It shouldn't be an issue. If asked about it, obviously, be honest. But I'm assuming that you filed while you were still married and living together, and the separation happened in between filing and interview. As for the taxes, again, I'm assuming it was an honest mistake (misunderstanding) of the rules.
In theory, your new application has nothing to do with your prior marriage - as long as the officer who interviews you doesn't think that you tried to circumvent the law the first time, you should be fine. And I think (although I don't know) that the length of time you've waited before reapplying (5 yrs after the initial 3 year filing, and after "getting right" with the IRS) would suggest that you're trying to be sure to get it right this time.
No one can be entirely sure what's in the mind of an USCIS officer at any given time, but I think you'll be ok.

I, personally, would be sad if my husband couldn't attend my oath ceremony - it's kind of a big deal, and I'd want to have the person I love there to see it. However, sometimes things don't work out the way we would have wanted, and if it turned out he couldn't come, I wouldn't change the appointment. Who knows how long it would take to get another date?

If you want to be sure your whole package won’t be sent back for incorrect payment, you should get it fixed. I know it seems like a tiny detail, but I wouldn’t take the chance.

Roughly a year based on the Phoenix field office. Maybe shorter if you file online, but since most people are filing online now, the advantage might be gone.
And it costs $725 - $640 to file plus $85 for biometrics.

It seems like, in your situation, you’d be best to get the I-551 stamp as soon as possible. The stamp should be good for another year. The I-551 stamp is essentially a green card, so you should be able to use that info to book your tickets.

My opinion, for what it’s worth, is that your pay stub is your pay stub. If that’s what you have, use it. They’ll ask if they need something more, or different.

Of course you should do what you think is right. However, there is no penalty for contacting your representatives, and the sooner someone is "on your case" the sooner this all might get resolved.... or you'll get an extra green card with the wrong date on it. My advice may be faulty....

YAY! It is what you think it is - you've been approved and you'll probably get your card in a week or so! Congrats!

Contact your representatives (Congressperson and Senators) and see if they can follow up on it for you... worst case USCIS will probably schedule your interview sooner and best case they may take another look at your file and approve you!
In other news, for me...
On Monday, I got all excited there for a minute... my email said "we've updated your file" - so I checked in on the website to see if they'd done something on my N-400 ........ And nope. It turns out that the "update" was changing the status on the I751 (which you can finally track online) to say that my card had been mailed to me.
The update was dated Sunday... I got my new card 2 weeks ago. I joked about "wouldn't it be funny if they sent me another green card?" - hahaha
Right, so... I totally got a second green card. But this one says my "resident since" date is 03/14/18 (the date they finally approved my I-751) - SOOOOOOOO ticked off, since this means I had to take another morning off to go to an Infopass (fortunately there are Infopass appointments available next week!) to sort it out, and make sure that the date is correct in my N-400 application - if they look at the wrong card, they'd simply deny my N-400 because I "wasn't a resident long enough" and I'd be out $700!
Seriously, the IT department at USCIS need to get fired. OMG I'm so tired of USCIS and their incompetence!!!!!!!!

Is your wife concerned that student loans would be considered a "means tested benefit?" If so, don't worry -
- Since they are loans and need to be paid back, they don't qualify as "assistance" in that way.
- Since your stepson is (I presume) a USC, he qualifies. Your immigration status doesn't impact that in any way. He's getting the loan, you're not.
- Even if 45 decided to disqualify everyone related to an immigrant for federal student loans/student aid, he most likely would not be able to make such a ruling retroactive. (Which means that, if you'd already gotten aid, it couldn't be held against you, but you wouldn't qualify going forward.) This would make him mad, but the rest of the government just wouldn't stand for it.

Some offices have oath ceremonies frequently, some don't. If I were at a field office that doesn't do them all that often, I'd be pretty tempted to change the vacation. But if not, it's worth making an infopass to attempt to reschedule. I don't think they'd let you do a walk in, but I don't know that for a fact.

Yes. Bring the entire package... every form. The transcript won’t show up until they’ve processed your return, which likely won’t be for awhile.

The (mis)information line is chronically bad, especially at the customer service level... they don’t know anything. The notice from the tier 2 officer is probably correct, and your file is probably en route to San Francisco. Crazy that they have to send it to MO and then all the way back to CA! What a waste!

its been 603 days since they received my application.
RFEs generally take around 1-2 months these days. Good luck, the end is in sight!

Does your stepson qualify to file on the same form as your spouse? Why does he have to file on his own? If he arrived at the same time or within 90 days of your spouse, they can file using the same I751 form and fee, with 2 biometrics charges.

@Le Bangoulap Yes, it is just a coincidence that the no action update was sent just before they scheduled your interview. The "no action" update is automatically generated every week/2 weeks it seems. But as it happens, you did in fact get an update later that day. So, good for you! The 2 different sites seem to update at different times, so I'm sure it will update soon!
