    The submission of the 864 should include tax transcripts. Get them from IRS for free from the IRS web site or in person at IRS office.

    the same thing happened to my husband his medical expires December 12 they asked if he could travel before then...he said yes he can and they issued the visa the next week!!! Best of Luck

    Lol whoops i used acco. Because every other thread i read said to.
    I fastened the i130 as one and the i485 package separately. Then i put in tabs at the bottom for the forms and supporting documents. Ours was like 3-4 inches thick, so this was the most organized way to do it for me.
    Oh well, it was accepted, so i guess as long as its in order it won't matter what you use. Lol

    How unlike the government to be contradictory! (kidding!) I haven't gotten to the stage where you are yet (won't be too long now!) but after reviewing both and looking at the fasteners, I think I would not use the ACCO fasteners. I will probably just use simple binder clips or rubber bands (neither change the integrity of the paperwork and are easily removed). They really do make it confusing though, don't they? Hopefully others have run across this and will comment, it's a good question

    She can always try to provide as much evidence of her current income as she can and see what happens. They would not outright deny you if they won't accept her financials. They would send you an RFE and ask for her to show more income, assets or provide a joint sponsor. You could always wait to see if you will need the joint sponsor and have all their documents ready to go in case the RFE comes. That way you don't lose too much time.

    The problem with her working freelance is that it is difficult to prove current income when self-employed. They tend to use line 22, Total Income, from your most recent 1040 to determine if your income meets the requirement. Since her last 3 years of taxes have fallen below the requirement, I would suggest you get a joint sponsor, even though she is on track now and currently earning enough annually. That would be your safe bet.

    You are welcome. Also, in case you did not know, you also do not need to include a statement as to your reasons for wanting AP. When filed with a pending I-485, that is not required.

    You will need to leave those blank as you complete the rest of the form that applies to AP. When you print it out, hand-write 'Unknown' for the date and length.

    The spouse/petitioner needs to submit their own I-864 with complete tax returns, even if they do not qualify as the sponsor. Then the sponsor will also submit an I-864.

    You can put "unknown." AP is routinely approved for people with pending I-485s.
