    I am filling out AOS form for my parents. Now, I am getting mixed answers about particular questions.

    1. Household size in both the forms should be 5 ( myself, my husband, my son, my two immigrant parents) but then both the petitions are "two separate visa petitions", correct? and both are principal immigrants.
    2. Does this mean that both the petitions have nothing to do with each other?
    3. Do I still say that spouse will accompany (the form says that do not list ppl on other visa petition)helpsmilie.gif

  2. Ok, Here we go.. Got a RFE. My dad lived for a year in Austria, so they are asking for a police report from Austria.. which is super difficult to get. Well, now to try to achieve the impossible.. =(

    Does your dad know someone in Austria? The best thing at this point is to go online and check their PCC procedure...u never know, it may be easier than you think. If he was there on job purpose, it should be easier.

  3. Can I ask 2 very stupid questions please?! Our AOS free is now showing as 'paid.' The AOS packet that everyone talks of - do we actually have to wait to receive something before we send it off?! Do we actually receive a packet that we then have to return, or do we just send off our forms now and not have to wait for anything?!

    Also my second stupid question - when we get round to doing our IV packet. Do I have to sign the form, and then send to my USC husband? Or as he's now my agent, can he sign the form on my behalf?

    The only stupid thing is not asking your quetsions lol You dont have to wait for anything, however; my question is that do we have to send the paid AOS reciept with AOS packet? If yes, is it a barcoded reciept?

  4. Hi, I have a few questions which i don't seem to find answer or maybe i over looked. USCIS had just approve my parents(mom & dad) I-130. Since my income does not meet the household income guideline, my husband will be the co-sponsor (I-864a). We file joint return since the day i live in USA. I get mix answer on how to file I-864. Could some please review my sample pdf in red pen color if I did it correctly. Thanks in advance for your help.. I know that each person need to file separate I-864/I-864a

    Just a suggestion: I know your question is about household size, so if you post a specific question, you will get better/accurate response. i personally think your I 864 is accurate in refernce to household size :) Lets see what other members think :)

    Sorry for any misleading info by suggesting the Property value assessment notice, as I read it somewhere and still don't recall where, but it 'filed' in my brain along with the zillion other tidbits of info that I've read since starting this journey...

    Question : if you very recently paid your property taxes, the receipt includes the value of the asset. Will that work?

    on your example in red, does that mean i will only have 6 household? I-864 for dad household would be me, spouse, 3kids, and dad = 6. I-864 for mom household would be 6 too (me, spouse, 3kids, and mom = 6)?

    Please check in to this one more time because I think you have to say 7 eventhough you have 2 seprate I 864. You do list a person who is comming with your father (ie your mother) and visa versa.

  8. i was wondering bout that too.. most of the cases i follow here got iv invoiced after 2 weeks, a few were earlier. maybe bcoz of the backlog, holidays, weather.....

    even the AOS bill, its taking a while to show its paid.

    and if you dont mind, can u make signature timeline

    I am experiencing the same thing. Anyway, I just hope that eventhough its slow, it should atleat go smoothly (i.e without REFs, extreme delays etc)

  9. The thing is if you have a mortgage.

    Get the value of your property assessed by a professional or three (like a realtor.) Basically what you could realistically sell your house for in the current market. Then minus what is left of your mortgage. This is how much assets you have in your house. Keep in mind that the NVC or consulate may not accept using your ONLY home as an asset. Generally they only want to see assets that will not leave you homeless and jobless.

    I am $1300 away from the poverty line :( However, my house is paid up, no mortgage. I also have around 40K in my saving and checking account. Do they count bank account as assets.

  10. Saylin I need your help smile.png my father is my joint sponser and he will be using his property for assests, but here is the problem, we cannot find the appraisal for the house anywhere ? now I have the deed but that does not show value. Is there anything else I could provide?

    I believe it should be on the deed b/c I got my deed today and it did have the asset value. Does it depend on state where you live? Edit****sorry I didn't read the post where you said th as t your deed doesn't show the value.

  11. On Monday our lawyer received the RFE. They are asking for an updated biographic form for me, photos which should not have been taken more than 30 days from receipt of the RFE, ORIGINAL marriage certificate, and translated copy of the marriage record booklet. Can I get the marriage record translated in India and mail it to my husband?

    What is "translated copy of the marriage record booklet" ? Is it memorandum of marriage? Which state are you from in India? I believe you can get it translated in India. If you send the original to USCIS, makesure you have another certified copy B/C NVC will ask for one as well.

  12. Who with my date has not received case number yet????? NVC received case on 1/13/14, today is 20 business day and I have yet to get a case number... They are providing excuses such as we have received several applications and it's taking longer than usual to input them into the system.. UGHHHHHHH!!!!!! I have had it.. How much longer are we supposed to wait

    I was able to put in a service request. When I called NVC at day 21/22 I acted extremely sweet/polite and asked the rep about what could be done since 20 day have passed. He told me that he will place a service request for me. The next day I got my number :) I feel that the rep was equally nice as well, so I don't know if my tone helped or he was just helpful.

    Trust me, you will get your number soon :) Good luck.

  13. Keep in mind, pregnancy, unless it's high risk, is not a reason for expedite. It's worth a shot, but no guarantee.

    1. Lets say my income for this year is exactly at the cutoff poverty line, (for the previous years is definitely under). However, to be safe I declare my assets, Will that cause any confusion or it is not a big deal?

    I have flexxible hours at work so i am never sure about the amount sad.png And I am planning to declare my saving, checking accounts and my paid up property. Just want to be sure that my AOS is not short and want to cover all bases.

    2. Whom should the employment letter addressed to? Is there a sample copy somwhere? I didn't see it in post 1 & 2 or if its there one, I am brain dead.

    Rightnow your main task is to send whatever USCIS wants and get an approval. However, when everything is done, and you get here I would really want you to go see your lawyer and confront him. the main reason your husband hired a lawyer is to makesure that everything goes smoothly, so how come there is an REF? Clearly he did not do his job. I am not aware of your background, but when my case was deayed my relatives sucked the soul of of me by constantly questioning me.

    If you can convince you husband, I would suggest that once you get approval letter, remove the lawyer and do all the paperwork by yourself. VJ family will guide you at every step. And finally, DO NOT PAY THE LAWYER, I REPEAT DO NOT PAY HIM, NOT EVEN A DIME.
