    Hi people!
thanks to everyone who tried to help with a positive reply or a non positive, cause i beleive that critics helps too.
well i introduce my self, iam the moroccan fiancé and iam the owner of a very modest computer's shop called victorious sect's technology and i really wonder how this shop's name became the topic and not the case!!
so am going to feed the questions of some people and talk about my backgrounds of choosin this name hoping that it will end this situation of "store's name".
my shop was born in 2011 and as u know you need to follow steps and a philosophy to create a busness name, cause A good business name helps you succeed by being easy to remember"and seems i Succeeded in this " and representative of you and your business.
and as there is a stiff competition in this kind of busness here in morocco i tried to look up for a name who Expresses some challenge, thats when i was influenced by a hadith of the prophet muhamed peace be up on him who says:A group of my nation shall remain steadfast, on the truth, victorious, unharmed by those who oppose them, until the Day of Resurrection"...and muhamed didnt name this group by a name but the old shcolars of islam and not the new ones named that group by victorious sect or saved sect or survivor sect...
so i took the challenge word "victorious sect" and i added "Technology" cause i have to Determine the elements of my business wich is computers and electronics...and why i choosed victorious sect's technology and not saved or survivor sect's technology ,is to get a nice abbreviation of my shop's name so i thought that VST will sound cool then SST....so this is the story of this name.
and i dont care if this name is used from a terrorist group or no cause as i said this name was mensioned from the old scholars who lived in the past centuries...and my shop has nothing to do with any group or organization, and this word has nothing to do with terrorism and doesnt mean that,...so people who play extreme games or call ther self extreme team,is that mean that they are extremist!!!of course no its just names and words for the challenge.
and what it concern me yes iam A MUSLIM but i never been in a group who follow a man who go to the bathroom as i do,but i beleive in followin allah and his prophet and i beleive in the one nation and i hate to be a part of a group made from someone so am just a muslim dont panik!
and yo people plz just use some logic what a stupid terrorist who has a background to hurt people and who belong to a terrorist group callin themself victorious sect will use tht in a visa application!i think tht someone who wants to do a crime he will just hide his face and reality, and use a streape tease's company name or something like this...so i think its so inoncent to think in it this way.
well we are cool and we are not doing anything wrong, all we want is to be together and build our future and as she has a 12 and 15 daughters they can not be integrated here in morocco and we care to ther studies in the us and not like wht some people accuse muslims that they dont let ther girls to go to school, and as ther is more opportunities to work and study and build a nice future ther thts why we choosed to apply for a visa...and at last its our busness to apply or not "u hear me james"
and i just want to say something,in my interview first i said to the officer was good morning and she didnt respond me and the first she said is rise ur hand and swear that this relation is true!!And Through the interview one of her questions to me were when ur fiancé converted to islam i said "I THINK IN" So she judged my english expression and she said u think!!!and i said i mean first i meet her she was a muslimah like a year and half ago who means she converted in 2007 ,and for me when i used "i think" expression i was just talkin algorithm!
and then she asked me the weird question :why she converted to islam?
i said she was a buddhist and she did her research and thn she beleived in islam!
and thats when her energy changed and she said its just like that she chaged her life cause she beleived in islam?i said yes its like that...and after this i got a hail of illogical questions,so i was doin my best and i answered wht i know and i said i dont know for wht i ignore..
and i know tht my english is not tht much but i studied communication 10 years old ago and i confirm tht the lady wasnot professionel and am not her only victim but visajourney forum is full of her victims!!
so i will try to post whts happened exactly in tht interview when i have a time and thanks to everyone trying to help us and i hope that u got and understand my reply and sorry for my bad english expressions.

James is a good guy. I'm sure he will back, and he would be the first to admit there are things he didn't know. There has been so much perversion of Arabic and Islamic terminology in Western media coverage of the War on Terror - a lot of people have been conditioned to be on their guard or suspicious or even fearful of many things because of these misunderstandings about Islam and cultural custom. Islamophobic pundits have led the way on this front, but the mainstream media often repeats their distortions and demonizations - for instance, look how it represents the meanings of "masjid," "jihad," "taquiyya," etc.
Anyways, it's always good when there's an opportunity to clear the air of these suspicions and share our collective knowledge. I hope I can learn something new every day.

"Victorious sect" is a reference to at least several Hadith. I wish Sofiyya was here to explain it more completely and professionally. But to the best of my knowledge, it basically says that Muslims should stick to their faith and obey the requirements of their religion until Judgment Day, no matter who tries to fight them, because they will be victorious in the end. It long predates any groups who have may have hijacked the phrase to try to give their unGodly behaviors some kind of religious justification.

Good grief. If one wishes to be the big, bad VJ tough talker, it would probably help to have a goddam clue first.

None of your comments were at all helpful, just judgmental. First you accuse her of being aligned with a terrorist group then you suggest her fiance is only after a green card? COME ON. I was the one who gave her the FOIA request info, which was actually helpful to her. I was not being warm and fuzzy in the least. DHS and CBP interview and debrief me every time I come back from visiting my fiance in his country - so what?? I am not doing anything wrong and have nothing to hide and they are just doing their jobs, by their own admission. She's never going to know why they came to her door. DHS will say their investigations are classified and not divulge. She can only do a FOIA request to try to glean info from consular officer notes from her fiance's interview. That's all.
For your information just because a terrorist group uses a religious phrase for their name or own benefit doesn't mean the Arabic phrase in and of itself is nefarious. For example: Ansar al-Dine means in Arabic "helpers of the religion". It has religious meaning long before some North African militants decided to co-opt it. You are out of your element posting here. While this is America and you are free to be as ignorant and bigoted as you want, people are equally free to call you out on said ignorance and bigotry.

