US Immigration from Singapore

Compared to July where we saw 34 approvals, we are pushing triple digits! We have seen 25% of the approvals being K1-Visas which is a huge jump from 0% in July!

"Ahead of the election we're airing a series of voter roundtables. Last week, for instance, we spoke with three voters from Wisconsin. This week we spoke with three voters who are military veterans. And this coming Wednesday from 10-11 a.m. ET we're hoping to speak with three newly naturalized citizens who will be voting for U.S. president for the first time this November.

I've reviewed 8 USC 1101 (a) 15 and (20) and it appears that K1 entrants who adjust status to Permanent Resident will always be considered not "lawfully admitted for permanent residence as an immigrant".

It was my understanding that the "Non-Immigrant" status of a K1 Visa Beneficiary was temporary -only 90 days- after which the Beneficiary either left the USA or married the Sponsor and completed Adjustment of Status.

The removal of the Non-Immigrant intent was the benefit of K1 as opposed to B1 or unlawful crossing to then wed a USC. It was my understanding that the Non-Immigrant status of a K1 Visa entrant was special/unique and only temporary because of the 90 day requirement to marry or depart. The continuation of Non-Immigrant Intent beyond the Adjustment of Status to PR seem discriminatory at the least. This is in reference to 42 USC 1436a.

It just seems so contrary to the entire scheme of lawful immigration procedure. It's as if the INS has created a sub-class of Permanent Resident.

Asking this on behalf of a friend:

My friend's parents and he moved to US through family based GC. They were sponsored by his aunt. My friend stayed in the US and now a citizen. His father continued coming to the US from 2008 to 2016 to maintain PR status but his mother only came once to US on GC. Now, they (his parents) want to renew their GC and move to the US.

Question:

Can they(parents) apply for a Returning Resident (SB-1) immigrant visa or i-407? or does he need to petition again for their GC?

Any help/guidance is appreciated.
