I-751/N-400 DENIED despite rescheduling Interview

Situation: I called the contact center to reschedule my interview when I received the interview notice in August because my husband would be on a mandatory, two-week work trip in October, when our interview was scheduled. I received a letter from USCIS acknowledging the reschedule request for the N-400 case and confirming it would be rescheduled. I assumed since it was one interview, my rescheduling was confirmed. However, on the day of the original interview, the 751 was denied and closed. When I followed up, the contact center explained that my reschedule request had only been applied to the 400 application and not the 751 even though both were supposed to be adjudicated together at the same interview and this was what I requested the agent to do on the phone. The agent guaranteed my N-400 would still be rescheduled and both cases could still be adjudicated at that interview, which was definitely not true after I spoke to an immigration attorney.

Today, I have now received yet another denial letter for the N-400 and the reason given is that I failed to appear for my N-400 interview, despite the fact that I have a letter from the field office confirming my reschedule request for the N-400.

Do you think it's worth filing and I-290B/N-336 to save both applications since I have that reschedule confirmation from USCIS and I have proof that I contacted CIS in good timing to reschedule with documented evidence? Or do I need to file a fresh I-751? I am still happily married to my husband so this will not be a waiver case, and we are way past the 90-day deadline. My lawyer thinks I have a decent case for an I-290B but she's also very forthcoming and is clear that it could very well be denied. She wants to try a wait and see approach, but I don't mind filing an I-290B and a fresh I-751 together.

My dear colleagues,

my us citizen child filed I 485 and I 130 concurrently for us her both parents.

we sent all neccessary documents.

we got EAD and social security, months after my wife got her green card, mine was not sent.

I received REQUEST FOR EVIDENCE on my I 130 that.

I should submit our marriage certificate issued with seal and duly signed.

submit evidence that I and my daughter had a valid parent-child relationship before my child turned 18.

5 days after I got another message on both I 485 and I 130, that my case is being actively reviewed, and that their records show that, I dont have any thing outstanding with them. This is confusing what can I do please help.

Hello, my Fiance is currently awaiting her new scheduled interview on October 23rd in Almaty Kazakhstan. She has a new medical appointment on October 20th. Originally, she was supposed to be in Warsaw Poland but was denied her Schenghen visas and was accepted a transfer to Almaty. The only question we have is her K1-FTP still says Warsaw Poland on it. She has a new interview date and a completed Ds-160 through Kazakhstan. I have reached out to my lawyers and to the NVC inquiry form to see if we can get another one if needed.


Has anybody experienced another embassy accepting the original K1-FTP in regards to a transfer case? Thank you all for your time.

Hello all, I am in a bit of a situation with my fiance and her K1 interview. She is a Russian foreign national who was originally scheduled to have her K1 interview in Warsaw Poland on August 26th. Her Schengen visa was approved from Greece originally to cover the date. However, when she went to her medical exam they forced her to return on August 27th for further inquiry into her medical history ( which in my opinion, was complete <DELETED>but thats another story). We got her interview date in Warsaw switched and then she went back to Moscow to reapply for a new Schengen visa once her old visa expired.


She reapplied on September 1st and on September 6th she was denied this time, despite having the exact same application as before. The only difference is she doesnt work anymore because she quit her job to leave the country. She had more money in her bank account than the first time and i used myself as a supporter of funds as well. We had a cover letter also that explained our situation and why she didnt have a job compared to last time. Also, we of course had all of our flights and hotels mapped out to where we were staying and we stayed more days in Greece than Poland as well. We also, just like the first time had a flight showing us leaving Europe.

We are utterly devastated because now she cant get to Warsaw. Is there any advice you guys could give me in what we should do? My lawyers are now trying to get the case moved to another embassy but I doubt this will work. Has anybody had any success? I have yet again called my senators office to see if there is something that they could do.
