    I'd put vacation trip and to visit the daughter and son in law. Avoid mentioning the up coming baby, as this can often be assumed to be coming as baby sitter and/or domestic help, which would be considered as coming to work. Yes I know even if they would not expect pay, some hire people to fill in this roll, therefore it is considered taking a job that a legal resident or citizen might be paid for.

    The length of his stay will be determined by the CBP upon his entering the US and it will depend on how he does in his interview. In most cases, a B2 visa holder gets six months. [Presuming he is not Canadian], taking a short trip to Canada will not reset the clock, which means upon reentering the US he will still be bound by his original allowed date.
    While he is here he can apply for a student visa if he satisfies the requirements of, and enrolls in an institution that is authorized by the USCIS to issue I-20.
    It seems to me you're going the wrong way about getting him to stay in the US longer than a tourist should. If he has plans to study in the US he can - and should - get a student visa before arriving in the US to avoid any unpleasant surprises.

    I work in the court system. (Prosecutors) Trust me. Unless you want to take a chance at a bench warrant being issued for contempt of court you should appear IN PERSON at the proper place at the proper time with the letter in hand as well as your LPR card and other identification. I would NEVER trust calling the court and hoping that the person I talked to really took proper action to see that I was in fact excused. I would go IN PERSON. The court clerk will want to see your green card and probably at least one other ID (drivers license?) I would also bring my passport along just in case. You can never be too careful. Specially when you have an ROC pending. Be safe. And don't forget to get your jury duty fee for appearing as ordered.

    As soon as you get married, you can start using your married name. This is regardless of whether or not your marriage certificate actually shows your married name, because some states don't show the new married name [only the maiden name] in the marriage cert. This means you can definitely use the marriage certificate as proof for a legal name change.
    Also, you can fill out your AOS forms (including EAD and AP) using your married name, even if you haven't changed it yet with SSA.
    For the name change on your SS card, that is a separate process. You can check with your SSA office, because some folks mentioned here that one only needs the MC for the name change. However for non-USCs, SSA will typically look for a valid immigration document showing that your new name like EAD or GC on top of the marriage cert, because they will have to check your name on the SAVE database.

    Use your residential address on the I-864 and all the other AOS forms where it asks. Your local USCIS office where you will have to go for biometrics, and possibly an interview, is based on where you live.
    You will not include your parents in your household size, just you and your spouse. You check Unemployed and will need to include a statement as to why you were not legally required to file taxes for 2013.
    Your dad fills out his own separate I-864 and will include your spouse, his spouse, and you because they claimed you on their taxes, plus any other dependents they may have Your mom fills out an I-864A to go along with your dad's I-864.

    The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.
    You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

    it is not a dim/negative view because NVC takes *much* longer for spousal visa cases as opposed to fiance visa cases. COCs do expire, and there is a chance it could expire if there are delays at the NVC stage. i wouldn't advise that the OP takes that chance.
    if there is incorrect information that is being posted, someone will eventually come along to correct it - that does not mean it is contentious.

    Ticket has to be in passport name, which is your valid travel document.
    When re-entering US, you need to show your GC and until you have a passport in your married name, you also have to show your certified copy of marriage certificate every time you travel internationally.

    Please elaborate, what affidavit are you referring to?
    "Statement" of intent to marry? If so, yes, an original, signed statement from both the petitioner and beneficiary is required to be submitted with the I-129F petition. accessible at the top of the forum page, for details.

    Not to discourage you, but unless you have a very rare set of skills, you are going to have big challenges at best.
    In some years the entire quota is spoken for within a few days of the year (the immigration calendar year that is)
    Not only that, but also, it would have to be properly demonstrated that no one around here can fill the position -hence the very rare or at least difficult to find skillset
    A PhD might make it even more challenging.
    Your desire to look into social media analytics might get you that edge: with big data being the current fad around this side of the ocean, there are some demand for data scientists; which could be argued are best fit if a PhD is held by thte candidate.
    Now, let's assume you in fact get a job offer, your next challenge is to have the prospective employer wait until your work visa is issued, that can take several weeks/months, though there is an expedite possible --by paying a premium. Not sure how long or whether a company would wait, so we get again to a very rare and hihg demand skillset.
    Last but not least, Miami and Florida in general are not the "hottest" area for the kind of post you are looking, unless working remotely is available.

    Just to add, you don't need SSN for you AOS, but getting your SSN soon gives a whole lot of benefits like opening a bank account, etc. It's also faster to get your SS card using the I-94 than using the EAD card or GC.

    It's clearly indicated in the I-864 instructions that proof of US citizenship or LPR status is required.
    He should scan his birth certificate or the biographical page of his US passport and send it to you as a .pdf attachment in an email, something like that.

    Husband to be? What are you filing for? Adjustment of status? From what visa?
    Is he self-employed? If not, he can provide a letter from his employer and most recent pay stubs to prove his current annual income. Total income amounts from the past taxes are different than current income.

    You will proceed with the I-129f since she is your fiancé. If you meet the requirements to transmit US citizenship to the child (which you probably do) she will file for a CRBA (consular report of birth abroad) which will result in the child receiving US citizenship and then apply for a US passport.

    Hmm? I think you are confusing Adjustment of Status with Application of Support.
    You need to file Adjustment of Status, there is nothing to do online, no invoice. You need to fill out a I-485 package and send a check or money order with it for $1070. You need to mail it to the Chicago Lockbox. More details in the guide section here, and in the form instructions available at uscis.gov.

    You cannot shop consulates to avoid denials. You can use the Kazak embassy if he is working there legally.
    Consulates are "hard" or "easy" depending on the populace that come for interviews. If a lot of fraud comes through there, then there will be a lot of denials. A fraud couple would not get approved in an easy embassy just because it is easy.

    The next step is to get married within 90 days. Once you have the certified copy of your marriage you can apply for AOS. As part of AOS you can file for EAD/AP. Once you receive your EAD you will be able to accept employment, not before. The EAD allows you to accept employment while your status is being adjusted.
    In regards to the SSN, give them two weeks to get you in their system and you should have no issues applying for one.

    Yes, it certainly is.
    We front-loaded our initial I-129F petition with as much of the different types of evidence types mentioned in the VJ K1 Guide as we could assemble prior to the petition submission. My then-fiancee and son's visa interview lasted about ten minutes. The CO had certainly previewed the file. There is no specific indicator if the front-loading was successful other then they got their visas, and no issues with evidence.

    'Front-loading' is not to avoid an RFE for the I-129F petition. Relationship evidence is not a requirement for the I-129F petition, so they would not send an RFE if that evidence was not provided. 'Front-loading' is for the consulate stage. What you submit with the I-129F petition will be in your file for the CO to see for your K-1 visa interview. There have been instances where a CO will not allow further evidence to be provided. If it is already in the file with your petition, then they cannot deny that the evidence was present, as it already went through the USCIS and was in your case file already. The CO will most likely look through the case file before you interview, and it helps to make up their mind whether your relationship is legit or not.
    You do not need to go overboard though. Hundreds of pages is not needed. Just a few select documents that span the length of your relationship will do. Then, bring more to the K-1 visa interview.

    Yes. If you had your overseas medical done within a year prior to your AOS filing and all the required vaccinations are completed, then you only need to submit a copy of your DS-3025 with your I-485.

    RFE or Request For Evidence. You forgot something or what you provided did not meet the evidence standards they require. You could go over everything you sent, and check it against the checklists, or you could just wait for the letter to arrive.
    Anything from the lists here could be missing, or any form could have been incorrectly filled out or lacked a signature.
