    What their suggesting u do is illegal because u would be over staying on ur visa. Im guessing ur on a tourist visa. And what ppl were able to get away with in immigration 30 yrs ago may not be able to get away with now. I know of many ppl who have done this in the past and were never found out and it worked. They just over stay until they can change status but immigration nowadays are more strict about ppl overstayingon their visas and if u decide to go through the route ur bf and his family is suggesting and immigration figures it out it will be harder or impossible for u to have a chance to get a visa again tourist or other types. Its big risk to do this. And I don't think u can change status on a tourist visa. Im not sure.

    Getting the NVC case number can take 2 to 4 weeks.
    Once you get NVC case number in the mail, you will also get (1) choice of agent form and (2) documentation on how to pay for AOS (Affidavit of Support) fee online
    #1 Choice of Agent Form
    Your wife probably got the choice of agent form. If not, scan in your copy, email it to her, have her print and fill out the form, designating YOU as the agent (you are in USA, it is better this way as mailing time is less), SIGN the form, and mail it to the address the National Visa Center gave. And don't panic if the form is out-dated, they will accept it (after all, they sent it to you)
    #2 AOS fee
    Go to the website they give you, log in with your NVC number and invoice number (which they will give you), provide your routing number and checking account number (if you are paying by checking account) to pay the $88 fee. They will provide you a cover sheet to print out and include on the very top of your AOS package. This coversheet has the NVC code and name of petitioner.
    Once the AOS fee status say PAID, only then you should mail it in. It took me about a week for AOS to display PAID, even though my bank says it was immediate.
    In the meantime gather photocopies of Federal taxes (include W-2 and 1099 forms), or request the IRS to give you Federal tax transcripts for the past three years (in this case, you don't need to include the W-2 and 1099, just send in the transripts).
    Also, provide a letter from your employer stating your SS#, Name, Date of Hire, Salary. And also include the last six paystubs.
    Even though I-864 (actually, I filed I-864 Ez) said that I only needed to provide last year Federal taxes and other info was optional, I provided everything (three years tax, proof of employment letter, last six paystubs).
    It is better to provide more information and take your time doing things, than to send in your package, only for it to get delayed because NVC wants more info.
    And you want to make your documentation easy to read, right after the Cover Sheet, you should write a cover letter stating the contents of your package. And I would buy tabs to label what is where, i.e. put a tab on the I-864, a tab on proof of employment, etc. I used something like this to hold my pages together,
    Keep checking the online payment website for when they ask for IV fee, $230
    Right now, I am in the process of having my hubby gather the appropriate documents from India
    1. Notarized copy of birth certificate in English
    2. Notarized copy of passport
    3. Two identical passport photographs of him
    4. Police letter (this he will get at the end, since they expire in 3 months, at least in India)
    And I am also asking Hubby to check whether I filled out the DS-230 properly

    Election to File Joint Return
    If, at the end of your tax year, you are married and one spouse is a U.S. citizen or a resident alien and the other is a nonresident alien, you can choose to treat the nonresident as a U.S. resident. This includes situations in which one of you is a nonresident alien at the beginning of the tax year, but a resident alien at the end of the year, and the other is a nonresident alien at the end of the year.
    If you make this choice, the following rules apply:
    You and your spouse are treated, for income tax purposes, as residents for all tax years that the choice is in effect,
    You must file a joint income tax return for the year you make the choice, and
    Each spouse must report his or her entire worldwide income on the joint income tax return
    If you make this choice, you and your spouse are treated as residents for your entire tax year for the purpose of your federal individual income tax return, and for the purpose of withholding U.S. federal income tax from your wages.
    Example:
    Pat Smith has been a US citizen for many years. She is married to Norman, a nonresident alien. Pat and Norman make the choice to treat Norman as a resident alien by attaching a statement to their joint return. Pat and Norman must report their worldwide income for the year they make the choice and for all later years unless, the choice is ended or suspended. Although Pat and Norman must file a joint return for the year they make the choice, as long as one spouse is a US citizen or resident, they can file either joint or separate returns for later years.
    How to Make the Choice
    Attach a statement, signed by both spouses, to your joint return for the first tax year for which the choice applies. It should contain the following:
    A declaration that one spouse was a nonresident alien and the other spouse a U.S. citizen or resident alien on the last day of your tax year, and that you choose to be treated as US residents for the entire tax year, and
    The name, address, and social security number (or individual taxpayer identification number) of each spouse. (If one spouse died, include the name and address of the person making the choice for the deceased spouse.)
    You generally make this choice when you file your joint return. However, you can also make the choice by filing a joint amended return on Form 1040X, Amended U.S. Individual Income Tax Return (PDF). If you make the choice with an amended return, you and your spouse must also amend any returns that you may have filed after the year for which you made the choice.
    You generally must file the amended joint return within 3 years from the date you filed your original US income tax return or 2 years from the date you paid your income tax for that year, whichever is later.
    Social Security Number
    If your spouse is a nonresident alien and you file a joint or separate return, your spouse must have either a Social Security Number (SSN) or an Individual Taxpayer Identification Number (ITIN). To get an SSN for your spouse, apply at a social security office or US consulate. You must complete Form SS-5. You must also provide original or certified copies of documents to verify your spouse's age, identity, and citizenship. If your spouse is not eligible to get an SSN, he or she can file Form W-7 with the IRS to apply for an ITIN.
    ITIN
    An ITIN, or Individual Taxpayer Identification Number, is a tax processing number only available for certain nonresident and resident aliens, their spouses, and dependents who cannot get a Social Security Number (SSN). It is a 9-digit number, beginning with the number "9", formatted like an SSN (NNN-NN-NNNN).
    To obtain an ITIN, you must complete IRS Form W-7, IRS Application for Individual Taxpayer Identification Number (PDF) . The Form W-7 requires documentation substantiating foreign/alien status and true identity for each individual. You may either mail the documentation, along with the Form W-7, to the address shown in the Form W-7 Instructions, present it at IRS walk-in offices, or process your application through an Acceptance Agent authorized by the IRS. Form W-7(SP), Solicitud de Número de Identificación Personal del Contribuyente del Servicio de Impuestos Internos (PDF) is available for use by Spanish speakers.
    Acceptance Agents are entities (colleges, financial institutions, accounting firms, etc.) who are authorized by the IRS to assist applicants in obtaining ITINs. They review the applicant's documentation and forward the completed Form W-7 to IRS for processing.
    NOTE: You cannot claim the earned income credit using an ITIN.
    Foreign persons who are individuals should apply for a social security number (SSN, if permitted) on Form SS-5 with the Social Security Administration, or should apply for an Individual Taxpayer Identification Number (ITIN) on Form W-7. Effective immediately, each ITIN applicant must now:
    Apply using the revised Form W-7, Application for IRS Individual Taxpayer Identification Number; and
    Attach a federal income tax return to the Form W-7.

