  1. Simon has his visa as of this morning!!! He is booked to fly out of London tomorrow and land in San Francisco at 2pm!!! He is a little anxious about POE since SF has been a pain in the past, but we are hoping for everything to be smooth!

    Not sure if this is correct but I recall reading somewhere that San Fran has a "new immigrants" line and is pretty organised for K1s... hoping I am right on this one! So pleased for you!

  2. Ok, so Josh already has a SSN. He worked two summers on J-1 visas. And has a SSN through that. Is that sufficient or will he need a new one?

    I'm currently insured under my family, as my mom worked for the state and is covered for life now. So until 26 or so I'm covered under her. But I do work full-time, so I can get insurance through my employer.

    I will go to my bank though and go over the mortgages and getting approved etc, and see if it is something I can swing on my own.

  3. Congrats! Wished I could be joining all of you guys that are booking flights!

    Still in TSC backlog, my company is laying people off and I'm now in a consultation period for redundancy, no idea if I have a job in 30 days or not. Just hope my noa2 comes soon (probably June), the amount of uncertainty is the worse out of all this.

  4. We had misfortune that my husband was laid off from his work 2 weeks after I came. His taxes for last three years show that he made well above poverty guidelines, but we had to tell them that he is not employed at the moment. He is doing freelancing, but there is no way we can prove how much he earns, so we tried to use assets. Hope we will not get RFE. Can you try the same thing?

    I'm sorry to hear this. Unfortunately, as we both just graduated, we don't have anything in the way of assets but he IS earning well over the poverty line now which is so frustrating. We will be using his mom as a co-sponsor (we are very fortunate that she is willing to do this).

  5. The way US Consulates and USCIS work will always remain a mystery...

    However, people in both cases you mentioned (1. didn't earn enough before but currently has a job with sufficient income AND 2. did earn enough before but currently doesn't have a job/doesn't earn enough) will likely get RFEs. USCIS wants to see continous and sufficent income. Since your husband didn't meet the 125% of the poverty guidelines to sponsor you not just in 2014 but in 2013 as well, they might not be convinced enough. Good luck!

    But they can also see that he was a full time college student during that time- not just some waster sitting around with a **** low paying job. This has been his first opportunity to get a proper job and therefore meet the requirements. I find them so frustrating and illogical.

    Whoever was on the phone was wrong. The 125% of the poverty guideline 2015 is $19,912 for 2 people in the household. http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf

    Your husband didn't meet the 125% of the poverty guideline in the most recent year (2014) so that is why you got the RFE. Current income matters, yes, but since he has his new job only since January 2015, USCIS wants to see a co-sponsor.

    Thank you both, I just don't understand why his income was approved during the interview stage if it's going to be an issue now. I was always told that current income is key. Surely this means someone who is now unemployed but earned enough in 2014 would be approved without issue? To me, this doesn't make sense.

    The above poster did call them and were told for two people it was $25,000 which makes no sense.

    You mentioned that you sent the 2013 tax papers as the most recent. Did your husband meet the 125% of the poverty guideline in tax year 2013? How about tax year 2014?

    If he is above the 125% of the guideline in tax year 2014 AND currently, then there is no need for a co-sponsor, you only need to send them the copy of the 2014 tax papers (or IRS Tax Return Transcript 2014).

    He didn't meet it in 2013 or 14 but he does now, since starting a new job in January.

  8. it all goes back to your household size that was placed on your i864 u counted someone twice thus getting a larger household size so need for greater income

    Nope ours was correct, it was 2.

    Have you tried calling them? I may call them tomorrow, not that i think it will make any difference xD Besides that, we're talking with someone who can be a joint sponsor, i hope she agrees...

    Yeah I might try that although it sounds like they aren't very helpful! I think his mom will joint sponsor me.

  9. Pheebs, i just looked at your thread and it looks like your RFE is almost exactly like ours. The first box say to submit the complete tax return for the last tax year, and the second that he doesn't meet the poverty guideline blah blah and to either show assets that make up for the difference (they don't mention how much is this "difference") or get a joint sponsor. I thought they need the complete return for 2014, cuz we send the one for 2013, but i was still confused how come he doesn't meet the 125% since he works 2 jobs. And we sent all supporting documents too. :angry:

    Gosh, what a pain! Not sure where to go from here :cry:
