so is a round trip required?
My wife came from Guatemala on K-1 last July one way ticket. No problems leaving Guatemala or arriving in the U.S. as you are handing them your K-1 packet when you arrive .

I'm not working in USA. I have a cr1 application processing at the moment. I live and work in the UK. She lives and works in USA. But she still needs to file as married.
I was just curious if the NVC wiki was either outdated or incorrect or whether I've missed something.
Nothing on WIKI is official. WIKI is a website that is created and maintained by users inputting what they know or think they know. NEVER rely on WIKI for ANYTHING. Always use travel.state.gov or USCIS websites for accurate information.

We are, but we were K-1, so the timelines are a bit different.
-
Although the departure is there, you can only see full records while in the U.S. Therefore , the latest departure will not show up when you log into cbp. from a foreign country. Do not worry, am sure it is there. If not, I still would not worry as my brother in law is missing one departure on his and was admitted with no problems when he came to our wedding last summer.

My AOS case went from "new card is being produced" to "your case has been approved" does this mean I won't be having an interview?
Congratulations, same as we got. Keep logging in. You will get a status of Postal service picked up with a tracking number. Didn't take but a week total I believe until card was received.

When my wife came to the U.S. prior to the approval of our K-1, she came on a visitor visa. She gave them the date of her flight back which they listed on her I-94. She changed her flight to stay longer. The original return flight date was on her I-94 as a red flag until she departed the U.S. Once she departed (less than six month stay, so no overstay) The red flag disappeared and her I-94 then became current. When she returned on the K-1, the I-94 showed her previous arrival and departure with no negative marks on it.

thank you for your reply The documents that needed to be signed by the foreign fiance did you have them faxed to you or sent via email? Seems like a lot of time and money to do that just to get sent back to the place where the interview will be.
-
Typically if using USPS tracked mail you're going to send the packet to the first address above. The documents the foreign fiancé sends that need to go in the packet such as their G325A and the intent to marry letter should be the original wet signature on them. No photocopies. Some have had success with a photocopy, but I think most just sent the original to the petitioner via mail. Remember this application is going to the USCIS first, if it is approved they will forward the application eventually to the location of the embassy where the fiancé has their interview.
Just seems like a lot of money and wait til to just send it back but guess it doesnt need to make sense. Where did you find out that information? In the guides here?

Hi everyone,
So I know that it takes quite a few months to get a green card after you file for change of status (after getting married in the USA after fiance enters on the K1), but I'm curious about how long it would be before you can work? I've heard that when you apply for the green card you can include an employment authorization (EAD) so that you work while you are waiting for the GC. I'm confused about how this works, how long it takes and if you get some sort of card or authorization through filing the EAD? If anyone can enlighten me it would be super helpful.
Also on a completely different tangent - I'm just about to send off the K-1 package! I want to make sure that I make no mistakes, so if you all could tell me if I have the correct address to send the package to it would be really helpful. The address I have is:
United States Department of Homeland Security
U.S. Citizenship and Immigration Services
USCIS
P.O. Box 660151
Dallas, TX 75266
Is this correct? And is this the right address no matter where I live in the USA (I'm from NC)?
Thanks so much!

That address is correct if you are sending standard mail
Utilize that site for proper information. Utilize visa journey for advice. EAD/AP can take quite a while or be processed quickly. We were lucky that we were chosen to bypass EAD and AP and get the green card just about two months after filing AOS.

My fiance went for an interview today which took place in Ankara, Turkey. After the interview, he was given a document stating he will be sent to AP, code 221G (told him it would take few days until they send him an email with instructions to send him passport along with that document) . He was not told that he needed to send any additional paperwork. His status is sensitive, since he is in military. Muslim country. Specialized training in military for an officer as well. But has a clean record of course. I am worried he might get denied completely becouse he is in military. How long does this AP usually takes, please give me any responses, I am 9 months pregnant and was really hoping he would be here before I deliver ((((( They gave him his passport back, but they said he would need to send it in along with the letter they provided.. Any answer greatly appreacited !!
It really depends on what the additional document is they need from him. They will send the email and it will detail what he needs to do. Do not get too stressed until you find out what they are looking for. 221g is administrative processing. Often times it is for a missing or incomplete document that was required.

Especially after being stuck in the TSC backlog for long...I'm back to my daily routine of waking up and immediately checking my case status to see if anything has changed, and then being disappointed to see the same old status update.
BUT...I'm grateful that I at least get to be with my spouse during this waiting period, and happy that some other TSC survivors have gotten their approvals.
Hello to another Massachusetts VJer...We also were stuck in TSC 221 days.........We feel that pain !!!

The UNITED STATES COURT OF APPEALS FOR THE NINTH CIRCUIT theld that a K visa recipients that good marriage in good faith and the relationship ended in divorce prior to the adjudication of the adjustment application are still entitled to adjust to resident status. See the case of Choin vs. Mukasey, No.s 07-70941 and 06-75823 (9th Cir.) and see Matter of Alfred Kebbie SESAY as well.

Looks like a gray area to me. Both of those cases were for marriages of more than two years. One in which the case was mishandled and left in limbo for an extensive amount of time. The second was because they were married more than two years when the AOS was filed. It was denied due to misinterpretation of the statutes. The OP was not married for more than two years, so I wonder if someone can find cases of shorter term marriages.

Go anyway. Better to go and get put into administrative processing for RFE than to delay. Once the interview is done, then you only have to submit the additional information once it is obtained.

So sad to hear so many still waiting. Coronavirus really messed up a lot of immigration. Interview and approval was February 2020. Oath scheduled March 2020 but canceled due to Covid. Moved from NH to MA in March. Oath ceremony was June 11,2020 at Lawrence , MA field office. Wishing everyone the best possible outcome. The past year has certainly not been at all what any of us could have envisioned.
