I recently became a US citizen and need to file for my mom whom the consulate had denied Visa thrice for no reason. upon speaking to a lawyer whom I plan to use to help file. he said since my birth certificate is missing. Myself and my mom will have to take a DNA test and he advised we take it before applying so to reduce the chances of rejection which we'll still have to go back and take the test. I have a national population document and a court affidavit to prove my age but he said this will not fly with USCIS. Has anyone gone through similar circumstances and did you just go to any random medical laboratory to do the test? I'm in the US and my mum is in Nigeria. Please, advise.

    Did you resolve your issue?

But isn't that requested if a person isn't qualified to file taxes. In my moms case she earned more than $5 abroad. Isn't it supposed to be taxed?

Which category does your mom fall under in the IRS threshold for filing:

    https://www.irs.gov/newsroom/who-needs-to-file-a-tax-return

if she married and filing separately or if she is married filing together and reached the threshold than you have another issue on your hand.

  3. "Verification of Non-filing Letter - states that the IRS has no record of a processed Form 1040-series tax return as of the date of the request. It doesn't indicate whether you are required to file a return for that year. This letter is available after June 15 for the current tax year or anytime for the prior three tax years using Get Transcript Online or Form 4506-T. Use Form 4506-T if you need a letter for older tax years." - sounds like your mom needs to request that proof from the IRS  (https://www.irs.gov/individuals/transcript-types-and-ways-to-order-them).

IRS makes it really easy to obtain information from them online. You can obtain that letter and generate an additional note with your mom's signature stating why you weren't required to file a tax return.

  4. Hello everyone,

I am currently filling out the n400 for my spouse and we are at the question about overseas travel.

My permanent resident spouse lived with me on an overseas base for 4 years now.

Is the entire period considered overseas travel or just the period from the airport to the base. As far as I know, overseas us military bases are considered in-US resident locations for naturalization for spouse.

    Please help. Thank you.

  5. Like posters said earlier, looking at foundations is a good way of getting cheap wheelchairs and adaptive equipment. I believe most insurance companies allow the purchase of one wheelchair per 5/10 years (check with your insurance company). Make sure to get him sized and buy a foam or gel cushion for the seat. Once he is in school request an assessment for special needs (that will get a school based evaluation by a child psychologist, speech language pathologist, special education specialist, physical therapist, and occupational therapist). They will work together as a team to create a treatment plan and recommendations.

As a Occupational Therapist working in school based therapy, I know it not easy. There are a lot of federal and state laws in place to help children just like your's fiance's son (IDEA law, no child left behind, etc).

    Good luck and God bless.

  6. They asked your fiance a question and then went to the back room and came back with a picture from facebook which you guys had not provided voluntarily, I'm assuming? How did they find your facebook profiles? Am I understanding this correctly?

You can look up most people on facebook if they don't adjust their privacy settings. They have their names, phone numbers and more. No different from an employer looking up a interviewee being considered for a job.

  7. Yes he will be interviewed again. They want to make sure you guys are not married (I'm guessing you applied for a k-1 visa). Make sure to bring all those pictures from the traditional introduction because clearly they did a thorough investigation. They do know the Nigerian customs but you can explain it to them again that is just a traditional introduction.

Honest opinion: I am 100% certain it is a scam. Having spent a considerable amount of time in Nigeria has given me detailed understanding of how local Nigerians think. The story is overly complicated for no reason (Nigerians tend to believe that Americans are stupid). I have known people in Nigeria who claimed to be my friend and talked about coming to my hotel room and robbing me right in front of my face when they thought I didn't understand the native language.

As a husband myself, I would never involve my wife in something like this. I have known people who have gone to jail in the USA for these scams and they never involved their wife.

Be very careful and do not give your account. See if he is willing to let it go (a real man would) and continue to keep an eye on him. I hope I did not offend you and if I did I apologize.
