I don't know why it seems weird that a person only authorized to be in this country until September, who has $0 income would not be offered credit.
It is unlikely my income will go much higher. Everything goes into the business. Can you use household income at all for applying for credit?
-
Everything seems limited by my EAD, I'm a K-1 AoS applicant. Got a NPIW right now.
My EAD expires in September, so does my driving licence and when I try to apply for credit I've been told AmEx won't accept non permanent residency and credit unions have told me they won't give me credit longer than my EAD validity.
I got added as an authorized user on my wife's credit card and it bumped my FICO (experian) score to 770s.
Anyone know any banks who give credit longer than EAD? And with that score can I apply? My income is $0 and I'm self employed, can I use household income when applying?
Seems weird to me.

You've registered with the Selective Service System (SSS)?

And how would one find such specific advice in VJ? Perhaps it is buried in here somewhere but who knows.
If you click the Guides thing on the navigation bar, and then look on that page and then on the top of the right hand of the page click Adjustment of Status Guide (K1 & K3 Visa Holders) you probably will see the guide.
I think the issue you have here is that you filed for EAD while on the K-1 visa, since it would only be valid til the end of the 90 days. The EAD takes about 60-90 days to process so that wouldn't really be any use.
Once married you can apply for the EAD and it will also take 60-90 days to process and should be valid for 1 year.
You can apply for the EAD without paying anything due to the pending I-485 (just include a copy of the NOA1 in your application).
It may help to include a cover letter explaining your situation clearly and that should then be seen by the guys actually processing things rather than the people on the phone who only know what they see on the system.
I used the guide I linked above and have had no problems thus far. I am also unfortunately in the NPIW (Potential Interview Waiver) group. But maybe because of the confusion with your application you might get an interview and then you will get your green card a long time before me. If you get a NPIW then it says it takes 6-9 months from the date of the letter.

Counting days doesn't really matter if you were a bonafide resident of the UK. Do you have a UK passport? Then you were a resident and authorized to live and work in the UK.
You have to understand this foreign income exclusion tax law is written more for Americans who work abroad. They have to qualify as resident in that foreign country with a visa or some kind of permission from the UK government for example. Or they had to have been there a LOT of days to qualify on presence. All that day counting is to make sure the American qualifies. If you were a citizen of that foreign country, then you qualify as a bonafide resident.
It is either/or. You don't have to meet both tests. Go with being a full fledged citizen (resident) of the UK as why you qualify to exclude your UK income.
That's great. I just did it. Although for some reason the tax refund is slightly lower than when I didn't have any foreign income entered on TurboTax. Oh well...
Do you know if I can get moving expenses paid for as I shut down my UK business (before move) and started my USA business (after move)? https://turbotax.intuit.com/tax-tools/tax-tips/General-Tax-Tips/IRS-Moving-Expense-Deductions/INF14389.html

Nowhere. it only talks about "period of authorized stay" if I am not mistaken, which doesn't anybody a legal resident.
Why do you expect to have the same "perks" ? That would make absolutely no sense, what if your AOS is denied ?
I mean, like for example the K-1 is authorized to study any number of high education hours. But AoS doesn't say anything, just says we can stay while pending I believe.
Does that mean we can't study when the K-1 expires? Or does the pending AoS continue the perks (education) that K-1 allowed (or the previous visa before adjustment of status allowed)?
If I get denied AoS that would be terrible, would have to shut down my business and ask my wife to return to the UK with me which she can't do because I don't have a job there. So I would need to leave my wife and kids behind and return, find a job and apply for a visa to bring them over. That would suck big time, especially with the recent UK immigration changes over the last couple of years.
-
That takes care of everyone with a current visa.
What about a person with an expired K1? What authorizes that person to study?
Does anyone know if/where the AoS (I-485) says we have the same perks as the visa we had when we applied?
-
You have to disclose all foreign earnings.

To those insisting that the college is wrong for not enrolling a person who is here on a non-immigrant visa with a pending AOS have the "right" to attend college, please provide a cite.
I'm also interested. I've noticed a couple of university mention it on their website.
-
They are wrong, you can study while adjusting status. Show them all those documents which are listed in the links you shared here. Show them copy of your I 94, your visa (Fiance visa K1), your passport, etc. They stupidly think you don't have status (probably) but you do. Just keep pushing, ask to speak to the supervisor if the people are being thick headed.
Explain to them that you are pending green card application and employment authorization, that you entered the country with a fiance visa, so you are NOT out of status and you DO have the right to be enrolled in classes, full time.
Does this community college have a website? Maybe it says something on there?
The website doesn't say anything. And the supervisor is the one telling me all of this. I told her all of that. And still the same result.

