  1. I'd pick ''Immigrant'' for the purpose of mailing the documents. It needs to be sent to the IV Unit... But technically K1 is classified as a nonimmigrant visa as it ''only'' allows you to travel to the U.S. to marry within 90 days. What allows you to stay after that is filing for AOS and obtaining your green card.

  2. K1 visas are valid for 1 use only and void on entry. The February 11 date on yours was the end of the 90 days limit within which you had to get married.

    When you file for AOS after marrying within 90 days of your activated K1 visa, you enter a phase of authorized stay. However you cannot leave the U.S. without abandoning your petition unless you have received your AP and have never overstayed.

    Now you just wait for your Notice of Action and your biometrics appointment.

  3. Sorry you have trusting issues. If your husband does not feel comfortable with some things, you can consider other options. Your name on the house (or mortgage) is not mandatory but nice. I know some times to add a name, you would need to refinance which can be a hassle. You can share other joint property: car, furniture, etc. If he doesn't want you on his current checking account, you can create another one that's joint.     Among other proofs of a bona fide marriage, you can have both your names on utility bills, same address on driver's license, he adds you as a beneficiary on his health insurance, you are both insured on your car(s), etc.

    I believe those are all decisions that should be discussed in a couple and not decided entirely 100% by one or the other, but that's me ;)

  4. I'm pretty much ready for my AOS interview coming up but I have one question...

    Back before my husband and I applied for a K-1, I was coming to visit him in the U.S. and ended up having to withdrew my application for entry. I was going to visit for a couple months and the customs officer at the time thought my return flight ticket and travel insurance coverage for the time of my stay were not sufficient proof that I was going back home after visiting. We were then engaged but hadn't applied for a K-1 yet. This was barely brought up at our K-1 interview and the IO was unconcerned and said it happened often. We were approved without a hitch.

    Has this also happened to any of you and how did it impact your AOS interview? Do I have to prepare anything relative to that incident for the interview?

    No, it won't be a problem. They often have to renew those, especially Montreal because they're so slow.

    Don't be surprised if you get the secondary questioning routine. You having a fiance in the U.S and being in the visa process might make you look suspicious to some officer's eyes. In any case, do not lie. Make sure you bring evidence of strong ties to Canada when you go visit in the U.S (lease, rental agreement, letter from your boss saying they expect you back by X). And if possible, bring your appointment letter with the consulate to prove you don't plan on staying in the U.S illegally and have to go back to attend your interview.

    For the application, you just send the required forms and additional support documents listed. You might want to send a couple wedding pictures, but you save the real evidence for a potential interview request.

    Should you have an interview, you will need to prove you are in a legitimate bona fide marriage. That means anything that proves co-mingling. Lease agreement or mortgage with both your names, photos of the wedding, pictures of the 2 of you since the wedding, tickets or receipts if you've been taking trips together, joint bank account statements, same address on driver's license, both your names on health/car insurance, bills in your name, letter from employer saying you are on your spouse's 401k and emergency contact list, letters from friends, any kind of cards from friends you might have received at your new address, etc.

    You keep all those for the interview. If you do get one that is. Your relationship has been proven at the K-1 stage so you shouldn't have any problems really.

    I did Medisys too. No complains about their service.

    You could plan to spend a few days in Montreal and have your medical and interview done on the same trip. But you must allow 3 business days before you can go pick up your results. It is 10 min walk to the consulate. If you walk slow ;)

  8. Tip for you: You can try to do both your medical and interview on the same week but should allow 3 days for your medical to be ready for pick-up.

    That being said, if you test positive to anything, results will take longer. But they would then give you a sealed envelope to take to your interview and you would have to mail in your medical to Montreal as soon as you get it. If you do have to do that, take into account your package will sit in their mail room for 3 weeks before they do anything with it and it will delay your visa issuance. But your interview would be done with and either way it would save you having to make 2 trips to Montreal.

  9. One thing to do if you are considering having your child in the U.S., double check with your fiance's health insurance plan. Once married, he can add you to his coverage but some insurance companies won't cover a preexisting condition, pregnancy included. An out of pocket birth in the U.S. would be VERY expensive.

  10. I don't think there is much to do but wait. The 3-4 months wait time seems very optimistic to me. And your interview, if you have one, will be done locally so it depends how backlogged they are in your area.

    My AOS appointment is scheduled for February 9th and I applied for AOS last July. I'm right on the 7 months time frame from application to interview. See my signature for my timeline.

  11. As Inky and Rayoflight said, most people never receive their Packet 3 from Montreal. They're notoriously backlogged. I received mine after I scheduled my interview. From the moment DOS tells you your Packet 3 instructions were mailed to you, just go ahead and mail your Packet 3. Give them 3 weeks then start calling DOS to see if they received it. Once they did, Send your Packet 4.

    TammyandJosh, the DOS clerk is wrong, you won't be able to reach Montreal's consulate. Their answering machine is an endless loop message and they rarely reply to email requests. If your instructions for Packet 3 were mailed to you, go ahead and mail it to them. What they mailed you is exactly the same thing as you'll find on their website.

  12. Risky, yes.

    It could easily take more than an hour to process you in secondary. It all depends how many people are in front of you, how accustomed to the procedure the POE officer is and if it's a busy day. Pretty sure Greyhound won't be waiting for you. Should you choose to do it you would need a plan B. Can you catch the next Greyhound bus that same day?

  13. I use Vonage too (World Plan: unlimited calls to 60 countries, $35/month). Just got it 2 months ago. You can keep your phone number or choose a new one in your area code and travel with your adapter. It comes with voice mail and a couple other cool features. Best part is: it's paid by work :D

    Before that I used a calling card.

  14. Congratulations to all who were approved!

    My field office must be very slow. I haven't heard anything since my biometric appointment mid August.

    I tried calling USCIS for a case update (nothing shows on website) but I can't seem to find how to talk to a human being. Any of you know how? Should I rather make an Infopass appointment? It's been 4 months and 17 days now since my NOA...according to their timeline, it should be processed within 4 months.

    What should I do?
