  1. It seems likely that they will not count the first submission. But for you that's just a couple of days of lost time. For us it's 2 weeks. Which is a giant drag, since I want to get going with this!

    It doesn't "mess anything up". It's just that you need to count your wait time for IV fees from the second submission, not the first.

    I see - did you try and raise this issue with NVC? Two weeks on top of their backlog sounds bit too much. Did you try and fight for it?

    Hope it doesn't go to "incomplete" for me after few days again..makes me nervous :(

  2. Yes, the backlog is incredibly frustrating! But I guess we should have expected it. After all, to get USCIS back in line, they needed to use 4 different offices and now everything has been funnelled down to 1 NVC office. It really bites, but it makes sense, kind of. There's still no more budget to hire more people (of course, that's in government parlance, where they'd rather spend 1.5-2 times the amount of money to make their regular staff work overtime rather than spending the same number of dollars to hire 1.5-2 times more people!!!!)

    I'm trying to be philosophical about it.... it'll happen when it happens.

    It seems like you ran into the same issue I ran last Thursday. I completed DS261 before we received official letter from nvc. It showed completed for a day and on Saturday morning after receiving instructions email from nvc, it was showing "incomplete" for ds261 so we resubmitted. Now it again shows "completed". Not sure if I should have resubmitted or not but it seemed like the right thing to do. Hope I didn't mess anything up.

  3. I really wouldn't worry as it won't cause any significant delays in your case. That's only 2 days. If it was 2 weeks I would worry.

    Not yet but I hope they start scheduling for July next week!

    I will try with the consulate in Casablance to see if they can move it to June once they get the file.

  4. Since you just received instructions to do it, I suggest you go ahead and resubmit it! it is only a matter of one day or two, you don't want it to drag longer than that!

    Also, there is no credible information as far as that causing delays, so far we only have conflicting opinions!

    My 2 cents: go ahead and resubmit!!!!!!!!

    Ok resubmited and not it shows "completed". I am pretty sure instructions email we received last night reversed our already completed DS261. Although, what surprised me the most was that when i clicked on "incomplete" all of the prior submitted info was already there. So all I have to do was to click next couple of time and then submit! Hope I didn't mess it up by resubmitting it...ugh..

    Did you get an interview date?! :)

  5. I did almost the same thing myself. I filed DS261 before getting the instructions to do it and it showed complete.

    When I got the email to fill out DS261 and pay AoS fees, the status of my already filled out DS261 did not change. It stayed "Complete" so I did not have to re-do it.

    Since yours changed status, I'm guessing (keyword: guessing) the system kicked it out and you need to re-submit it.

    When did you fill it out originaly?

    That is exactly what CS rep told me. She said "as you filed it out before you received instructions from nvc, you may have to resubmit it". This whole thing is so confusing..m just going to go ahead and re-submit it. I fled the first one on May 22 and got instructions yesterday.

    I called nvc yesterday and cs rep told me she couldn't see my ds261 and I told her that I had already completed ds261 before nvc even emailed me with instructions. then she was like "you may have to re-do it once we send u the instructions" then she put me on hold for couple of mins and came back and said "she could see the form at her end"...and now this morning i got "incomplete" message...what a mess...When I clicked on incomplete, it had all of the info I had entered.

    So you are suggesting I should go ahead and hit resubmit it? Just makes me nervous that it might cause delays. :(

  7. Good morning everyone, ok so I paid aos yesterday and had already completed ds261 before we even got an email from nvc with instructions. Yesterday both wife and I received instructions for ds261 and aos. Ds261 was showing completed until we received instructions and now it is showing "incomplete". I know couple of people here ran into this issue. Can u pls advise what I should do? Resubmit? So confusing

    That is quite strange, they are there just to collect all of the paperwork per my understanding. Questioning marriage certificate at NVC stage makes no sense to me if uscis already approved it. Try calling NVC again and speak with the supervisor?

  9. I am anxiously waiting for news from NVC regarding my AOS and IV packages.

    In case they come up with a checklist on Marriage Certificate or Birth Certificate, can I consult a lawyer to respond to the checklist? I have submitted to NVC the originals for both the document and will be completely at lost if they ask me provided validity on either of these documents. Going back to the issuer of these documents is major hassle.

    Wanted to see if anyone has hired a lawyer to help with these unreasonable checklists?

    Why do you think they will question the authenticity of either marriage or birth certificate? If you are submitting original certificate you used to make copies for USCIS and if USCIS accepted it, why would NVC question that? It does not make sense. I think you should not be concerned.

