    I'm also going to go ahead and delete the Nebraska lockbox. We don't have any military applications on this thread, it seems... If one shows

    You have already received all the information there is. 

     

    When you apply online,  you will have to go through a million screens as they ask questions about you. 

     

    At the very end of the process, there will be a screen where you upload all the documents they require (and they're all listed on the same page). You will need to scan any paper documents and save them in PDF format. Then attach them to the application.

     

    If you don't know how to do this from your computer, someone will need to help you (an actual physical human, sitting beside you). Ask a teenager (or someone else who is good with computers.) 

     

    If you really can't figure out how to upload a document online, (and you can't get anyone to help you) you'd be best to file by mail. If you file by mail, you will need physical paper copies of the required documents and you send them in the envelope with your application.

  3. We were lucky... my husband's mother let us stay with her for the first while, as we were setting up and getting jobs etc (I came here on a CR1 but my husband and I had been living together in Canada before that, so he didn't have much US credit/rental history either.

     

    He did have some old credit history, so we were able to get a credit card with a small line of credit and start building up our US credit history. Yes, we had to make a fairly large security deposit on the apartment we got, but by that time we were both working and could prove income, at least. 

     

    And on a CR1, you are eligible to get a SSN as soon as you arrive, so if you didn't get yours you need to contact Social Security and get one ASAP. 

     

    Sorry your arrival was so difficult.

    Well, TSC does not have a timeline listed for processing ROCs. (Which is super handy for USCIS, isn't it? We don't have any framework to make a service request.) Presumably all USCIS officers are trained to process all the different types of files, so they  are able  to process ROCs... which now, if there's been a workload transfer, they will have to do. There will most likely continue to be no way to view a timeline for how long TSC will take to process ROC files, since that form is not part of their usual brief, and unless they're going to start regularly processing that file, it's not worth it to USCIS to change their computer programming to accommodate.

    The next update you get (which is often heralded with multiple emails/messages) is "We reviewed your biometrics" No documents, and probably no interview appt yet. They're supposed to use your biometrics to run all the background checks before they schedule your interview. You never know though! Good luck!

Unfortunately, "all bets are off" for processing times at USCIS for the last couple of years... they've gotten ridiculously backlogged since late 2016.  A lot of the patterns (like being informed of being "in line for interview" at the 3 (or 5) year anniversary of residency) seem to be less predictable than they were. 

     

    Some people are hypothesizing that "in line for interview" may not be a status update anymore. It may be that we'll all just go from "actively reviewing" to "interview scheduled". Either way, I hope you get your interview soon.

  7. Yes - believe me, I know it takes for. ev. er. to get approved... I finally had my senator's office intervene after I'd been waiting 18 months. But once I was approved, it was very fast to get the actual card. There are a few people whose cards don't get sent properly but those cases are outliers. Usually, once the approval happens it's only about 2 weeks to get the card.

  8. Re: 3 year rule naturalization:

     

    The rule states that you must have been living "in marital union" for three years... I don't think that specifically excludes people who are married but temporarily not living together. So it would appear that the CR could still apply for naturalization at the 3 year mark, provided that CR doesn't move "jurisdictions" within 3 months of applying. And keep in mind that sometimes "jurisdiction" can change from town to town. 

     

    I can't see any rules that would preclude CR from filing on schedule, provided they fit all the other rules.

    Lots of people don't realize it. But the handy thing in your case is that it means you can at least have one address in common.

     

    No worries about income for this portion of the immigration process. As long as you both file (and pay if necessary) your taxes and the CR doesn't try to get a means tested benefit, they don't care anymore. It's not like the original immigration process where USC had to prove income. So no, not a concern.

  10. I know that they say that you may have to wait a long time for your green card, but for most of us it takes less than 2 weeks. You'd probably wait that long for an Infopass appointment anyway!

     

    The approval letter doesn't technically provide any immigration benefits, but it might be enough to get the rest of the paperwork on your employment moving along. Probably not the DL though. An employer might see the letter and understand that you can probably bring your new card to your first day of work, but the DMV likely won't give you a new DL without seeing the new card.

     

    If you do want to get the stamp, as others have said, make an appointment for an Infopass, and bring 2 passport style photos - they will put the stamp on an I-94 form, I believe. However, they might only give you a very short validity period (or refuse to give you one altogether), since that sheet of paper is essentially a green card, and since your new one is probably in the mail, they don't like for anyone to have 2 valid "green cards".

     

    If you can possibly wait a week or two, you'll probably have your new card in hand.

  11. The USC will need to file a change of address form (I-865) with USCIS - they will put their "physical address" as the place they're living while taking the master's program and their "mailing address" as CR's address in NJ. 

     

    The CR, as you've already stated, will file AR-11 to change their address (both physical and mailing) to the new apartment in NJ. 

     

    It is reasonably likely that you will receive an interview, since this situation is not the most common, but it's certainly not unheard of either. Sometimes for work or educational opportunities, "real couples" temporarily have different addresses. 

     

    If you get an RFE, include a cover letter explaining your situation. It will ultimately be fine - you may just be subject to a little more scrutiny, but you know your marriage is legitimate, and will definitely be able to prove it.

  13. Clearly this is an unpopular belief among the contributors to this thread, but I don't believe that anyone is "all in favor of illegal immigration." What I do believe in is not throwing people out of the country who have never really known another.

     

    The dreamers (DACA recipients) were brought to the US as children, and in most cases, don't even remember their "home countries." Despite the fact that they are in the US illegally, this is the only home they've really ever known, and in order to maintain their DACA status, they must live up to the highest expectations. Allowing them a way to normalize their immigration status (even if they are not allowed to become voting citizens - possibly creating a new category of green card holder that never qualifies to become a citizen) is simply the most humane thing to do.

     

    I don't think Democrats are in favor of illegal immigration any more than anyone else. But they understand that an adult knowingly crossing the border illegally should be treated differently from a person who was brought here as a child and has essentially grown up as an American.

    Well, there is a good chance it won't make any difference, of course!  :lol:

    I think that the story about delays is a story a lazy lawyer might tell. Once they’ve pulled your case they have to look at it.

  15. First of all, I’m thrilled that you’re so understanding about your fiancée’s potential culture shock moving to the US. 

    She probably should hold off listing the apartment until she’s at least been approved, especially if they sell fast there. If that means renting it out for some time (until she has her green card and can return to Ukraine long enough to sell) that’s probably best. Chances are it won’t affect her US taxes because foreign income is often exempt from US taxes. 

    As for the job, again I understand the issue... she will need the income until she actually moves. But taking vacation time and then quitting seems a little shady, depending on what the rules are there. What is considered normal for giving notice? Presumably she will not be able to leave instantly upon approval- could she give 2 weeks’ notice by phone on her way out of the consulate after being approved? Either way, she’s not likely to get enough vacation time to use that job as a safety net, so better to be up front.
