Don’t get despondent. 35 days is early. Anything could happen. Take is easy and don’t beat yourself over mistakes. We all make then. Ultimately if your marriage is bonafide and you were truthful, at some point more likely than not, you will get an approval even if it requires answering an RFE and second interview.

    Cheers

@Family thank you for the detailed response, yes I do believe he was assigned my case coz of his experience in the military and Afghanistan. At the interview he questioned me if I was in Bagram ( where he was) and I told him no that I was in Kandahar Airforce base southern Afghanistan while Bagram was north of the country . I explained to him how I was hired and where exactly I worked and my job title as a TCN & the officer was in disbelief and continuously rolled his eyes at every answer I gave. The officer literally doubted my phone number as there was a digit off for some reason in his records …we went back and forth for 2 minutes attempting to clarify something as simple as a phone number…in one of the N400 questions there is a part where the question asks have you ever served in the military…that’s when he asked me if I would like to change my answer from NO to YES..which I refused and he stated “I am giving you an opportunity to be honest “…he repeated that question a few times after I said no and that’s when my lawyer jumped in.

Also should I wait or I can ask my lawyer to write a letter with your recommendations?

Yes I am familiar with it. There is a difference between active theater and an installation at peace. Afpak POSTCONTSTAB was a threat induced environment. But that discussion is beyond the scope of our issue at hand. Lets focus on how your issue can be resolved. As I stated before, agency-specific background checks are limited in scope because they basically run on NCICISII (National Crime Information Center Interstate Identification Index) and legacy IAFIS (Integrated Automated Fingerprint Identification System) apart from IDENT or DHS local. These databases are repositories where fed and state along with international partners contribute information along with pre-approved "Wants and Warrants" features. However "Visa Donkey"  kind of request would reveal a comprehesive amount of info. But they are full of outdated and wrong information as well.

US Gov maintained a comprehesive record of all contrators in Afghanistan ranging from 2002 to 2021. I believe the officer questions your credibility and the main faultline appears to be your time in Afghanistan. FOD has very limited say when it comes to adjudication oversight because their role is operational. It is the officer who who has authority vested by the laws to adjudicated your application. I would be gathering paperwork to overcome any allegations.  If you have anything to support your position, it will help you resolve your case sooner. If I were you, I would reach out to Dynacorp or do other opensource searches to supplement my position. I wish you sort this out because at the end of this exhausting immigration journey, we all get so tired and simply wish a happy ending. Good Luck my friend!

@Mike E I entered USA on immigrant visa which my ex sponsored but we divorced. This interview was for my naturalization . My current wife petitioned for my GC and conditions were removed last year

@Family thank you again for the resources, I now understand where the officer was coming from irrespective of the badgering at the interview… it has been a long /expensive and difficult immigration journey and most people have mentioned that the naturalization process/interviews are fairly the easiest part…I pray I will have favor with USCIS and get approved . It’s day 35 after the interview and my lawyer has advised me to wait for updates from the local office as they had already reached out to the field director with a statement of what transpired at the interview and the director apologized and is looking into it personally…don’t know if that’s a good sign or just another “dear John” statement…I am so confused, worried and stressed about all this it’s eating me alive. Thank you so much for your prompt responses …

When you are represented, you don’t have much choice other than trust your attorney’ s strategy and skill….although a non confrontational approach would have been to ask the officer if he advises that a change is required…and if USCIS takes the position that your engagement was of a military nature, you are willing to accommodate as long as there are no stolen valor  or misrepresentation implications. So even a simple question like “ What do you think I should do, Officer? “ would have allowed further dialogue.

The idea being that it is more valuable to understand and address an officers concerns, even if it means checking every digit of a phone number…fellow is being thorough  …because honestly I believe the vetting is to make sure you were / are an ally, not a foe…that does occasionally slip through the cracks , as they say.

So, it’s really up to what your legal rep advises you to do.

Margaret Stock is the nation’s leading immigration attorney on all things military/ naturalization and national security ….and a better source for a worthy second opinion

What should i expect after a rough n400 interview with a junior officer & got decision cannot be made?

did my N400 interview with my wife present in the waiting area & had a rude & condescending jr officer. Interview took around 45 minutes, I passed the civics and english test & the officer accused me of being in the military, i explained i worked as a TCN( 3rd country national) civilian contractor in Afghanistan as a logistics clerk prior to me ever coming to the states), the officer being a military vet himself did not understand how i was in Afghanistan and not be in the military and accused me of being in the same military base he was in Afghanistan i explained to him the base i was while employed in Afghanistan as he argued that on my A file i have a photo of myself wearing US military uniform(which was a screenshot of a message with my ex) i explained to him that on that instance i was casted as an extra for a film production locally here in my state playing a military guard, which he denied that answer and asked me if i would like to change my answer and admit i was in the military and i promptly said no as i have never been in the military. My attorney interjected several times for the badgering and the interview was stopped and handed decision cant be made. Online status still shows interview scheduled and it’s now 35 days…any thoughts on what to expect, are they doing additional background checks ??

@Crazy Cat … I was casted as an extra for a film studio in my state playing an embassy guard and being in time I played and wore military uniform…I used a thread of text conversation as evidence and that military photo was part of the the text thread.