I've applied for a community college and they have told me I cannot study without a proper student visa. I have told them about my pending i-485 and my EAD and the International Student Services have put a hold on my account since I don't have the visa they want.
Every time I call them they keep asking for my I-94 and my passport and proper visa. I keep telling them I am able to study because of my pending I-485 and EAD, I even told them about my NOA1 and they told me I was wrong.
The worst thing is a university in Ohio accepts the NOA1 (I-797C) and even removed their international student services fee. They also accept me to in-state tuition. I can't keep doing classes there as a guest student, because I've maxed out the available credits I can take as one.
Is there any way to prove it to them, I've found these so far but they are not in Ohio:
http://grad.uga.edu/index.php/incoming-students/information-for-new-students/university-system-of-georgia-residency-policy/
http://www.gradadmiss.gatech.edu/lawful-presenceI need to be able to convince this community college's International Office that they are wrong, which they are.

I haven't gotten my green card either.
By being married you have to file married, you can choose whether to file jointly or separately though.
Never had a complicated tax return in my life.
Actually, I'm really enjoying the paperwork and the intricate tax system and so is my wife. Although she is planning to branch out to become an account in a couple of years.

I just got a one way ticket to Baltimore for 300 GBP while spending some miles. I didn't know when I would be back in the UK.
By the way, it is cheaper to do a return from the UK than the US.
-
Congrats, my wife just added me to her US Bank card. Hopefully that will help me get credit. None of the banks want to give me a secured card directly because I don't have my Green Card yet (only EAD)...
-
Is that the case even though in the 365 period before I came to the USA, I was actually only outside for 280ish because of the trip to the USA on a tourist visa.

Hello Everyone!
July Filers here and Received my NIPW Nov. 12, 2014 does anybody received a green card with same date as mine
I believe I also received my letter then, and also filed in July. It's a waiting game. Seems like 6 months is the average time it takes to get it from the NPIW letter.

Hello,
i have my Ead recently, one week before my interview, and now they mail me my green card.
And it is true i have apply for one job and she tell me i need the green card, i told her i give my EAD and she can't put me in this position since i don't have my greend card, so some opportunity can go so fast.
so when i read your post i realise it is normal , it is not only me.
Have a good day. I don't see nothing than patience.
That is odd, I don't see how they can discriminate against EAD holders. I know some jobs may require US citizenship but I've never heard of a Green Card being required. However some people don't know what an EAD means, so maybe that's why...

This is a difficult situation, India is a higher risk country as there a more fraudulent applications from there than say the UK, France or Germany. This is why they questioned you more.
Your father really didn't help, technically he lied to the officer. The officer probably won't try again, and you will probably just get the result. If you get denied, it is a long and lengthy process, and you might have to use an attorney to this time to make sure your previous denial doesn't get you in trouble again.
You might want to get in touch with your wife's congressman and/or senator and see what can be done.
This is really nasty. This is why the support of family is essential.
My parents never supported me on my choice to marry an American, they kicked me out 2 years ago and haven't talked to me ever since they found out I was having a child with her. It's been 7 months now since I last spoke to them. They last called me the day I was about to fly and told me how I ruined their lives by being with my wife
-
How long has your wife been outside the USA?
If she's been abroad for 6 months to 1 year she may have issues re-entering. If she's been abroad over a year she will have to get a Re-Entry Permit.
-
He could get deported. It can also make his AoS more complicated as they will do background checks and this will pop up.
-
You haven't seen the Potential Interview Waiver Club, that adds another 6 months from the date of the letter to getting your Green Card.
You had an RFE, so they probably paused processing your application until they received the documents.
-
I'm using TurboTax to file, and my wife has used that a lot of times before. It does the foreigner earned income exclusion and has the relevant tests. It basically asks you questions and then figures things out for you.
I also have an EAD, but you can file as a resident for Tax purposes. I am filing as a resident for Tax purposes.
Good luck with the tax return, it sure is a headache.
-
By having a pending K1 while coming on the VWP he could have actually been denied entry, I've heard of some people who have.
You'd need an attorney to sort out this, but I think it would be difficult saying there was no intent while a visa which is for that intent is being processed.
I would say go back and return on the K1.

Look at the bright side, by the time the I-130 is approved, you will have been married for two years (or close to it) and then your husband will receive a 10 year green card versus the 2 year green card. Once the I-130 is approved, wait until the two year marriage mark occurs before coming to the USA and he will get a 10 year green card. This will save you a lot of money.
You need to be married for two years to qualify for a 10 year green card
If it were me being back with my wife earlier would mean more than having to apply again.
Can you get credit for longer than the EAD is valid?

Funny thing is I have yet to get any credit card offers. I get loads of offers for my business but not for me.
I would like to increase the available credit that the household has, also I want to be able to get credit cards for my business and don't I need good credit for that? I am very sceptical of the effect the authorized card user thing I am doing now has on my credit score. I can't believe I could have a high 700 score after a couple of weeks of being on her card. If it really does work I can't imagine why everyone else doesn't do it? Then what is the point of a secured credit card?
Well, I noticed this ruling: http://www.consumerfinance.gov/newsroom/the-cfpb-amends-card-act-rule-to-make-it-easier-for-stay-at-home-spouses-and-partners-to-get-credit-cards/
