Sending cases to the department of state/consulate

In the recent ********removed*******, they have the following paragraph:

"Transfers to the Department of State's National Visa Center have also slowed in the second quarter, tacking on an additional 2 months for cases post-approval. Cases that are currently being sent to the DOS (NVC) have spent a total of 8 to 11 months at USCIS, with a median wait time of 9.3 months"

I got very anxious reading this. Does it really mean that once getting the NOA2, it takes a median of 9.3 months wait after? ridiculous :(

We are NOA1 of December 10th 2024. Still waiting, ** says we are 2700 cases from the front of the line. So maybe 2 to 3 more months wait if they dont hurry like the do sometimes, or more if they stall more.

So after that, another year?! to just being out of USCIS?

what is your experience? (well, now things are different anyway)

Alos, my future step son is 20 yo. we were hoping to bring him over. At his rate, he may turn 21 before they can come, and we need to be married before he is 21. So he might not be able to come over.

What a nightmare. I am just really venting, but thanks for commenting your thoughts and experiences.

VAWA case: No update after RFE response + EAD renewal receipt never received

Hi everyone, I m posting on behalf of a friend and we would really appreciate your input.

She applied for a green card about three years ago, then filed for VAWA and got divorced after obtaining a restraining order. A few months ago, she received an RFE for her VAWA case and responded to it. Since then, the status just says something like RFE was received.

We have a couple of questions:

1.- Her I-485 shows Case is actively being reviewed by USCIS. However, under the MyProgress tab, it says she doesn t need to attend an interview (it's marked as completed), and that she s on step 4 of 4 (Case Decision). This has stayed the same for several weeks with no further updates. She tried contacting USCIS, but hasn t been able to get any useful information. Is this normal?

2.- Her I-765 expired almost a month ago. She filed for renewal about 3 months ago but never received a receipt notice. She recently resent the renewal application, but still hasn t received anything. This is what s worrying her the most, as she can t continue working without a valid EAD. USCIS told her to send an email to a specific address, but it s been a couple of weeks with no reply. What should she do in this situation?

I-130 confused on processing times

Sorry to start a new topic, but I ve been looking everywhere, forums, lawyers, even ChatGPT, and I m still very confused.

My mom is a lawful permanent resident (LPR) and filed an I-130 petition for my brother, who is currently under 21. The petition was filed in December 2023, and my brother will turn 21 in November 2025.

We ve spoken to two different immigration lawyers, and they gave us conflicting answers:

  • One lawyer said that when we filed the I-130, the visa was current, and we could have filed for adjustment of status right away. (The last time the visa category for children of LPRs was current was in early 2023.) They also said that even if my brother turns 21, we can still apply for the green card once the I-130 is approved, and he won t age out.

  • The other lawyer said the I-130 would take at least 3 years to be approved and that my brother would age out unless both the I-130 is approved and we file for adjustment of status or consular processing before he turns 21.

Because of this conflicting information, I started reading online forums and asking ChatGPT, but I keep getting mixed answers. Some say that children under 21 of LPRs are in the immediate relative category (like children of U.S. citizens), and others, including ChatGPT at times, say they fall under the F2A category and may have to wait 4 5 years.

According to USCIS's case processing times, the California Service Center currently takes up to 55 months to process an I-130 for a child of an LPR (F2A category).

I m now really worried that, unless something changes, the I-130 won t be approved before my brother turns 21, and that he will age out and lose eligibility under the F2A category.

Is there anything we can do to preserve his eligibility? Does the Child Status Protection Act (CSPA) offer any protection in his case, and what steps should we take, if any, before he turns 21?

One last important detail: my brother is currently in the U.S. on a valid student visa and is expected to finish his studies by September or October of this year.

Any clear, fact-based guidance would be sincerely appreciated. We re overwhelmed with the conflicting advice and just want to make sure we do everything we can to help before it's too late.

Average time from interview and oath scheduled (letter)?

Hello!

I passed my interview and naturalization test on 4/17. I was told a letter will be soon in the mail with my ceremony details. I am curios on the average time frame here (I am in Boston). How long until I see an update in my portal? Still shows "Oath Ceremony will be mailed".

Hi there!

For those of you who have attended your naturalization ceremonies in recent years in Boston, how common is it to have an administrative ceremony at the USCIS field office?

How often did you have a judicial ceremony instead, at locations like the Moakley Courthouse?

I'm just curious about the odds of my ceremony being one or the other hopefully just a few weeks from now!
