Well: good news!
yeahhhh!
yesterday was the USCIS interview.
oat right hand up (Im still having problems deciding wich one was my right one!)
formal questions were we live and date of born etc etc
and question for my lawyer: why they are here again?
Lawyer explain the 6 month rule of no marriage in wisconsin and she turn to me and read all the questions about national security like if I have some gun training or affiliated to any dark institution and then she said.
Due that was a technicalism I dont see nothing that will interfere in the desition wait for 6 to 8 week for an answer.
Uscis page was showing card production when we arrive home ...
Happy !
My lesson of all of that ..after almost 10000 dolars in lawyers get the right one that is familiar with the rules in your state.
Check the rules of marriage of your state first and even you divorce in other country in the world, they will stop to get your papers.
Hard way to learn the lesson but here we are ...happy couple that all this process make Us more strong and attach to each other.
Crazy in love !
good luck for the ones still waiting...now one year and 9 month to ROC! ....(and rock!)

congrats!

If you do all the job trying to deport your wife, and it came later you were treating her, if came out that she was looking for someone else because you beat her, or you have a jelousy problem and act like a control freak person. This will be a declaration of war.
She will probe abuse of your side and you will lost what you look for , the son custody forever.
A kid need both parents. all this obsession means you still hurt or care for her. Think IF in the future its what you want. because maybe reasons to stop to love someone can be any. or just none.
There is a lot of divorced couples that share the love for the son and thats it. They help each other and the kid grows knowing he has the inconditional love of both.
In Spain there is a legal figure that its call alienating the kid and is penalized by law. When a parent try to influence the kid to think the mom or the dad were BAD and thats why they dont have any more contact.
1 calm down and breathe
2 think whats best for your kid

I hired 2 lawyers because the first one make all wrong.
She gave us bad advice and my paperwork instead to be done in 4 month as most, it took a year and 10 000 dollars to fix her mistakes.
My advise is get a good one that knows the rules and regulations in the state you are at if you dont feel confident doing it by yourself.
But (and this is my personal opinion) we could do everything by ourself
Visa Journey is a wonderful source of information and tutorials, and believe me, reading the posts here I have learn my first lawyer was cheating.
-
Seems nobody is seeing the point of view of the wife.
She is doing everything she can to be in USA with the child/ and work in her field.
About cheating: well nobody wants that in their life but if the husband is checking her computer seems he is a controller and who knows why she was looking for someone else to be with.
Focus in the child that need mom and dad. A deportation will came back and bite you right in your neck. If Im your son and I found you make my mom deported and have a horrible life just because you want to revenge I will hate you with all my heart.
Maybe you win now, but believe me: in the future you will regret taking this decision.

It is not typical for them to stamp your passport at the end of your AOS interview. If you are approved, you may let them know your reason for needing to travel right away and they may or may not allow you a temporary stamp. If they do not allow it, you will need to wait for your green card to arrive in the mail.
Did you try requesting an expedite of your AP or taking proof of your mother's hospitalization/surgery to your local USCIS office to ask for emergency AP?
No I didnt. Tomorrow at 3PM is her surgery and I know I never will arrive on time. And all the communication with my sister has been by phone or skype..I have no fax or cable to show..they just call me by phone. I didnt want to delay or jeopardize my AOS interview on 20 that will be 90 day from my application ...
Thank you for your answer
-
Yes, my Interview Official denied to stamp my passport even I was approved at the spot. He said stamp was not accurate showing my status and could cause headache with mixup.
And if he didnt stamp it what did you do?
-
Sorry I dont know it that post fits here but Im looking to know if in the interview of AOS I will have, they will stamp my passport and Im free to leave the country. Is in the same appoiment or you should need to wait something by post?
The surgery of my mom is in 2 days and I know I will not arrive even asking for the AP but I do need/want to be there as soon as I can.
I do appreciate any answer from anyone that have had experience it.
Than you all

765.24 Removal of impediments to subsequent marriage. If a person during the lifetime of a husband or wife with whom the marriage is in force, enters into a subsequent marriage contract in accordance with s. 765.16, and the parties thereto live together thereafter as husband and wife, and such subsequent marriage contract was entered into by one of the parties in good faith, in the full belief that the former husband or wife was dead, or that the former marriage had been annulled, or dissolved by a divorce, or without knowledge of such former marriage, they shall, after the impediment to their marriage has been removed by the death or divorce of the other party to such former marriage, if they continue to live together as husband and wife in good faith on the part of one of them, be held to have been legally married from and after the removal of such impediment and the issue of such subsequent marriage shall be considered as the marital issue of both parents.A 2nd marriage entered into while the plaintiff was already married will not be annulled when the plaintiff did not live with the 2nd husband after the first husband died. Smith v. Smith, 52 Wis. 2d 262, 190 N.W.2d 174 (1971).Public policy favors upholding a marriage attacked as void by a 3rd party as well as by a party to a marriage. Corning v. Carriers Insurance Co. 88 Wis. 2d 17, 276 N.W.2d 310 (Ct. App. 1979).The equitable doctrine of "clean hands" precluded the defendant from obtaining an annulment of a marriage to the plaintiff. A voidable marriage became valid upon the removal of the impediment to the marriage. Halker v. Halker, 92 Wis. 2d 645, 285 N.W.2d 745 (1979).A husband was estopped from challenging the validity of his wife's divorce from her first husband. Schlinder v. Schlinder, 107 Wis. 2d 695, 321 N.W.2d 343 (Ct. App. 1982).

today I receive the letter of denial
-
someone received a letter that said we are reoppened your case?
Its on internet on my USCIS case state but the letter didnt arrive yet and Im wondering if anybody has received one of those and why
so nervous! ...I know its a waste of my time feeling like everything is pending ....out of my control
-
Pffffff....you dont know nothing about that process. How stressfully has been for me and still is. Im in wisconsin and Im passing reallly hard times here...
Believe me you sound like a child doing child things.
I just will ask you something: do you know why he divorced? ...the 90 days they give to you to married when you arrive try to find the friends and know better the person you will marry.
Seems to me that you dont know him enough to trust him to depend on him for this little period of life that is the visa process.
Believe me it feels like years and its really hard.
There is a lot of "marriages that went wrong" so please be carefully and choose the right guy. If you dont trust on him .....better dont do nothing.
now small stuff:
you can have the drivers license if you apply in the 3 first month. but you has to be quick to have something that shows your address n wisconsin like a electric bill or bank ...I did it.
Cars? pfffff you can find a really cheap one and believe me really really cheap ones .
the working permit: takes a media of 90 days.
so everything you have moan here its ridiculous. ...work without permit? thats just the most "irresposable and selfish thing I ever heard. and if your job in argentina is so good...just keep working, save some money and 3 month living in his place at not cost will give you the peace of mind to expend all your money in a car insurance and inmigration papers. ...

they are coincident that has to be something simple ...each one want to charge forst for do the learning curve with my case. Pffff...
just was with the hope someone else here has to pass by the same so we can offer answers to next generation ....
-