Your screen name is also the name of a Turkish Jihadist group that went into Afghanistan, so that might also explain their visit. James isn't far off.

    Hi.
Two words, 4th from paragraph from the bottom from my OP: "pro bono". (Emphasis added this time around).
Mods, if you like, delete the final sentence of that paragraph. It's too late for me to delete it. Or delete the whole thing.

    .
You're right. I've navigated the process at least two hundred times.
And I've interviewed at least a thousand clients who have been denied K-1 or
    family visas at consulates.
I'll consider you to have opted out though.
    Finally,
I assume he's offering his service pro bono publico as well.
    Two thoughts here.
    1. It's better to be lucky than good.
    And
    2. Voltaire's prayer: "O Lord, make my enemies look ridiculous."
There is a pretty good history of CSC's policy of reviewing expired K-1's returned
by consulates from 2007 to the present, contained in my OP. In fact, I don't think you'll find
it anywhere else. And I'm definitely not soliciting paying clients. I'm doing this pro bono,
as I assume Gary and Alla are also offering their translation service pro bono.
Mods feel free to remove the thread. But I will be handling requests for
expedited review of expired K-1 petitions pro bono publico with CSC.
The grounds will be "USCIS error" and "Compelling Interest of USCIS".
I can't guarantee an outcome. But there is a serious problem here. Nothing is
happening. There is a paralysis between two agencies. People have brought
me emails from CSC stating it is reviewing cases returned from consulates in 2002.
There are hundreds if not thousands of these petitions returned by consulates
every year. I don't blame CSC for the problem. Really, Department of Homeland
Security should be training consular officers in immigration law and taking a greater
role in supervising the visa process, as DHS is the responsible agency - not DOS.
I'm not sure DHS knows it's in charge yet though. (Sec 402 & 428 of the Homeland
    Security Act of 2002).

I have seen 1 or 2 cases over the years be re-affirmed after being sent back to the states from the consulate. Most people are not contacted, some receive a notice that the application has expired, some one just posted recently (I think destiny64) that she sent a letter to withdraw the application about 1.5yrs ago as they decided to marry and file CR-1, and she just received the letter acknowledging the withdrawal. I think filing the FOIA will be beneficial to your up-coming CR-1 case. And as capri said, you have nothing to hide.
Best of Luck and Congratulations on your marriage!

The only thing I can really say, is because of 9/11 Homeland Security has a LOT of leeway in their operations.
For whatever reason, you became someone they decided to look at. I personally wouldnt think too much of it. They can look all they want, youre not doing anything wrong, so dont let it effect you. Perhaps you can look at it like at least they had the courtesy to knock on your door and say, hey we looked at you, rather then just doing it behind your back? Either way I can understand it being offensive.
You have to understand when you invite the government into you life (by petitioning for an immigrant) Your marriage becomes their business, your personal life becomes their business, your finances become their business. This (the homeland security visit) is a consequence of that.
Again, youre not doing anything wrong, so dont let it effect you. Take comfort in the fact that Homeland Security is still very much 'on alert' and while theyre wrong in looking in your direction, at least theyre out looking.

    Sounds great!
Make sure to "offer" some of this up front when you file the petition. They don't always let you show it at the interview. It is nice to get it in their hands before then, especially in tough embassies

Have you filed a Freedom of Information Act request for the consular officer's notes at your fiance's K-1 interview? That wouldn't likely trigger a DHS visit but it may help give you some more insight into why your case was denied, and therefore, how you should proceed. FOIA requests do take a while to process but the information you gather from it could be valuable for the future. Link to instructions is here: http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7543f6d1a/?vgnextoid=5c9ab75d8e5e6310VgnVCM100000082ca60aRCRD&vgnextchannel=5c9ab75d8e5e6310VgnVCM100000082ca60aRCRD
To answer your question, it's not totally unheard of for Immigration agencies (USCIS, DOS, DHS) to want to interview petitioners if their significant others are from certain countries or backgrounds. Seems to happen to Yemen petitioners with some degree of frequency. If I were you I'd think about it as a good thing, that you are given the opportunity once again to state your case and to discuss how much your fiance means to you and your plans with him for the future.
Wishing you all the best on your next steps!

If your petition expired and this happened, I can't see it as a good sign. It has never happened to me so I can't really say, however I would gather as much proof and information you can about your relationship as well as maybe anything you may have showing Muslim activities - maybe pictures from the past few years of a group gathering/event with the local mosque you attend, etc.
That way when you re-apply you may be helping calm the issues they had this time around. I am sure your home visit will be noted in your file, so you will need to help clear up anything you can with the next petition.
    Best of luck to you!!

I have been doing my best to understand this so confusing process hoping to read and not feel so lost when I call DOS they consistently say in AP but today spoke with a lady that said it's not AP but was sent back I posted a copy of what my fiance received his last contact with the embassy and I have contacted the congressman and awaiting response, but we are in limbo because we love each other and I am not wealthy and travel back to him is serious do we marry or wait for the response from USCIS our petition expires 11/18/12 it will be a year and half I have not been near him it's wearing on us we have our ups and downs but mostly ups we complete each other our connection is undeniable just to get through all of this madness, I am curious does anyone know the Consular name the blond lady? as I would love to pursue other avenues we both need to do something to process this rejection I have more options than him as far as voicing concerns, to people who might listen. we understand our mistakes and seek to remedy them I have also applied for the Fioa I mean everything and anything I can do within financial limits as I am currently on unemployment we do have a very substantial sponsor any advice or support appreciated.
