  2. My fiancee put in a petition for a K1 visa in Aug 2011 at the Vermont Service Center. Our 5 months awaiting period is almost up and we are very hopeful that it will be approved.

    I was granted a visitors visa while the petition is still pending. I am currently in the US on holidays with my fiancee

    I live and work in Ghana but the long distance between me and my fiancee is breaking down our relationship so i have decided not to leave her alone again.

    1. I want to know if there is any option for me to process my K1 visa in the US if the petition is approved ?

    2. Can I send my documents to the embassy in Ghana and only go back to Ghana when the interview is due ?

    3. Should I just forget about the fiancee visa and go ahead with our planned marriage here in the US then apply for Change os status as a spouse of a US citizen.

    Im confused, please help.

    How did you accomplish getting approved for a tourist visa to see your fiancee? My fiance is in Ghana and went he couldnt get a tourist visa (3xs he tried). I heard its near impossible to get approved for a tourist visa when they know your significant other is in the states, the consulate told my fiance that he needs a fiance visa. :unsure:

    But back to your original question, as another poster suggested, since you are already here in the states. Get married, withdraw the I-130 and file for AOS.

    If you have decided not to leave then your only option is to get married

    withdraw the K1

    Apply for AOS--fee is about 1100 dollars

    I have to ask...How did Ghana get approved for a visitors visa with a fiance? OMG I am impressed. Please tell me how you did it.

    That was the same thing I wondered too!! How did the OP get approved for a tourist visa! I am also hoping that he shares how he did it!!

  3. Actually, I was told to file the I=130 and then the I-129F so that the spouse can come over while the I-130 is being processed. I assume that is what is meant by the married fiance visa

    :blink: I have never heard of filing both.

    It's either file one for a fiance [i-129f] or one for spouse [i-130].

    In such a situation... presuming it isn't in error...

    Is there any reason not to just begin plans to move to China? Has anyone ever beaten this kind of thing in a period not measured in years?

    When I read the OP post, I wonderd the same thing. If the petition by chance does get denied again after the appeal/waiver then is it possible to move to China and make a life as best as you can with your wife there?

  5. If God forbid your marriage did not work out and you ended up in divorce, would you consider doing this process for a second time?

    I don't anticipate getting divorced in the first place!

    But if God forbid that I would become a widow.. then the answer is NO, I don't want to go through all of this process again.

    And even though it's difficult to go through the process now, I know that it will be worth it in the end.

    Once he is here and we get married then I would think that after all we went through being patient with the process then our marriage will be it and there will be no reason for a Second time around! :thumbs:

  6. Wow! I'm in awe.. ok so I'll hold off on making finally wedding arrangements until his visa is approved. just dont like last minute planning...I'm a little disappointed that our wait might be that long but I'm trusting God that it moves quickly...

    I'm trying to do the same, and it's still not easy and we have to learn patience...It will be a long process unfortunately. :blush:

    I filed the k-1 in October and this whole process will more than likely take up to a year.

My fiancee and I have been friend since 2007, in june 2011 He finally proposed, he tried obtaining a tourist visa to come vist and meet the family but he was turned down in September 2011, so this past december I went to Ghana for his graduation from Ministry College and to finally meet the family now I am back home, and I was wondering how long should I wait before I can file for the K1-visa. Someone told me I have to wait 6mths after his interview date for the tourist visa and another told me to start today. What should I do? I would really appreciate someone helping me, we are planning for a May wedding...

    I would file the K-1 visa, because I also tried to get him over here 3 times for a tourist visa and each time he interviewed they told him he needs to get a fiancee visa. He told me that the consulate said that if he came to the US on a tourist visa that he would not come back :bonk: which was unfair the consulate assumed that he wouldnt, my fiance has reason to have come back to ghana, he has a daughter and property and a business there. But even with all of that, they didnt issue a tourist visa. He wasted time and money filing for a tourist 3 times, and I wished everyday that we would have just gone the k-1 route over a year ago.

  8. You can File Now for a K-1.

    I'm confused what the reason for denial was for a Tourist Visa if you have'nt filed yet.

    Someone told you " 6 months after a interview date and a tourist visa.... There is No interview for a Tourist Visa. Do not File a K-1 and attempt a Visitor Visa. IT SEEMS ODD THAT A TOURIST VISA WAS DENIED. Again, what was the reason for Denial

    File your K-1 and you are very Unreal about a May wedding on a K-1 Visa.

    There are interviews for tourist visas at the ghana consulate in Accra.

    Yes that is frustrating.

    I petitioned for my fiance and his daughter (on a K-1 Visa) he told me that it will prolong the waiting time because he has to do a DNA for her. And I am still waiting on our NOA-2. *sighs* Should we just send for his daughter later? But that will be hard too because I want her to be in our wedding.

    What to do??? :unsure:

    I'm seeing all these people getting approved so fast(20 days is the fastest i've seen) and I don't know what to think. People say get ready for a five month wait, but dayum, when I see these fast approvals(especially for D.R. I-130's) I can't help but get my hopes up..lol. I've seen people get NOA1 early october or early Nov, and approve one month later. As much as I try to settle in for a 5 month wait, it's hard to do that when I see these fast approvals. I got my NOA1 early december so If my I-130 follows along the lines of fellow dominican appliers then January or early feb doesn't seem to far out of reach. Just some thoughts.

  11. Gee, just trying to help the guy! :rolleyes: Sorry if I offended the VJ royalty.

    I am NOT saying he needs all that stuff, but just print it and take it with him. He has ONE day to get this done, and he doesnt have time to do research or assemble some surgically correct amount of data. My intention was to have him throw together as much as possible, roughly organize it, and be on his way.

    I actually agree with your advice, because IMHO its better to have TOO much evidence than not enough!!!

    I am prepared to show that not only do we have a relationship, but that its an ONGOING BONA FIDE relationship!

    So I'm with you on all the heaps of proof. I would rather the CO tell my fiance, 'oh well we dont need all of that' and hopefully will hand most of it back to him, than for the CO to have him reschedule for lack of evidence!! :yes:
