officer did not ask for my extension letter. We moved on to agriculture, declared our food stuffs and everything else was smooth. When we walked through the exit where dogs are at, two CPB officers stopped me and asked where I came from, I guess its because I carried 2 large boxes of food lol. And I said Singapore, they let me through without checks. I was thinking they were going to open up my food boxes cos I tie and taped them up with strings, didnt want to mess up lol.

    Overall experience, it seems like US Customs are clear of what the extension and expired GC works but the other countries and transiting don't.

    My dates are as follows: 

     

    I-751 Mailed on 12/08/2017

    NOA1 Date 12/14/2017

    NOA Received - actually not sure about this but I'll just say 12/20/2017 since I know it was the following week and definitely before the holiday. 

     

    I followed up via phone/email with CSC and got the same info as most people on this thread - that they are experiencing a longer processing period than what was originally reflected and that my name has been electronically added to the appointment scheduler. I am still not able to check my case number on the USCIS website either. 

  5. Hi Everyone,

     

    I'm aware traveling is fine with the green card extension letter while awaiting Removal of Conditions. My question is more specifically for Canadians who cross at land border crossings with the Nexus card. Can I still cross in the Nexus lane when coming back into the United States? I will obviously have my expired green card, green card extension letter, passport and Nexus card with me. Just wondering if people have experience with this/if I should expect to get pulled into secondary processing or what not.

    After calling several times and talk to customer service I have not got any useful information from them , so today I decided to request to talk to Tier2 and they transferred me with no issues. I've waited 36 mins and got the call back from an IO , he gave me a case number so I can check online and put in a request for Biometric Appointment.

     

    So my advice , I would call and do that as well.

    Yeah, that sounds strange.  I never heard that from anyone before.  I know my husband's GC was approved relatively fast from our AOS, but I haven't seen someone needing to go for a new biometrics.  Maybe read over some September/October 2016 ROC threads were CSC people may still be waiting.  Starting at the last page and reading backwards may show some people saying they were surprised at a GC being approved.

     

    On another note, someone in the Nov 2017 ROC filer thread found out they had a biometrics appointment scheduled, but didn't receive the letter.  We will call if no biometrics letter is received after Feb 5th (our NOA date is Dec 26th).

    Hi @Amhara,

    I am thinking about calling as well since my NOA1 is 12/14/2017 and I still have not received a Biometrics appointment. Are you planning to phone the (800) number listed at the bottom of the NOA1?

  8. Thanks everyone. Lots of good information. My parents are trying to rebook to another country, otherwise we will likely just bail out on the vacation and spend Christmas with them next year instead. We had lots of tours and educational activities booked so I guess "people to people" might still be an option for us but we would rather be safe than sorry!

  9. Hi Everyone, 

     

    I hope this post finds its way to anyone who has information on this topic. I am a Canadian citizen, I became a conditional permanent resident in February 2016 (based on a K-1). My husband is a dual citizen of the United States and Canada, he was born in Canada and became a citizen through his parents naturalization around age 16. My Canadian citizen parents have planned a Christmas trip to Cuba (flying Toronto -> Varadero). We had planned to join them and did not foresee any issues until the recent announcement of the return of travel restrictions. Given that we both hold Canadian passports, we can legally from Toronto on our Canadian passports regardless of how the rules for US citizens shake out in the coming months. However, I am wondering if this will in any way effect my removal of conditions or citizenship paperwork in the coming years. I am particularly concerned the citizenship paperwork as I know it asks for recent travel information and which countries you have visited. 

     

    I plan to reach out to an immigration attorney this week, however I just thought I would see if anyone has experience with this.

    Quick clarification:

    • My Canadian fiance lives in Vancouver, BC.
    •  I live in Seattle, Washington which is only a 2.5 hour drive away.

    We received our K1 Visa NOA1 in November 2016.  We took a trip to Las Vegas in December 2016 with our flight leaving Bellingham, Washington.  She had no problems driving across the border to the Bellingham, Washington airport while our petition was in NOA1 status.

     

    We recently received our K1 Visa NOA2 approval on February 7, 2017.  She has the first week of March 2017 off work and would like to visit me in Seattle again.

     

    Has any of the Canadian member forum have issue when visiting the US while their K1 Visa was under NOA2 status?

    Yes, your fiancé can continue to cross into the U.S. right up until her interview. As many people say, it is up to the discretion of the border agent that day however I think it is unusual to have any problems. I crossed the border probably 10-15 times between my NOA2 and interview date. It's important to have the ability to show ties to Canada in the form of bank statements, lease, letter from employer etc... however I was never asked for anything of the sort. I would also recommend not over packing, as anything more than a suitcase may make it seem as though she is already moving stuff across the border before an official approval. In the many times I crossed (whether it be a day trip unrelated to visiting my fiancé or spending two weeks visiting him) I was never once asked any questions related to my immigration status!

    I also had a difficult time receiving my SSN and I filed AOS without it, leaving the boxes blank. It caused no issues whatsoever. I think this is pretty common!

