  1. Make sure you know under what rules you're doing it, though. I definitely went in because I knew it would work. I just can't remember the exact process. It may be that if you have submitted the EAD application and are still waiting for adjudication you can force their hand and make them adjudicate right away. It was ten years ago and my memory isn't fantastic ;)

    Lol thanks. I have to actually mail in the EAD and AOS tomorrow. I guess he will have to wait a little longer to go to work. School will be the goal for now then.

  2. Years ago I was on a TN and applied for the greencard. As part of this was issuance of the EAD. I was caught in the unfortunate scenario in which my TN was about to expire but the applied-for EAD had yet to arrive. One morning I took a two hour drive to the closest immigration center and applied, given the above, for an EAD in person. I cannot remember now exactly what process I used, but I ended up getting an EAD issued to me that very day. My original one came through about two weeks later in the mail anyway, but I wonder if it's available to you a similar scenario. I was employed at the time and this allowed me to be legit without any hiccup in authorization.

    This is worth a try. I like the idea of just going in and trying to apply in person. Thanks

  3. I hope I am just being paranoid, but I think I may have left out some things from my AOS package. I filed for my wife who recently arrived on a K-1 and we have since gotten married.

    I only sent one copy of everything that was required (I-94, passport, copy of K-1 visa, etc...) and I just realized that the I-485, I-131, and I-765 are all separate applications.

    So, for example, I only sent one copy of the I-94 with the whole package, but on the instructions for the I-765 and I-131 they each require a copy of the I-94.

    Same goes for the photos and copy of passport. I only sent 4 passport sized photos, and only one copy of her passport and K-1 visa, even though each application requires its own.

    I hope this makes sense. Anyone have experience? How many copies of each required supporting document did you send?

    Good question but I think you only need 1 copy for the entire package to go along with the other I-.....applications if you are filing them at the same time and not separately. I'm about to mail out my AOS packet but I will wait to see what others have to say on the topic.

    I am looking for suggestions on how to thank my State Rep and the assistant who countlessly checked up on my case until it was finally approved. My state reps office is close to my home. Should I write a heart felt letter, send a fruit basket with a card or just a simple email? Any suggestions would be welcomed.

  5. I applied for a K1 Visa I129F followed the instructions here (thank you!) Sent it on 9/11/2013 with Checked cashed on the 12th and an SRC number assigned 09/13 from the Texas.

    Today i received my (5) 4x6 color photos returned stating that they cannot support my application/petition with photo pictures. They are standard pictures in the format stated in the guide here.

    Anyone else had this issue?

    That is strange...

    Have you gone to the advance search tool to see if there are others in the same predicament as you and the reason why they were returned. It's worth a try to check it out. yes.gif

    Sounds like you did send them in correctly in a bag and specifics written on the back..not sure why they were returned. That's how I sent in mine as well.

  6. Judging someone on whether they're newer than you or not can be hit-and-miss. They might well be wrong, but on the other hand they might be a quick study and have learnt the basics of their process quickly and somewhat accurately. I like to think I've fallen into the latter category given I didn't start offering any detailed advice for a good while until I'd had time to read some veteran responses. Even then I stick to K1 stuff and leave other processes to more knowledgeable people.

    That said? You're right. A lot of the veterans do look down upon those of us who need a bit more help at times but that said, I personally get annoyed with some people who want their hand held for the entire process. There's one person in the UK forum (and you might tweak as to who I'm referring to) who has posted a separate topic asking for help every single time they come up against the most minor of obstacles like "how do I answer this field on this form". If they aren't going to get it now or try and use a bit of logic, they are going to have a hell of a time doing AOS, ROC and then Naturalization.

    Asking questions is a good thing, all said. It's the key to understanding which then leads to knowledge. The trick is knowing when to ask the question to yourself and find the answer via your own means - or when you hit a brick wall when to ask out loud and understand that way. Once I was told "You don't question this veteran". But if we don't question either to ourselves or openly, it gets harder to understand and then eventually help others ourselves

    yip I call it spoon feeding ... all too often especially when there are many here who have found most of their answers in a good way either here or there on their own

    I definitely agree with you both regarding the amount of questions coming from one individual during the process...It's like a question a day about the each step to take.

    FWIW, I'm a fan of the advanced search tool.

    I also rely heavily on the advanced search tool. That is the closest I get to getting answers to my Visa questions. I must say though if you really want help from the ones who know best you must IM directly on VJ. I have also done that and received many responses regarding my issue. Sometimes the guru's don't know you need help unless you reach out to them.

    LOL...sometimes it feels like no one cares about you or your question/country....unless they are from your country and again if they are from your country they need just as much help as you....Unless...they are a senior member and they are amongst the true veterans of VJ.

  9. You would be better off calling and talking to them. That information can only come from the horses mouth.its in your best interest to double check this with them. since you don't want another denial. No one can tell you what information they have unless they work for uscis.

    An inquiry has been done. I am waiting on their response. I have read many threads on here regarding similar issues regarding NOIR's and the info is conflicting...just looking for opinions.

  10. I have a question for the recipients of all the awesomely fast NOA2 approvals thru CSC lately. For those that have already been approved, first of all YAYYYYYYYY!! So Exciting!! Can't wait to join you all in celebration soon!

    My question is: was your case pretty straight forward, meaning no previous marriages or children involved? Or were they more complex cases (as is mine) involving divorce decrees etc. I am a July 31 NOA1 filer and was just curious is all rolleyes.gif

    So excited to see that we are up to 39 NOA2's for July filiers!!!!!!! This is AWESOME!

    I'm not too far behind you as far as filing but it will be interesting to see how my case gets handled, since this is the second time around....involving pesky divorce decree...ugh!.

  11. Hi VJ'ers,

    Filed 1st K-1 in 2010, denied due to improperly registered divorce decree by petitioner. Re-filed 2nd K-1 front loaded petition along with a statement regarding 1st denial and how the situation has been corrected. Submitted new properly registered divorce decree. While awaiting NOA2, I get 2 letters same envelope today 9/5/13....They are both in reference to the prior K-1.... dated October 30, 2012 from the embassy in Haiti Intent to Revoke based on fraudulent documentary evidence (divorce decree), sham relationship for immigration purpose (unable to marry if divorce is not valid)...blah, blah, blah.

    The second letter dated August 30, 2013 from USCIS informing me that I-129 petition (1st K1) was returned to them and will now be closed because it is no longer valid...."This action is without prejudice to the filing of any future petitions or application"

    Now my question is how will this affect the new K-1 currently in progress?

    Will they put a P6C marker on the file because of the NOIR?

    Would anyone agree to say I received the NOIR because of the new filing?

    Any suggestions will be appreciated.
