    Tell your wife to go ahead and call US immigration.
    She can not withdraw her sponsorship even if you divorce.
    Tell her if she tries to f... you over, you will get means tested benefits that she will legally have to reimburse the government for because of the binding I-864.
    In fact, you can get 125% of the poverty level from her based on the I-864 as support after the divorce.

    Absolutely heart wrenching . I can only imagine how frustrating this has been. I hope they are able to just have the decency to expedite your green card and have that mailed out instead.

    A letter of intent which she has signed. A relationship which she says she wants to continue for a lifetime, which makes it hardly clear at all that she does not wish to marry, see post #5. People get cold feet when things get close. There is nothing in your position or this situation which comes even close to meeting the legal standard of fraud. If you were to say its your opinion its a bad idea, something that I'd agree with actually, you'd be fine. But you're throwing around the word fraud, which has legal definitions and standards that just are not there. If he enters on the K-1 still with his intent to marry, and leaves if it does not occur, there is not the slightest way to call this fraud, as his intent is all that matters.
    One big factor in order for fraud to be true, is their must be a victim. There is no victim if he comes to the USA on the K-1 and attempts to convince his fiancee to marry. In fact about the only victim in this entire case is himself, who after going through the process, paid for the ticket, and quit his job, now finds his fiancee has gotten cold feet. If anything, it is his fiancee who comes closest to having committed fraud.
    Sure there is no doubt a lot more we do not know about, as rarely we do, but this is hardly a case of fraud on the OP's part.

    You can disagree all you want, but if he enters the country in order to convince his fiancee to change her mind and go forth with the wedding, he will have broken zero laws. If he fails and returns home there is still no law broken. Fraud would occur if he had no intent what so ever to marry, or never did in the first place.

    Congratulations...if you're specific on the country in question you may get more hints as well as embassy specific requirements and red flags. Africa has more than 50 countries the last I checked...

    Cold feet before a wedding, and then still getting married, happens all the time. The question is why she has cold feet. 30 minutes on Skype is not enough time to resolve some differences. Some things have to be resolved face to face. He already spent the money on the ticket....that ship has sailed. If there is a chance to fix it, I think he should.

    Most women are quick to anger and then try to resolve issues when the damage has been done. Get on the plane and go see her but stay in a hotel. Get in touch with her and have a face to face and let her sleep over your discussion. If after 72 hrs you guys can't resolve the issues then leave her in peace she was never worth your stress in the first place. Please DO NOT grovel no matter what you do. Good luck

    No worries babe I have also told my husband same thing and we fight all the time call her bluff and tell her u have cancelled your flight and i bet u, she will be hurt to her soul, its just the distance is hurting you two love birds, me and my husband are right now going through the exact same as I type, lol she did not go through all this and the long wait to cancel, its not easy, plz go to her and make her remember why u guys love eachother so much, GOD BLESS YOU BOTH and congratulations, we r still waiting cant wait till my day come, so when u come u can fight with her here and makeup here it will be well worth all the long distance fighting ;-)

    Everyone argues... dont understand why some assume that marriage is a fairytale and everyone has to be perfect... biggest lesson I learned is Forgiveness and you have to let go of wrongs if forgiven. I been apart from my Husband for almost two years. I think after she cools off and you explain to her your feelings maybe she will come around. Let her know this is your chance to be together and if you dont get married now, later if you try it will be harder process, and longer. Good luck and I hope this can be worked out.

    Am so sorry this is happening to your relationship. I don't have experience with K1 visa process and I don't have knowledge about K1 visa cancelation but my advise is that you should reshedule your flight and get on the plane to save your relationship. I know what it feels like to be seperated from loved one, am speaking from experience because some times I feel like ending this process myself because the distant is so frustrating. Go and meet your sweetheart and try to solve everything face to face, if she doesn't want to push thru with the relationship and wedding, then you should return back to your country.

    Being a jerk of a guy is not the same as being fraud.... He can file for removal of conditions without you based on good faith marriage so no reason to pull the VAWA abusive spouse thing... Send his daughter back, divorce and change the locks if it is your house... As I can see, it is more if a case of him being an a$$h0le not fraudster... Sorry but time to pick up,the pieces and start fresh.

    Either way he's a complete a**hole. I feel sorry for you, OP. I don't think you have a case for fraud though.
    Most of it is anecdotal and it's not a cut-and-dry running away from marriage a week after getting GC kind of situation.

    I disagree with previous posters.
    If it was fraud then why would he say he wants to go back to his own country?
    Being a bad husband doesn't make it fraud.
    Possibly being a cheat doesn't make it fraud.
    It only proves he's a jerk.
    If the marriage is over then let him go back to his own country and both of you can move on.

    Her length of stay is determined by the CBP officer at the point of entry. The maximum allowed stay is 6months per visit. Wishing your mum a speedy recovery.
