  1. Pretty much what most of the other posters said. Also if you get a Notification of Potential Interview Waiver (NPIW) be prepared to wait another 6+ months from that letter. I applied in July, got NPIW in November, and from other people's timelines it seems they approve in about 6 months from there without a interview. Some people have still gotten interview.

Make sure you apple for EAD and AP. Do not leave the USA without AP, or you application is abandoned.

  2. I will be entering the US late Jan if all goes well, on CR1 visa. Will be there till end of april then i have to go back to turkey finish my degree.. I will try transferring my credits for a few months say 3-4 by getting a university in states where i can cover for the time in turkey.. If not it means i will be out of USA from may till dec 2015.. Does it mean i have to get a re-entry permit before leaving? What do yiu advice? I will be out for 8 months +2 weeks if I cannot transfer credits.thank you!

I think you are eligible from a green card when your CR1 is approved, I think you just have to request it when you get here. I don't think this is the correct forum for this question, so I may be wrong in my answer.

If you have a Green Card and want to leave the USA for more than 6 months you could have issues re-entering.

  3. I took a couple of classes and I noticed they are adding a International Student Services fee on my bill. I look further and it states that it has to do with nonimmigrants. I know my K-1 was a nonimmigrant visa, however after applying for AoS and having my EAD what is my status. Does anyone have any links to any Government sites explaining this so I can point them there if I am an immigrant.

  4. I was in the USA for Oct 2013 to Jan 2014 as a tourist (ESTA) for 80ish days last year, I wasn't married. I applied for my K-1 in March and I was in the USA from July 2014 onwards.

So does this mean I wouldn't qualify for foreign earned income exclusion for income I made prior to my settlement in the USA from July 2014 onwards? Or does being here as a tourist not count as time in the USA for tax purposes?

  5. You need to look at the figures of how much the insurance costs to add her on, it probably will be cheaper assuming you are getting it through employment compared to her getting hers outside employment.

I get mine through my wife and we pay $2300 a year but it was half that much before I was added on. She had her and the children on before. Our deductible is $3000 for the family, then coinsurance.

We have to pay out of pocket for the first $3k of expenses.

  6. I have my combo card and got the possible waiver letter, but we can't understand what is important about the "green card". I know I would have to renew in one year, but is there a benefit to the green card that I haven't clued in to? Other than the possibility of not being allowed back in when I leave. Thanks.

    • You are eligible to be a US citizen 5 years (or 3 years if married to a US citizen) from the beginning date on the Green Card.
    • You can get on loans and acquire credit for longer than you EAD/AP/Combo Card is valid for.
    • You are not a permanent resident until you have a Green Card.
    • And probably a bunch of other things (e.g. Driver licences) that expire when your EAD would expire.
  7. You should definitely have a talk with her, maybe go counselling? If things are going to work out, then unfortunately you will have to inform USCIS that you don't want to support and AoS (and withdraw your affidavit). Also look into ways of ending your marriage.

If you can't be with someone, it isn't your responsibility to think about what happens to her after you do what is right for you.

If you believe your marriage is over think about yourself first, then her.

  8. I joined the Interview Waiver Letter club today. I thought it was good news! Until I got on here and saw the reality of the situation. Sigh.

FYI, we're a K-1 AOS. Spouse from the middle east.

I got mine today. Guess it is time to sit tight. As long as my AoS doesn't take longer than next June I'll be fine. My medical expires next June.

I wish the AoS Immigration Timeslines here would let your filter by Interview Waiver!

  9. I just googled this and I'm not liking my initial findings. My medical was performed and sent to the London embassy in January 2014. I'm guessing it therefore expires January 2015. I'm don't think my case will have been adjudicated by then.

    Does anyone know any more?

That is pretty much it. Oh also you may have to pay additional fees due to the fees increase if your interview isn't this year. http://www.visajourney.com/news/2014/09/02/us-visa-fees-to-increase-sept-2014/

Had our AOS Interview yesterday in Detroit,MI office. Our schedule was 7:45 AM and got there around 7:30 and checked in to the lady who looked at our Interview Appointment and after that we were told to wait in a Waiting Area and after 15 minutes my name was called by an Officer. He was nice to us. He greeted us and lead us to a room and told us to sit down. He told us that the Interview wouldn't take long for us since he already checked our file and it seems everything is there and very well organized. He just asked basic questions like Name, Address, Birthday, Parent's Name and my POE and Date of Entry. He asked the Yes or No questions in the I485 form. After that, he told us that he will Approve us and that we could check the status of our Application online later that day and for sure it will already be updated to Approved and reminded us about the Removal of Conditions and discuss a little about it. And he finally told us that our Green Card will be mailed and we should expect it within 2 weeks.

The whole Interview didn't last very long really. Just about 10-15 minutes. Though I brought tons of stuff like copies of the Original packet we sent and Copies and Original documents for our Supporting documents and proof of relationshipand photos, he didnt really asked for them. All he asked and looked at are our passports(me and daughter), my Work Authorization card which he returned to me, and my husbands ID.

Evrything went Great for me. And I'm just happy that everything is done and will be free from USCIS for some time...

I filed around the same time as you, annoyingly I think because I may be getting a "potential interview waiver" (haven't gotten a letter about it, but my congressman told me that he was told they are considering me for it), it might take a whole lot more time. Apparently my congressman was told it takes 9-10 months with a potential interview waiver.

  10. Same here: stuck on the "fingerprint fee accepted" since July 31st. It does make me feel a little bit better to see that I am not the only one. I am glad that at least I have the work authorization.

Congrats to all the people who had their interview :)

Also, I don't really know what to think of the new layout of the webpage to check your case status. It's cleaner, but it throws me off not to have the steps on top of the window. :P

I know what you mean. I am finding it somewhat weird with having no steps on the screen. In some ways it makes it feel like things aren't wrong when I am still in the "Fingerprint fee Accepted" (old Acceptance), but in other ways I wished they had employed more people at USCIS to make things happen faster for us.

  11. I think you're ripe for the waiver club. We filed a couple of weeks before you and got the waiver letter recently. Quite a few people seemed to get the letter on the same day. Maybe they do them in batches? Maybe you're next? Sorry I can't do better than maybe but good luck!

We spoke to our Congressman who wrote to the NBC. The NBC said that the Detroit office is pending sending us off for a potential interview waiver.

He also said the NBC said estimated times for the green card are 9 to 12 months. That would suck as in May my medical will expire.

  12. Thanks for the speedy response .... another question, what would happen to my UK passport - if it expires within the time period of waiting for AOS, I would have no UK residency to renew or replace ?

Renew your passport. The UK renews passport from their Overseas office in Durham (UK). I applied for my sons passport. It is simple, you apply online and pay online then gather supporting documents and mail the old passport and supporting documents to Durham (they will provide the address). Takes roughly 10 weeks according to them, but depending on when you apply processing times may be less...
