    I love how everybody says that "helping with the baby" is considered work.. I guess I need to start asking for money every time I do something nice about my brother/sister etc..
    Imagine your family comes over and they are not allowed to freaken touch the baby or change its diaper cause its considered work.. that just sounds crazy to me. It's like going over to your sister for dinner and helping with the dishes.. its not work.. work is doing something for profit..
    from what i've seen on lawyer websites etc "volunteering" is allowed on a tourist visa.. I would consider this volunteering and not "work" ..
    helping without profit = volunteering = not work on a tourist visa = legal.

    To be fair, not all insurance is created equal. My wife and I would not even consider having a baby on the insurance at my old job. Even with good insurance it's still expensive considering most insurances have large deductibles that must be met before they even cover a dime.
    Got to love paying out the "A" to an insurance company for the privilige of paying out of pocket several thousand before they even pay a dime!

    C'mon people, things happen! Give the guy a break. He said his wife was pregnant and about to give birth. Imagine giving birth in the US if you have no support system. Not fun. Plus flying is not medically advisable in the late stages, many airlines won't even let her on board. In my view, it is a perfectly valid reason for wishing to enter later.
    I was in this situation, and this is exactly what my wife and I decided to do - abandon the previous petition and give birth in Canada. The first few months of a baby's life aren't the best time for moving across the world either.
    Why apply? Duh. You apply in advance, and sometimes things happen in the meantime. Like pregnancy, for example.
    Let's think how we can help him manage the situation.

    If your wife entered the US when you both were married for less than 2 years then she would have been issued a 2 year green card. In this case, you will need to file to remove the conditions: http://www.visajourney.com/content/751guide
    During this process, you need to provide evidence of your bona fide marriage and possibly attend an interview. If the ROC is approved, she will receive a 10 year green card.
    She can still apply for citizenship in 3 years but, you must file the ROC application within the last 90 days of the green card expiration (before it expires).

    I'd think USCIS would be a little confused (they're not always the brightest sparks) because A6 means you need to pay the fee (and the EAD is only valid while the I-94 is) and C9 you don't pay the fee and it's valid for 1 year... but I would HOPE they would realise you meant C9. Worst case scenario they'll send it back for you to fix but that's not the end of the world. I would think you'd have heard relatively quickly while they checked the forms for appropriate payment etc so I'd say you're in the clear.

    I feel like they have some kind of translators ready. Obviously not for every single language, but maybe the big ones? I've been through ATL and heard someone call for an Arabic translator. Obviously they deal with non English speakers every day. They must have some way to handle it.

    My fiancé got call from American Express today for him to pick up the visa they must be definitely printing visas so if you're waiting for visa, stay positive! It won't be much longer

    I thought the problem was with issuing visas. They should be able to still work on cases that are pending in AP and get them as much complete as possible. Of course this is just what I tell myself. Who knows what they are really doing :/

    I don't think he got the papers back. I didn't think to ask him about it. I know they kept his passport. I'm pretty sure they kept his birth certificate. I was thinking maybe they will send it back to him with the passport?

    Several times. I also got my senator to email them but they only said that the case is in AP and that they have no idea when it will be completed.
    The wait is killing me.

    Yeah my fiancé was just worried about getting a job there. We thought it might be easier for me to get a job first and then he can get there and look for job. Well I'm American Muslim revert. Nobody else in my family is Muslim. I've never been married before. No kids or anything like that. Same for my fiancé. He's from Pakistan. Never married no kids. Just the two of us.

    And where do you think your wife's immigrant case will be processed? Sorry to tell you brother but Immigrant visas are not processed in Karachi. She will have to travel to Islamabad for the interview.

    if you get processed at TSC don't expect the whole process in 4-6 months. You'll be lucky to get petition approved by then. The only thing you need to prove is that you are both free and able to marry. You both are adults so you shouldn't need any parental consent. If you want to add it though then you can add it with your proof of relationship. It wouldn't hurt for the consular to read a letter from parents saying they approve the relationship. Not an absolute requirement though.
    I also would add for you to just make sure both of you are prepared for this. It is not an easy process. Best of luck!

    Are you sure about that? Because I think some states still require a blood test when you are applying for marriage license and most will at least ask are you related. They do not like first cousins getting married. It's very much against the social norm. But they will not say anything to people who are first cousins and got married in another country.

