We had our IR1 interview a week ago and we brought our joint sponsor's 1-864 with us incase my husband's US job offer letter wasn't sufficient financial proof. Because our joint sponsor filed taxes with his wife, we also brought an 1-864a with us that she filled out. The lady looking through our documents didn't see the I-864a and said that we needed our joint sponsors W2's or the I-864a.
I think it's better to be over prepared for whatever they might look for, rather than risk delaying getting the visa.
viol8tor, my husband's Irish job is also continuing here, but he also went from a full time employee to a consultant role with a set retainer fee. We didn't include that financial info in our own Affidavit of Support as he hadn't the details of it finalised, but if we had we would most certainly have brought it with it - and the joint sponsor info too, then just let the CO decide.

Exactly as above, you need to fully understand what the reasoning for denial was.
Did she answer questions hesitantly, or incorrectly? What documents were missing?
Without more specific knowledge on the case or reasons for denial just trying to get married and file a CR-1 could just cost more time and money for the same result.

Unless the underlying cause for denial is addressed, a spousal visa attempt will likely have the same result. What was the cause for denial?

Jesus Christ, what's up with some USC spouses thinking they can put their "real doll" foreign spouses back on a plane when things don't work out! Bringing them to the US might have been your doing, putting on a plane back home is not.

Sorry, there is no returns policy when marrying a foreign national.
Relationships breakdown, so divorce and move on.
On a personal note I find it sad that so many people think they can apparently treat a foreign spouse differently to a US spouse and return them "home" like a defective appliance.

At one stage you loved this woman enough to go through the immigration process to get her here and marry her. Why not just sit down with her and explain that you can't continue in the relationship and what does SHE want to do for HER future? If you can part amicably you can bypass a lot of nastiness during and after the divorce. Someone who isn't constantly fighting you isn't going to be making life difficult for you either (don't forget that you are on the hook for any benefits she claims between now and 40 quarters or citizenship).
Are there reasons she doesn't want to return? Does she have a fear of being cut off from her family if you two get divorced? Is she scared to go home because she fears that she will be shamed and unmarriageable in her home country, rather than not wanting to? When you are angry with someone in a relationship the truth seldom comes out. People don't always express what they want when they feel powerless.
Please remember that this is not HER home country. She's a long way from home and probably doesn't have many friends, much less confidantes. No matter what has happened between you, put yourself in her shoes before you treat her too unkindly. Relationships break down, they are seldom one-way disasters.

Harpa...I'm not sure that anyone was providing misinformation...someone just posted what is on the I-864 form with regard to the Petitioner's responsibility. Everyone here does agree that the husband should take responsibility for his actions, as a man and a human being, and not leave his estranged wife and her child stranded - after all, he is the one who decided that he doesn't want the marriage to continue. Divorce costs money and settlements take time. She's relatively new to the US...and it will take time to find a job. And, she has a 6 yo to support. While I usually respect your comments as being on-target, straight-forward and to the point...in this instance...hmmmm....

Well at this point the USCIS is making the DMV look good! So my assumption is that I shouldn't hope for anything less than an 8 month total processing time. My poor fiance is starting to lose home and I'll have to go for a 5th time, just so she knows I'm still interested and working on everything as hard as I can. She doesn't really realize how this whole thing works because of the language barrier.

Hi,
It is dumb if you want him here earlier. ? (Joking with ya using your own words.)
By getting marrried, you disqualify him for a K-1 fiance visa. You would have to start all over with a spousal visa and get to the back of the line. This will only make it longer for him to get to the US.
You would actually lengthen his time in Bulgaria by abandoning the K-1.
The K-1 is the quickest way.
Be strong. You can endure the wait.

Obama writing the laws has nothing to do with how USCIS chooses to handle these cases. It is all about prioritizing and management. If USCIS handle each case in the order in which they are received, we will all have our loved ones here eventually. Fussing and ranting is not going to make anything better. Blaming the President is not going to help either.
