    What was the crime? Being sentenced to community service satisfies the maximum sentence provision of the exclusion, but we need to know what was the maximum penalty they could have imposed? If the maximum penalty they could have imposed is more than one year then he wouldn't qualify for the exclusion.

    CIS doesn't have to manufacture evidence of anything. Adjustment of status is discretionary. They can deny if they don't believe the relationship is genuine.
    Your wife is from a communist country, so political views can be very relevant. If they suspect you were a communist or communist sympathizer then they would suspect your wife was the same. Someone who is or was a member of the communist party is inadmissible to the United States. My wife is also from a communist country, and I've seen people from her country put through the grinder at the consulate because they had a brother or cousin who was a party member. It's very common for USCIS to assign IO's who are from the same part of the world as the beneficiary because they would understand the culture, and they would be able to "read" the beneficiary in a way that someone born in the US would not.
    Try to put your emotions on the back burner while you go through this process. The IO knows he holds all the cards in this game. If they detect any attitude from you or any sense of entitlement then they'll put you through hell and ultimately deny you. You need to approach this with the attitude that you're asking the US government for a favor, and you need to convince them that you deserve to have this favor granted. If you act like you're demanding your rights (you have no rights in this situation) then they'll drop the hammer on you. Cool. Calm. Collected. Determined.

    That is really why you wasn't offer the job, not a good fit for the company image. It showed thru, when they interviwed you. Try another company with a better attitude.
    The person that gave you the information, does not make HR rues or policies. Therefore punching him will not solve your problem, hiring a lawyer to work at "Papa John" is a bit much. Try hiring the lawyer to fix or correct your immigration status, so you will not have these issues in the future.

    I can honestly tell you that if you question that someone loves you, the answer is NO they do not. When someone loves you, you will not have to ask, you will know it. You are thinking you have done something wrong. You can not make someone love you. They either love you or they don't. There is someone out there who will love you.

    I strongly suggest to you to not appeal, and just wait for the next 3 years to give it another shot, you've already miss represented yourself after not disclosing your shoplifting incident, not only will you dig the hole deeper for yourself but you will also bring yourself in front of USCIS infamous radar. You're lucky they did'nt take further action with you for not telling the truth on N400 form. withholding information from USCIS is misrepresentation and these guys has 0 tolerance for that.

    I think in most cases, an unemployed beneficiary would NOT qualify for an expedite. In many developing countries, many beneficiaries are unemployed. Many have requested an expedite based on severe financial loss and have been denied.
    You can certainly try and request an expedite. But IMHO, I don't believe it will be granted based on this situation.

    One of my friends just recently got her U.S. citizenship and she said the main two reasons she did it was that she can now vote and work in the government. There are probably many more reasons but I don't see the point in giving up your citizenship if you don't want to. Why not just stay a permenant resident?

    For me it is just very SIMPLE. If they ask for your wife's green card..then why not provide them a copy of it?? WHy make things complicated when it is so easy to solve the issue.

    What exactly does your friend need, her husband treats her well, then if she thinks that her husband has another woman then she needs to investigate and talk to her husband about anything about the marriage or seek marriage counseling, there's no abuse involved here so there's not much advice except for your friend to try to work things out with her husband. VAWA is not an option because cheating is not abuse.

    Hello! Why does it matter whether he is African American or Caucasian? Does that matter in this situation? Why did you even have to bring his race up? Is it your friend or you that needs the advice? At any rate, she should know if he has another woman or not nobody on here can help her. She needs to follow him and see what he does when he is not at home or just come out and ask him.

    Amazing news for all---
    With our case, I had recently moved from Chicago to Texas for a job at the end of July. After much fighting for justice on our case, I was able to obtain the fax number and mailing address to the Chicago Office in which I received my denial notice from. I drafted a letter explaining the situation and sent it to the office along with my wife's birth certificate and copy of the denial letter. We faxed and mailed it and surprisingly today, I received a call from an immigration officer at the Chicago Office who said there was an error in the denial of our case and they re-instated it and will be transferring it to the Dallas office.
    Come to find out I had an interview scheduled for August 1st which they say I failed to show for. However, I did not know about this due to moving. They were able to obtain the AR-11 showing my change of address that was dated in the middle of July and realized it was an error that we got denied. AMAZING NEWS!!!

    You won't be detained by ICE unless you have an encounter with them. I'm a US citizen, and have lived in the US my entire life. The only time I've ever seen an ICE agent was when I was at the airport or going to Mexico. It's not like these people patrol the streets looking for illegal aliens.
    DHS policy is to NOT initiate removal proceedings against someone who is eligible to adjust status. In the relatively rare event that you do end up being detained by ICE then your husband will need to convince them that you entered the US legally and married within the required time, and that you're now eligible for adjustment of status. This means you should keep your passport and a copy of your marriage certificate with you. Once you file for AOS then keep a copy of the NOA receipt notice with you.
    Don't worry. A lot of people postpone filing for the AOS because of financial problems. Very few ever have problems because of it.

    Above is incorrect. If you are a US citizen and have lived in the USA for 5 years, your child is a US citizen too. You need to report the birth to the US embassy in Manila and get CRBA b(Consular Report of Birth Abroad), so he can get a US passport: http://manila.usembassy.gov/service/citizenship.html

    I agree with you 100%. I honestly don't think Mathilda posted this to piss everyone off...I really don't think that was her intention. And I usually stay completely away from negative threads like this because it's does Visa Journey no good and reaps no benefits at all...but I will say this much: the post made by "MHTA" about Ironman being a douchebag and a scumbag was completely and totally uncalled for. If I were an administrator for this site, I would completely delete MHTA's profile. That's really, really pathetic. WOW
