  1. Well, I`m so happy to see everyone`s progress!!!

    I have a little question though, my I-485 and I-765 still does not show up online.... Am I alone??? Got biometrics done yesterday but still can`t get them viewable... Any advice??? Should I call USCIS??? Is calling about this particular matter helps???

    Theres many peoples cases that don't show online its pot luck if it does. Your not alone its ok.

    And even if your case DOES show up online, you don't necessarily get to see any progress! Mine has said the same thing since I registered!

  2. Hey all, just wanted the concerned to know I'm still living- and still waiting for my biometrics appointment. Everything has been on standstill since they got my response to the RFE. Anyway, its good to see so many people making progress on their cases. I'll once again be able to devote some time to helping Rosie with the spreadsheet tracking, as my move is now complete.

    Yay! Kimcorene is back! Hope the move went smoothly and you are beginning to feel settled! I was just asking the other day about your Biometrics appt. Oh well, it'll be around soon enough! The package is in their hands so all we all can do is wait now...ho-hum

  3. We got an e-mail saying that our case is postponed and they sent RFE. I was dreading this day. So I'm all freaked out now, we thought we sent everything right :((((((

    You may indeed have done everything right and it may be their mistake. Just give them what they ask for and you'll be on your way again. It could be something simple as a forgotten signature or out of date form or something. Good luck!

  4. Yes, they file the I-485 and I-130 - if he wasnt to work then they also file the I-765 for the permit. The fees you state are correct. They won't really have anything as bona fide marriage evidence yet, since they aren't married! If, however the spouse is added to Life/Medical/Dental insurance afterwards for instance, they could add a copy. The real evidence will not be needed until the interview but I know that the I-130 asks for it. They could just have a friend write an affidavit stating that they know the marriage to be in good faith. Good luck!

    Thanks...he doesn't have a work permit so she would also need to file the I-765 (EAD)...there is no cost for that since its free with the I-485 correct???...I know with K-1s when you do AOS you would do the I-485 with the AP and EAD...they don't have to do the AP right just the EAD????

    Also, all the forms go in one envelope correct???...and the fees...should she do two seperate checks or one check with the total amount???..thanks a million...

    As an overstay they DON'T apply for AP since if they leave the 3-10 year bar will kick in. And you're right, there is no fee for the EAD when filed with I-485. All forms in the same envelope with two separate checks $1,010 and $355. Wish them luck!

  5. I am asking these questions for a friend. I am going through this process but filing through a CR-1 while my husband is in Jamaica so its not the same step my friend would have to take.

    My friend fiance is here is the states. He came up here on a visitor's visa but overstayed by over 2 years...they are planning on marrying in Dec coming or Jan 2009...she wants an idea on what she would have to do so her finace will become a permanent resident...

    I know she would have to file the i-130 and i-485 correct???...she would also have to pay both fees together meaning the $355 for the i-130 and $1,010 for the I-485 correct???...Are there any other forms she must send with these two other forms????....also what should she include as "evidence" of bonafide marriage beside the marriage certificate???...also will his overstay be forgiven since he did come up to the US legally???...I heard it would be just want to make sure...any input will be great...thanks.... :thumbs:

    I asked this a short while ago since my daughter will be two or so when we have our interview next year. I am in the same position where there is nobody else to watch her - guess she'll be wrecking the interview room when we go 'cos she'll be with us! Good luck!

  7. Thanks for the uplift. I am feeling like I should get my biometric letter tomorrow but who knows. I am going to do the walk in, and if you say the afternoon (for Boston) is a better time to try, then the afternoon it is! Maybe 1 or 2 ish?

    I didn't know that the RFE and Biometrics letter were independent of one another. I foolishly thought it was a whole linear process, where one delay caused others.

    Another interesting fact which I have just learned and is applicable to all if not most people here...

    If you are let's say Canadian as I am, you can leave Canada to reside in another country and claim yourself as a non-resident. If you meet all the requirements, you effectively retain your Canadian citizenship, without benefits say health care, and you are exempt from paying your income tax. This is different than the foreign gains, or foreign income law.

    This is not true with the US. So once we all accomplish our dreams of finally becoming US citizens, we are in effect financially glued to the state for ever. So if me and my wife were to move back to Canada, or Britain, or anywhere for that matter, we would always be paying our taxes in the US. Just thought it was one of the few negatives to becoming American when other than that, all I see is positives. Interesting.