    Oh no :/ that's too long. I was thinking that AP they do after approval and AP because of getting a paper are two different things. It's both the same though? This part is what kinda is confusing to me. I wish they would give us more information about what's happening and how long it should take. My fiancé has only been in AP for less than two weeks but I'm already thinking what if it takes a long time? What if he's there for months or years? It's stressing me out.

    Yeahhh finally actually what happened is we kept waiting and waiting and didn't hear from embassy. We even filled out that online information request form. Nothing. But thank God I had sent in a request with my senator to get information on my case. It was before NOA2 and after I got that I kinda forgot about it. But I it this letter last week and called him to let him know what was happening. He contacted the embassy and they sent him an email saying that theh emailed me back when they received the case. But the problem was they wrote my email address incorrectly and I didn't get the email. So they forwarded the email to the senator who forwarded it to me and finally I have it so fingers crossed they will send you the email and you'll get it on time. I would defo say though that if it's been about a week or so since the status says "ready" then go ahead and think about sending the documents in.
    Here is what I got in the email
    K1/K3 Instruction Packet 3.5 Electronic Version
    Dear Applicant,
    We are pleased to inform you that we have received your K1/K3 visa file. The next step is to gather together your documents and send them by courier to the Immigrant Visa Unit. Please follow the instructions below:
    1. Electronic Visa Application Forms
    Please complete the DS-160 electronic visa application form - https://ceac.state.gov/genniv/. After the form has been submitted, you will be able to print out a confirmation page showing your photo and a barcode. This confirmation page must be submitted to the Immigrant Visa Unit prior to your interview.
    2. Civil Documents
    The following civil documents are required. Please note that you will need to submit an English translation for all documents. You must also submit one photocopy of each original document.
    · Original birth certificates with English translation and one photocopy.
    · Marriage certificate for any current or prior marriages, along with Urdu nika namas, if applicable. Include English translations and one set of photocopies.
    · Divorce/death certificates for any prior spouses, if applicable. Include English translations and one set of photocopies.
    · Police certificate(s) from any country where you are currently living or have lived for more than one year after the age of 16 (not required for time spent in the U.S., Pakistan, Afghanistan or India). Include English translations and one set of photocopies.
    · 2 visa photos against a white background, measuring 2x2 inches. Please note that photos must be natural and not edited. We highly recommend that all applicants review our photo guidelines to make sure the photos are correct before submitting them to the Immigrant Visa Unit. Please right click here and select open hyperlink for more information on photos.
    · Copies of the first 2 pages of each applicants passport. It is particularly important that we have a photocopy of any pages listing your personal information (name, date of birth, place of birth) and showing your photo. Please do not mail your passport to the Immigrant Visa Unit, instead, bring it with you to the interview.
    3. Affidavit of Support
    All K1 and K3 visa applicants must submit an Affidavit of Support (form I-134) along with the petitioners latest U.S. income federal tax returns. If the petitioner is unemployed or has a low income, the applicant should find an additional joint sponsor (form I-864) who will be willing to complete an I-864 Affidavit of Support. The joint sponsor will also need to submit proof of their U.S. residency status (such as a copy of their U.S. passport, naturalization certificate or green card) and their most recent federal income tax returns. The I-134 and I-864 forms can be downloaded from the USCIS website at www.uscis.gov.
    4. Sending Your Documents to the Consulate
    Once you have gathered together all the above-mentioned documents, including your DS-160 confirmation page printout please send them to the Immigrant Visa Unit by courier service. The location of our official couriers throughout Pakistan can be found at the following website: http://islamabad.usembassy.gov/courier_services.html. Applicants living outside Pakistan should submit their documents through any reliable courier service such as Federal Express, DHL, UPS, etc. to: Attention: Consular/Immigrant Visa Unit, U.S. Embassy, Diplomatic Enclave, Ramna 5, Islamabad, Pakistan.
    After the documents are received at the Immigrant Visa Unit, we will review the file. If all the required items have been submitted, we will schedule you for a visa interview at the U.S. Embassy in Islamabad and send you an appointment letter. You will then need to use the appointment letter to schedule a medical examination appointment at one of our designated panel physicians.
    5. Medical Examination Report
    Once you have received an appointment letter from the Immigrant Visa Unit, please schedule an appointment with one of the Embassys designated panel physicians for a mandatory medical examination. All individuals immigrating to the U.S. must have a medical examination, regardless of age. The list of panel physicians and information about the examination process are available in the attached MS Word document. Please do not open the envelope. You do NOT need to bring your chest X-rays to the Embassy.