  12. I moved from Ontario to Ohio in November 2015. The Ohio BMV (Columbus specifically) gave me a really hard time transferring my Ontario G license. I ended up having to take a written and driving test to receive an Ohio drivers license. They also would not allow me to do so until I had an EAD card in hand because they essentially needed it as an expiry date for the license (but that was because I was on a K1). If you will have a green card in hand when you move you should be able to get the license right away but from my experience you will still need to take the written and driving test, both are quite simple anyways!

    This could be a very common question, but I couldn't find much about it, any help is appreciated!

    I recently received my EAD and Advance Parole card. Hoping to get back to Ontario for the week preceding Easter and thought it may be a good time to change my name on my Canadian passport since I can go into a passport office while I'm there. I spoke to the Canadian passport office and they said they recommend I drop off my application, then they can give me my old passport with the visa in it back on the spot and they will mail the new passport to me in Ohio. Apparently this will be done more quickly and cheaper than mailing the passport from the US. I also have a Nexus Card, so the US order services said this wouldn't create an issue returning to the USA.

    So my question for the VJ experts is: What do I do if my green card interview gets scheduled for sometime in the few weeks after I have dropped my new passport application off and am waiting for my new Canadian passport? Can I go to the interview with my current passport that contains the visa, even though it has been "cancelled" (hole punched basically) by Canadian authorities?

    Does anyone have experience with this?

    I can answer a few of your questions based on my conversations with my accountant in Canada and my husbands accountant in the US.

    Just like you, I had no income in the US in 2015 but did receive income in Canada in 2015.

    Our US accountant told my husband to file "married filing seperately" and said that I in fact do not need to file as I made no income here and wasn't yet a permanent resident in 2015. So unfortunately I can't answer your questions about your US taxes :(

    I am filing Canadian taxes as married filing seperately, and there is a spot on the form to mark which date you became a non resident of Canada (which is the day you entered the US on your K1 visa back in September). One thing I still need to double check with my Canadian accountant is whether this is on the regular tax form (I'm from Ontario, or if there is a special form for non residents). CRA website might be useful for this information.

    You should send a letter in with your Canadian taxes stating the day you moved to the US, any income earned in the US in 2015, any income earned from Canada after you left (ie. maybe a final paycheque that you received after you had moved).. you can just say 0$ for the income questions if thats the case!

    I also can't answer the questions about writing off the different expenses you mentioned. But maybe someone on here who has history as a personal accountant could help there!

    Hi everyone, I apologize in advance as I know there are many tax threads already. I've looked through the tax forum but decided to post here in the Canada specific board. I just wanted to ask/be sure of a few things.

    I usually do not do my own taxes so please bare with me as I basically know nothing. Lol. Big thanks to VJ for getting me this far...

    First, our info...

    My husband (US Citizen) is a self employed business owner

    I have made no US income in the year 2015 (have not started any employment yet)

    I entered the US on my K1 in September 2015

    We married September 2015

    I received my green card February 2016

    We are married filing jointly

    I worked in Canada January 2015 - June 2015
    Received no EI from Canada while not working
    I have a US SSN
    My Canadian income is below the 2555 income threshold

    My questions are:

    Can I still elect to be treated as a NRA for the year 2015 even though I did not receive my green card until 2016?

    Please confirm for me: I need an election statement to be considered as an NRA for 2015, form 1040 and form 2555. Is that correct?
    Do I need to include any other schedules with my US taxes?

    Do I include my Canadian T4 at all or is form 2555 sufficient information?

    Do I file my Canadian taxes as married filing separately? Non resident?
    I have no yet declared to the CRA that I am now a nonresident. Did I become a nonresident of Canada when I received my green card or when I entered the US on my K1?
    Can my husband claim any of our lawyer/visa fees? I have also been taking courses in order to work that he has paid for. Can he claim any of that?
    Can we claim any of my US health care payments?

  15. You need to call them about the GST credit. You will owe everything they paid you after the date you moved. Writing a letter will not work (I tried.)

    Did you work in the USA? or make over the threshold to file?

    I actually phoned CRA to discuss the GST credit with them. I failed to inform CRA I left Canada in November (my mistake), so I received a few credits in-between November and January. They actually requested that I write a formal letter with name, DOB, SIN, new phone number, new address, date I left Canada, and payments received. I also included a cheque for the amount my account had been credited from these payments since I had left the country.

    They have yet to cash the cheque, so I'm not sure exactly what else to do in this situation. I got passed around to a few different people on the phone so the whole situation was a bit confusing.

    Anyone else have experience with this?

    We didn't end up having any problem. I think they just automatically extended the expiry date. I ended up keeping my medical and interview after the original expiry date (interview was about 1.5 months later). When I got the visa in the mail it listed both the petition expiry date (from the NOA2) and the actual visa expiry date (6 months from the medical or whatever that rule is). The petition expiry date had been changed to be later than the original one we received.

    I'm wondering if anyone has actual experience about whether or not an SSN was required to obtain a marriage license in the state of Ohio? I have seen a number of threads but cannot find a definite answer.

    I am moving to Columbus on November 8th, and we have an appointment to be married at the courthouse two weeks later on November 23rd. I'm planning to apply for my SSN first thing in the morning on November 9th. Basically I'm hoping that in the event it doesn't get mailed quickly enough or something goes wrong that we can go through with the November 23rd appointment without me having a SSN.

    Anyone have experience with this in Ohio?
