Hi there,

So we've finally gotten an rescheduled interview, we're plaintiffs in Milligan v. Pompeo.

Its my understanding London rarely asks for evidence of relationship. Has anyone experienced anything different? Would the fact that we are in current litigation to even obtain this visa be evidence enough of an ongoing relationship? He has photos of my most recent visit in June, but is it necessary to print off any more recent communication between us?

Additionally, as the petitioner, I've compiled and sent the following to my fiance:

I-134
W2, Pay Stubs
Letter from Employer
2019 Tax Transcript

Signed and dated letter confirming legally able and willing to marry (our I-797 expired in April)

Is there anything else I should provide? He will have his birth certificate, ARCO, and passport pictures, confirmations of DS160, courier, visa fee, and interview emails. Additionally, his passport is valid way beyond 6 months. Are we missing anything?

I had my interview today in newark, nj! My appointment was 9.45 it said on the letter you would NOT be allowed in any earlier than 15 minutes before your appointment. We got there half hour early so sat in the car for 10 mins and then went in.. when we walked to the entrance there was a massive line around the building to get in!! Ofcourse I panicked thinking they wouldn t take me. Around 10.10 am we got in the building went thru security and then went upstairs to check in, after another 20/30 minute wait the officer called us. He was extremely nice from the beginning. He took us down stairs and told us to wait another 20 mins while he reviewed our case. When we went in he asked for any joint documents / photos etc. He looked thru our photos and just spoke like it was a normal conversation asking how we met etc. He asked us each other s full names and birthdays. Asked my husband when we got married and then the yes/ no questions.

I was worried as I overstayed my esta but when he got to the question about if you ever violated terms and conditions of your immigration status he just said and you overstayed your esta? I said yes and he moved on...

he didn t approve on the spot but told me I can apply for citizenship in 3 years and said I would get greencard within a month if all goes well and gave me a letter saying it was being reviewed. I tried to give him updated tax forms and he said you know what I don t even need it I know this is a real marriage, you guys have a kid and you ve given me enough evidence

Just patiently waiting to see if it ll be approved any time soon!

just wanted to let people know that it is a very very scary thing to do but just take a deep breath and be yourself!!

Background check question?

I married my husband (from the UK) last year and he's already received his green card. When my husband lived in the UK, he had a few cautions on his record that showed on his immigration background check. I am currently in the middle of a custody battle and my ex could (and knowing him, he probably will) ask for a background check on my husband. My question is, will his immigration stuff show up on that background check? He had ordered one back in England for a job and it said no arrests or charges but that wasn't for immigration. Since moving here, he has not done anything, not even a speeding ticket. I'm curious to see if immigration transfers his cautions (even though we don't have those in the US like the UK does) to his criminal background or will it show no criminal history?

AOS interview scheduled, but still no EAD or AP - Is this normal?

Hi,

My wife is adjusting status from ESTA. We applied at the end of April and have still been waiting for her EAD and AP (which seems extremely backlogged right now with the pandemic and USCIS generally being backlogged). We are not too concerned about that aspect at this point given the current "normal."

However, today her I-485 status was changed to "Interview was scheduled." It seems like very exciting news, but it caught both of us off-guard because we were expecting a much longer wait given we have not heard back about the EAD and AP. Is it weird that things have happened in this order or is a sign of different parts of the chain taking care of different forms? I assume the I-485 interview is handled by the Milwaukee field office (where we would interview) while the other forms for EAD and AP are handled by the national benefits center, right? In this case, the field office may just be less backlogged than the NBC.

So here's the rundown:

- Got a letter for my medical condition from Neurologist

- Sent in email request to London Embassy on Dec 1st

- Got email confrmation of appointment for Dec 8th

- Went to interview (he's on his way back home as I type) got a green letter

In the green letter there is check marks for "updated medical" - we were anticipating this bc he had his medical was done in March right before the world shut down. "Updated Police Cert" that we also anticipated as it was well out of the 6 months. There was also a check mark on "other" National Interest Exception.

We will schedule out medical and all that what we are confused about is the National Interest Exception. Is there an application we need to fill in? I see one in Departent of state for work related visas but not anything about ours in particular. If we don't meet the requirements for this exception did we mess up our whole process. It should be noted that they DID keep his passport. I am not familiar with this at all and any information would be amazing.