    Ok, so here is something that I'm wondering also. This may only be the case for Morocco. Say you decide to file married jointly and claim your spouses income after getting an ITIN number. How do you prove your husbands income, as we all know too well , for the most part there is no paper trail in most jobs worked in Morocco. People are paid in cash .

    First if you kindly fill in your timeline you are helping others on here...
    And as you state on your signature with only filing on August 25th 2012 you still have a long way to go to be so "tensed" and upset...Your complaints dont seem warranted compared to the many others that have gone through much more or are still waiting.

    Interesting, I had a tax accountant doing my taxes last year. As my wife never lived in the US and also does not have a SSN or TIN, he told me to file as single.

    i feel your frustration..but being patience is the only way to get thru this.. it will take longer with the holiday's coming up.. all one can do is wait.. we are all waiting... and waiting.. and waiting.. and waiting.. hang in there.. we all feel your pain..

    I agree Teague...at the same time, I believe that just like every place of business...you have slow ppl that just take their time and find things to do other than staying focused on their responsibilities. Then, you have dedicated workers that run circles around these ppl. What I would like to add as a light at the end of the long tunnel is something I read several weeks ago from a former USCIS agent. That is that everything they do is monitored and that includes their productivity. So, the non-dedicated workers will be weeded out. Our case is at the Vermont office and I reviewed the # of cases they rcvd during the time that they rcvd our. They really got there butts kicked! Recently, they were 3 months behind processing and now they are about 1 month behind because they are getting help from other offices so they can get caught up. Hope this helps to shed some light.
    However, we are tortured with these long wait times and that's the bottom line! One hour feels like a whole day!
    All we can do it hang in there. It seems that these inquiry tools that they 'provide' us are just a pasifier and offer no real solutions.

    How do you and your fiancee communicate (aside from chatting) if you can't speak English? Be prepared to answer that one if you, in fact, cannot speak English.
    Telling the CO to find that information for him or herself will be like shooting yourself in the foot. "I don't remember" isn't a good enough answer. If you have the chat logs, read them and find that answer for yourself. Don't be lazy. Do you want the visa or not?

    I don't see how this film has anything to do with this? Some Muslim nut in Pakistan can make a porn movie about Jesus having sex with underage children. I doubt you'll see RPGs fired at the Pakistani embassy in Washington..

    Well this has finally changed my views. It used to pi$$ me off the way Israel treated Palestinians. Now I could care less about any Muslims in the middle east.
    You save a country from a 40 year dictator, and then instead of sending a cake and saying thanks, they send RPGs. All over a bad movie no one would've ever watched. Now they've just guaranteed that millions will see that bad movie.
    Time to pull out of Afghanistan and any other muslim countries NOW! Let them go back to killing each other.

    I can't speak for all Nigerian men, but as for mine, I would have to say what I found in him that I did not find in the American men I have dated is the respect for family and marriage. My fiance is very caring and sensitive when it comes to me and how I feel. He listens when I talk. He can remember things I have told him months ago just in a passing conversation. When I walk down the street with him, I NEVER once saw him glance at another woman. I feel like I am the only woman on earth for him, as it should be.