  10. If you are submitting the actual 1040 form instead of a transcript, then you need to include all worksheets and schedules that you used to calculate the numbers in your tax return form. Basically, the same docs you submitted to the IRS.

    If you're not sending in tax transcripts, you have to send the ENTIRE tax return package. Basically, whatever you sent to the IRS, you have to send to NVC.

    Great thank you both! My accountant only asked me to send W2 with the tax return to the IRS and nothing else. I received 2 1099s and one 1099-INT. I will send all 3 of them to NVC just to be on the safe side as they were used to get to the TOTAL INCOME number on 1040. :)

    You should be ok. I submitted my AOS packet barely a week after I sent my 2013 tax return to the IRS via snail mail, and I had no issues. That's the reason why NVC asks for full tax return packet (W2's and schedules) if you do not submit transcripts.

    One more question for you :).

    I am in the process of finalizing AOS packet. When you said include all schedules, does that include 1099s (for stock dividends & transactions) & 1099 INT (for bank interest)? I just don't want to overwhelm NVC with too much info if it is not required. Thanks in advance for the help.

    Anyone else, who has this info, please feel free to jump in. Would really appreciate. :)

  13. Be sure to send a W2 even if you send transcripts, so that it's clear what portion of the joint tax filing was by your joint sponsor. I'm certain I've seen that clearly stated here on VJ somewhere.

    I filed Married filing separately so I don't believe I have to worry about that piece? Also, don't have a joint sponsor as my income should be sufficient to 1 person. The only thing at this point that makes me nervous is how they are going to verify my total income if IRS hasn't processed my return. But then BOS_LHR mentioned earlier that many people's returns are not processed by IRS by the time NVC requires them and many people file for extention. So mine is not a unique case. Yet it worries me :P:D

    Don't be nervous, just use the numbers from the tax returns as you're supposed to (1040=total income, 1040EZ= adjusted gross income), include the W2, and you'll be fine :)

    Yes that is the goal. I will wait until they invoice me for AOS and see if IRS has my transcripts ready by then, if not then I will just mail in paper 2013 return + W2. Will see what happens after that..I am also going to mail 2012 & 2011 transcripts. It is out of my control at this point. :(

  16. I wouldn't send anything else at this point. Pay stubs aren't required documentation so you shouldn't get a checklist for not including them.

    Not sure to be honest, there must be some process to verify in cases where returns aren't processed yet, filing extensions were granted, etc. Can't guess what that might be but lots of people have those situations, it'll be fine :) I would plan on having the 2013 transcript available at the interview just in case though.

    Great thank you again! Can't believe they still haven't generated transcripts yet :(. It just makes me nervous to send paper return filed+copy of W2 as W2 has $0.50 and return rounded down...Plus it has other interest income from bank and dividends which are not listed on W2 obviously. I guess I am just thinking too much about the checklist that I might get..Plus don't want to delay anything anymore as everything has already been delayed so much! :(

  17. I think it must be an automated computer check that verifies the income figure listed on the I-864 against the IRS database. A W-2 may only be a few cents different before the feds round it for tax purposes, but it's a simple yes/no result for the match, so any wrong amount irrespective of how trivial will get a rejection kicked back :( The I-864 asks specifically for tax return data, so stick with what's on your transcript and you'll be ok :thumbs:

    So if I just send my paper tax return and W2 to NVC instead of a transcript, how would NVC verify my return with IRS if IRS hasn't had chance to file my return yet?

  19. I am in the process of finalizing Aos paperwork & not sure about last year's income. For 2013, my W2 shows $xx,xxx.50 and tax return shows $xx,xxx.00 as it always rounds up or down. Should I put $.50 for 2013 income the way it is on W2 or round it down like it is the tax return? Don't want to get a checklist for something very silly thing like this. Not sure if someone ran into this situation before or have any info? Thanks in advance for your help! :)

  20. Hey hi all.... do we get email notification that NVC has received our case or do we have to find out only by calling them? whenever i call them the call is busy,i cant get through...Does NVC have their offical site like USCIS?? If yes can somebody please tell me whats the site ??

    You have to call them at 6033340700 and find out if they received your file or not. Yes the line is usually busy and you would have to keep trying until you get through and then press 1, you will then have to wait for good 20-30 minutes (depending upon your luck) to speak with an agent.

  21. Any news? You are officially past 60 days since transfer. There's no way anyone at USCIS can you to "wait". You should make a service request, I think - also when you make the service request make sure to tell them which service center to send the service request to! They've been sending all the service requests to NBC where they sit until they expire, prompting another call from you :-(

    Did you get a case number!?