    I'm hoping today brings good news for you! When you go, will you be using public transportation when in Boston? I say that because it's a whole lot easier in the city and the ASC place is very close to the station. (Take a left out of North Station, Causeway St exit...Portland street is about three short blocks on the left...)nbvx

    Yes, this process is certainly an education in itself! I don't see too many negatives either in becoming an American citizen. I always thought that I wouldn't actually do it if the chance arose, but now I think differently. I just can't see myself moving back so I definitely would like to have a voice if I'm going to be here...At the risk of sounding soppy, for the most part this is a great, great country!

    Hope everyone is doing well, congrats on getting notices and biometrics done, you all have gotten a step closer.

    Beatownbabe- any word on your case yet? i know we are around the same time

    I also called the FBI Biometrics department and a nice lady verified my SSN AND NAME, and she told me my biometrics was done successfully completed and sent back to INS.

    SO STILL WAITING ON EAD..most people get EAD exactly one month after biometrics, it will make a great bday gift for me.

    NO WORD YET! STILL PATIENTLY WAITING...

    10/03/03 Package received at Chicago (Day 1)

    10/10/08 Checks cashed per my bank (Day 7)

    10/15/08 NOA's for I-130, I-485, I-765 (Day 12)

    10/20/08 Biometrics appointment notice for Nov 4 (Day 17)

    10/22/08 Notice for RFE showed on online (Day 19)

    10/27/08 Notice for RFE hard copy received in the mail (Day 24)

    11/04/08 Biometrics done (Day 32)

    11/10/08 Sent RFE letter with missing initial evidence (I-693) back to USCIS ( Day 38)

    I am just waiting in frustration for my biometrics letter. I mean #######?! Each day I open the mailbox and nadda. I am feeling like an RFE may be headed my way (knock on wood). Just frustrating. I was hoping for like a 4-5 day wait after the NOA's. Looks like the average wait time on this forum from NOA to Biometrics Letter is 3-4 days. Should I worry?

    No, no news and I'm not expecting it for a while. I'm just trying to keep myself busy while the clock ticks basically! A month after Biometrics would mean and early Christmas present - that would be wonderful! When I look at the timeline on VJ though, it tells me to look for my EAD in Jan/Feb! I'm so curious to know who will get theirs first and how it relates to any interview dates...

  10. Ugh!! Just when I thought everything was moving smooth....our case status on USCIS says that they sent out an RFE on 11/10/08!! Unreal! Anyone have any idea what it could be? I was sure everything was sent in. I don't know. We even received our NOA 1's for both AOS and EAD, and Val's biometrics is scheduled for Tuesday 11/18. I guess we won't know for sure until we actually receive the RFE in the mail. Wish us luck!

    It's amazing how three little letters fill someone with so much dread! R-F-E, ugh! Good luck with it and hopefully it's something minor.

  11. I got my NOA for I-130, I-485, and I-765. But I cant track my case status online with my I-765 EAD. I guess it has not hit yet on the system online or maybe it never will but atleast I got my important ones in. Im not to worred about that.

    But what does concern me is my check for my I-485 AOS ($1010) cleared on 10/7/2008 but not my I-130 ($355) has not to this date. Has anyone else encountered this? I got all my NOA at the same time too!

    I thinking that maybe they didnt need my I-130 from the beginning cause she was already here as a Visitor? Im just really curious what is going to happen with that check if anything. Im tempted to spend it but Im not sure if I should.

    Don't spend the money! I bet that check will cash soon and when it does you'll want to be sure the money is there!!! If your wife was already here, then she definitely needed the I-130 since that's the Petition for the Alien relative (spouse.) Good luck!

    My second $355 check final cashed on the Nov 13th. Two weeks after I send my package in and a week after my first $1010 check cleared. Well thats the good news. Still awaiting my biometrics appointment though. :whistle:

    You can reschedule if you want to - says so on the letter, but I guess it's a better idea to get them out of the way early - why don't you try a walk in?

    Has anyone tried a walk-in in Boston?

    I went in 15 minutes before my appointed time but they let me go in early and I was out 10 minutes before the appointed time... the Boston office is quite quiet... and yes I am from Boston too!

    Wow, it wasn't quiet at all when I was there, it was like a cattle market! My appointment was at 8 in the morning - maybe the afternoons are quiet, infact the people who responded to my thread before said they went for walk-ins in the afternoon. Lots of Boston-area folk here, huh?!
