Hi all , I was married, filed I-130 and I-485 concurrently with my ex wife . Case has been pending since 2018 went through a lot with with ex wife . Filed for divorce in 2020 and remarried SOMEONE else. It s been a year of being married , we are having a baby together plus tons of evidence already and mortgage in both our names. Filed I-130 on 12/23/2022 online with current spouse , and front loaded with all the evidence. About to file i-485 this week. So question:
1) I have a valid EAD card that expires in 2024 , do I need to apply for a new EAD card (form I-765) when filing I-485 ( if yes, am I applying for renewal of permission or initial permission for employment) or do I just file for i-485 now and wait until the EAD card expires to file for renewal with new case
2) i intend withdrawing the old I-130 and I-485 from my previous marriage during the interview whenever we are called for it (based on consultation with an immigration attorney ) is that the right way to go about it or should I withdraw it NOW before putting in the new i485 this week ?

I will appreciate any help I can get

Hi Good morning,

Pls I need some useful information, I arrived in South Carolina on K1 visa on Wednesday the 28th of this month which is 2 days ago.

I have from now till march 27th 2023 to get married but my fianc insisted that we go for our court wedding next week Monday which is few days after my arrival

so that we can have our marriage license and to begin processing other things while we have plans to have our wedding celebration with friends and families in 1st week of march 2023.

My questions are:

1. Is it not too early for us to have our court wedding on Monday which is few days after I arrived ?

2. If it is okay to go ahead, what forms and documents do we need to put together for AOS, WORK AUTHORIZATION, AND MORE.

3. How many forms do we have to submit at ones to save time and money and what are the requirements ?

4. I was not given I-94 at the port of entry, how do I go about that ?

5. Lastly, my family will not be available to witness for the court wedding but will be available for our wedding celebration in march 2023, is my fianc two kids enough to witness for us on our court wedding?

Your advice will be greatly appreciated.

My wife and I have been married since June 2019. We filed taxes jointly for the first year but decided to file married but filing separately on our subsequent taxes. We both make good money. Will filing taxes under married but filing separately have any impact on her being my sponsor for the I-130 application? She s USA citizen.

Thank you in advance

My tax guy dropped the ball and didn t file my taxes on time now it s too late to E-file this years taxes. I had to go into a local IRS office to drop off my taxes and have them stamp it as proof that it was filed via paper. The man in the office told me that it can take up to 6 months just for the transcript to appear online because of the backlog however I have the physical copy with a stamp from the IRS as proof that it was filed via paper. Will this a justifiable document to take to the interview?
